WHEREAS, an easement lies in Part of Lot 3 of Taylor
Heights and in the S.W. 1/4 of Section 31, in Township 45 North,
Range 5 East, St. Louis County, Missouri, as shown as a 10 foot
easement in said Part of Lot 3, and as recorded in Deed Book 6374,
Page 194 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement
lies has requested permission to construct a one story building
across said sewer easement, and examination and survey of such
easement and of such construction shows that the proposed
encroachment will not damage the existing easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted June 10, 1992.
