R2049 R E S O L U T I O N NO. 2049 WHEREAS, an easement lies in Lot 2 of Cookshire Subdivision and U.S. Surveys 366 and 369, in Township 45 North, Range 4 East, St. Louis County, Missouri, as shown as a variable width easement along the southern property line of said Lot 2, and as recorded in Plat Book 288, Page 58 of the St. Louis County Records; and WHEREAS, the owner of the land in which such easement lies has requested permission to construct a railroad tie retaining wall across a portion of said sewer easement, and examination and survey of such easement and of such construction shows that the proposed encroachment will not damage the existing easement; NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and he is hereby authorized to license the aforesaid encroachment on easement provided that the right of the District to use the easement is preserved and the District is indemnified against liability, loss or damage from such encroachment. The foregoing Resolution was adopted April 29, 1992
