WHEREAS, a ten (10) foot wide easement lies in the
Common Ground of Hilltop Plaza, a subdivision in the City of
Bridgeton, St. Louis County, Missouri and as shown in Plat Book
303, Pages 32 and 33 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement
lies has requested permission to construct two retaining walls in
a portion of said sewer easement, and examination and survey of
such easement and of such construction shows that the proposed
encroachment will not damage the existing easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted August 11, 1993.
