WHEREAS, easements lie in Jamestown Mall in Part of
U.S. Survey 2771 Part of Sections 8 & 17, in Township 47 North,
Range 7 East, St. Louis County, Missouri, as shown as easements
recorded in Plat Book 153, Pages 36 and 37 of the St. Louis County
Records; and
WHEREAS, the owner of the land in which such easements
lie has requested permission to construct commercial buildings
across a portion of said sewer easements, and examination and
survey of such easements and of such construction shows that the
proposed encroachment will not damage the existing easements;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easements provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted March 11, 1992.
