HomeMy Public PortalAboutR2096 R E S O L U T I O N NO. 2096 WHEREAS, a public sanitary sewer now in operation lies in an easement in Lots 12 and 13 of The Terraces at Woods Mill Cove Plat 2, in St. Louis County, Missouri, as shown as an irregular width easement at the rear of said Lots 12 and 13, and as recorded in Plat Book 285, Page 25 of the St. Louis County Records; and WHEREAS, the owner of the land in which such sewer lies has requested permission to construct a masonry retaining/garden wall across a portion of said sewer easement, and examination and survey of such sewer and of such construction shows that the proposed encroachment will not damage the existing sewer; NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and he is hereby authorized to license the aforesaid encroachment on easement, provided that the right of the District to use the easement is preserved and the District is indemnified against liability, loss or damage from such encroachment. The foregoing Resolution was adopted May 12, 1993.
