BE IT RESOLVED by the Board of Trustees of The
Metropolitan St. Louis Sewer District ("District") that effective
January 1, 1995, customers of the District whose property is
thereafter damaged as a result of a sewerage backup caused by the
negligence of District employees, malfunction of the sewerage
system, obstructions such as roots, grease, etc. or some other
occurrence that could have been avoided, shall be fully compensated
for their property damage.
No compensation shall be paid for property damaged as a
result of a defective or blocked house lateral or an overcharged
District line resulting from a storm event.
The foregoing Resolution was adopted December 8, 1994.
