R E S O L U T I O N NO. 2149
WHEREAS, a public storm sewer now in operation lies in an easement
in Lot 25 of Grantview Forest Plat One, in St. Louis County, Missouri, as shown
as a fifteen foot (15') easement in said Lot 25, and as recorded in Plat Book
320, Page 46 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such sewer lies has
requested permission to construct a deck across a portion of said sewer
easement, and examination and survey of such sewer and of such construction
shows that the proposed encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and
he is hereby authorized to license the aforesaid encroachment on easement,
provided that the right of the District to use the easement is preserved and
the District is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted July 13, 1994.
