WHEREAS, a public sanitary and public storm sewer now
in operation lie in 50 foot wide easements as recorded in Book
1883, Page 92 and Book 4033, Page 207, that fall within Parcel #2
of the Deed of Transfer of Property from Dillard's Department
Stores to Hycel Partners in United States Survey 2485 and 2679,
Township 45 North, Range 6 East, City of Richmond Heights, as
recorded in Deed Book 7615, Pages 1409 through 1411, of the St.
Louis County Records, and
WHEREAS, a public sanitary sewer now in operation lies
in a 10 foot wide easement as recorded in Book 9055, Pages 1986-
1999 of the St. Louis County Records that falls within Lots 1A,
1B, 6, and 8 of the Galleria Subdivision, as recorded in Plat Book
298, Pages 80-82 of the St. Louis County Records; and
WHEREAS, a public storm sewer now in operation lies in
a 50 foot wide easement as recorded in Book 9055, Pages 1986-1999
of the St. Louis County Records that falls within Lots 1A, 1B, 6
and 8 of the Galleria Subdivision, as recorded in Plat Book 298,
Pages 80-82 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to construct buildings, parking
structures, drives, parking lots and other improvements across a
portion of said sewer easements, and examination and survey of
such sewers, and of such construction shows that the proposed
encroachment will not damage the existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easements, provided that the right
of the District to use the easements is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted August 14, 1991.
