R2122 R E S O L U T I O N NO. 2122 WHEREAS, public sanitary sewers now in operation lie in easements in Lots 7, 8, 10, 11, 14 and 15 of The Terraces at Woods Mill Cove Plat 2, in St. Louis County, Missouri, as shown as an irregular width easement at the rear of said Lots 7, 8, 10, 11, 14 and 15, and as recorded in Plat Book 285, Page 25 of the St. Louis County Records; and WHEREAS, the owner of the land in which such sewers lie has requested permission to construct a masonry retaining/garden wall across a portion of said sewer easements, and examination and survey of such sewers and of such construction shows that the proposed encroachment will not damage the existing sewers; NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and he is hereby authorized to license the aforesaid encroachment on easement, provided that the right of the District to use the easements is preserved and the District is indemnified against liability, loss or damage from such encroachment. The foregoing Ordinance was adopted January 12, 1994.
