WHEREAS, Section 610.023.1, RSMo, provides that a public governmental body
is to appoint a custodian who is to be responsible for the maintenance of that body's records
and the identity and location of the custodian is to be made available upon request, and
WHEREAS, Section 610.025, RSMo, provides that a public governmental body
may prescribe reasonable fees for providing access to or furnishing copies of public records,
however, the fees shall not exceed the actual cost of document search and duplication;
WHEREAS, Section 610.028.2, provides that a public governmental body shall
provide a reasonable written policy in compliance with Sections 610.010 to 610.030, RSMo,
commonly referred to as the Sunshine Law, regarding the release of information on any
meeting, record or vote.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That the Secretary-Treasurer be and hereby is appointed
custodian of the records of The Metropolitan St. Louis Sewer District and that such custodian
is located at 2000 Hampton Avenue, St. Louis, Missouri 63139-2979.
Section Two. That said custodian shall respond to all requests for access to or
copies of a public record within the time period provided by statute except in those
circumstances authorized by statute.
Section Three. That the fees to be charged for furnishing copies of records shall
be as follows:
1-10 copies = $0.10 per page
11-199 copies = $0.04 per page
200+ copies = $0.02 per page
(In addition to copy charges, an additional service charge will be made for
actual labor costs for locating and retrieving documents.)
plus postage, if mailed, which fee has been determined to not exceed the actual cost of
document search and duplication. No charge shall be made for copies of the Board of
Trustees agenda or journal.
Section Four. That it is the public policy of The Metropolitan St. Louis Sewer
District that meetings, records, votes, actions, and deliberations of this body shall be open to
the public unless otherwise provided by law.
Section Five. That The Metropolitan St. Louis Sewer District shall comply with
Sections 610.010 to 610.030, RSMo, the Sunshine Law, as now existing or hereafter
amended.
Section Six. The Resolution shall replace and supersede Resolution No. 1931
adopted March 23, 1990.
The foregoing Resolution was adopted April 18, 1996.
