WHEREAS, an easement lies in Lot 4 of Wood Valley
Subdivision, in Township 45 North, Range 4 East, St. Louis County,
Missouri, as shown as a 10 foot easement along the south and east
property lines of said Lot 4, and as recorded in Plat Book 149,
Page 68 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement
lies has requested permission to construct a railroad tie
retaining wall within a portion of said sewer easement, and
examination and survey of such easement and of such construction
shows that the proposed encroachment will not damage the existing
easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized to license the aforesaid
encroachment on easement provided that the right of the District
to use the easement is preserved and the District is indemnified
against liability, loss or damage from such encroachment.
