WHEREAS, an easement lies in Lot 68 of The Forest Plat
Three, in Township 45 North, Range 4 East, St. Louis County,
Missouri, as shown as a 10 foot east-west easement in the middle
of said Lot 68, and as recorded in Plat Book 269, Pages 44 and 45
of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement
lies has requested permission to construct a wooden deck across a
portion of said sewer easement, and examination and survey of such
easement and of such construction shows that the proposed
encroachment will not damage the existing easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted August 14, 1991.
