WHEREAS, an active sewer line lies in a tract of land
in U.S. Survey 1936, Township 44 North, Range 6 East, in the City
of Crestwood, St. Louis County, Missouri, and as recorded in Deed
Book 9181, Pages 1728 and 1729 of the St. Louis County Records;
and
WHEREAS, the owner of said real property has agreed to
grant to The Metropolitan St. Louis Sewer District an easement for
the aforementioned active sewer line; and
WHEREAS, the owner of the real property in which such
active sewer line lies has requested permission to construct a one
story commercial building addition over a portion of said sewer
easement when granted, and examination and survey of such easement
and of such construction shows that the proposed encroachment will
not damage the existing sewer in said easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted September 9, 1992.
