R2066 R E S O L U T I O N NO. 2066 WHEREAS, an easement and right-of-way lie in part of Share 3 of the Partition of James T. Walton's Estate, in U.S. Survey 2966, in Township 46 North, Range 6 East, St. Louis County, Missouri, as shown as a 10 foot easement in said Lot, and as recorded in Deed Book 3117, Page 610, and as shown as a 60 foot right-of-way in said Lot, and as recorded in Deed Book 7158, Pages 2133 and 2136 of the St. Louis County Records; and WHEREAS, the owner of the land in which such easement and right-of-way lie has requested permission to construct a box culvert and warehouse across a portion of said sewer easement and right-of-way, and examination and survey of such easement and of such construction shows that the proposed encroachment will not interfere with the existing easement and right-of-way; NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and he is hereby authorized and directed to license the aforesaid encroachment on easement and right-of-way, provided that the right of the District to use the easement is preserved and the District is indemnified against liability, loss or damage from such encroachment. The foregoing Resolution was adopted September 9, 1992.
