WHEREAS, proposed public storm and sanitary sewers lie
in easements as shown on the North line of Lot 1 of West Port
Industrial Subdivision 2nd Addition, as recorded in Plat Book 107,
Pages 98 and 99 of the St. Louis County Records, and also shown on
the North line of Lots 1 and 2 of West Port Industrial Subdivision
4th Addition, as recorded in Plat Book 120 Page 15 of the St.
Louis County Records, in U.S. Survey 358 Township 46 North, Range
5 East; and
WHEREAS, the owner of the land in which such proposed
sewers lie has requested permission to construct a building across
a portion of said sewer easements, and examination and survey of
such sewers and of such construction shows that the proposed
encroachment will not damage the proposed sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive be
and he is hereby authorized and directed to license the aforesaid
encroachment on easements, provided that the right of the District
to use the easements is preserved and the District is indemnified
against liability, loss or damage from such encroachment.
The foregoing Resolution was adopted July 9, 1991.
