WHEREAS, an easement lies in Lot 21 of Sherwood Lake
Estates, in U.S. Survey 1920, Township 46 North, Range 6 East, St.
Louis County, Missouri, as shown as an irregular width East-West
easement in the middle of said Lot 21, and as recorded in Plat
Book 125, Pages 24 and 25 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement
lies has requested permission to construct a conservatory and deck
across a portion of said sewer easement, and examination and
survey of such easement and of such construction shows that the
proposed encroachment will not damage the existing easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted November 6, 1991.
