R E S O L U T I O N NO. 2145
WHEREAS, an easement lies in Lot 76 of "Barrett Station Place", in
Township 45 North, Range 5 East, St. Louis County, Missouri, as shown as a
variable width east-west easement along the south line of said Lot 76, and as
recorded in Plat Book 306, Pages 34 and 35 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement lies has
requested permission to construct a wooden deck which will cantilever across a
portion of said sewer easement, and examination and survey of such easement and
of such construction shows that the proposed encroachment will not damage the
existing sewer in said easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and
he is hereby authorized and directed to license the aforesaid encroachment on
easement, provided that the right of the District to use the easement is
preserved and the District is indemnified against liability, loss or damage
from such encroachment.
The foregoing Resolution was adopted June 8, 1994.
