WHEREAS, a public storm sewer now in operation lies in
an easement in Lot 5 of Sackston Woods in the City of Creve Coeur,
St. Louis County, Missouri, as shown as a 10' easement in said Lot
5, and as recorded in Deed Book 8898, Pages 1734 and 1735 of the
St. Louis County Records; and
WHEREAS, the Trustees of Sackston Woods, the
subdivision in which such sewer lies, have requested permission to
construct a masonry entrance monument in a portion of said sewer
easement, and examination and survey of such sewer and of such
construction shows that the proposed encroachment will not damage
the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized to license the aforesaid
encroachment on easement, provided that the right of the District
to use the easement is preserved and the District is indemnified
against liability, loss or damage from such encroachment.
The foregoing Resolution was adopted November 17, 1993.
