WHEREAS, a public storm sewer now in operation lies in
Lot 10A of West Forest View Subdivision, Township 46 North, Range
5 East, in St. Louis County, Missouri, in an easement recorded in
Deed Book 6766, Page 119 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct an open air canopy across
said sewer, and examination and survey of such sewer and of such
open air canopy shows that the proposed encroachment will not
damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized to license the aforesaid
encroachment over said storm sewer in Lot 10A of West Forest View
Subdivision, Township 46 North, Range 5 East, in St. Louis County,
Missouri, in an easement recorded in Deed Book 6766, Page 119 of
the St. Louis County Records, provided that the District is
indemnified against liability, loss, or damage from such
encroachment.
The foregoing Resolution was adopted June 19, 1991.
