WHEREAS, a public sanitary sewer now in operation lies in an
easement in Lot 4 of Brightfield Place, a subdivision in St. Louis County,
Missouri, as shown as a 15 foot wide easement along the North line of said Lot
4, and as recorded in Plat Book 320, Page 62 of the St. Louis County Records;
and
WHEREAS, the owner of the land in which such easement lies has
requested permission to construct "Versa-Lok" retaining walls within said
sewer easement, and examination and survey of such easement and of such
construction shows that the proposed encroachment will not damage the existing
sewer in said easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and
he is hereby authorized and directed to license the aforesaid encroachment on
easement, provided that the right of the District to use the easement is
preserved and the District is indemnified against liability, loss or damage
from such encroachment.
The foregoing Resolution was adopted May 11, 1994.
