WHEREAS, a public storm sewer now in operation lies in
an easement in a tract of land being part of "Hanley's
Resubdivision of Blocks 6, 7, 8, 9 and 20 of Hanley's Addition to
Clayton", and part of Block 12 of "Northmoor Park Addition", in
the City of Clayton, St. Louis County, Missouri, as shown as a
seven foot (7') wide easement in said tract, and as recorded in
Plat Book 260, Pages 57 and 58 of the St. Louis County Records;
and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to maintain existing brick walls across
portions of said sewer easement, and examination and survey of
such sewer and of said walls shows that the existing encroachments
will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized to license the aforesaid
encroachment on easement, provided that the right of the District
to use the easement is preserved and the District is indemnified
against liability, loss or damage from such encroachment.
The foregoing Resolution was adopted September 8, 1993.
