HomeMy Public PortalAboutR3004RESOLUTION NO. 3004 WHEREAS, in order to preserve the District’s right to be reimbursed for project costs from a tax exempt bond issue, the United States Treasury Department requires that the projects to be reimbursed for, be approved by Board resolution, and WHEREAS, in order for the St. Louis Community to address health and safety issues and to comply with federal and state clean water laws and regulations, the community, through The Metropolitan St. Louis Sewer District (MSD) must construct, improve, renovate, repair and replace wastewater facilities and system, including sewers, pump stations, treatment plants, and such appurtenances as necessary, and WHEREAS, MSD called for an election on August 5, 2008, presenting the St. Louis City and St. Louis County voters the option of funding said improvements by authorizing the issuance of Two Hundred Seventy-Five Million Dollars ($275,000,000.00) in revenue bonds to pay for the local share to build necessary improvements to meet federal and state clean water laws and regulations, and WHEREAS, the water environment of the community will be greatly enhanced by these improvements to meet federal and state clean water laws and regulations, and WHEREAS, the construction activity as generated in the community by this work will create hundreds of new jobs and benefit the entire regional economy, and WHEREAS, the MSD Board of Trustees and District Staff are limited in spending these funds solely for the engineering, construction, and other related project costs (i.e. easement acquisitions) associated with those projects, designed to bring the community into compliance with federal and state clean water laws and regulations, as identified in Exhibit A of this resolution, and WHEREAS, the engineering of all projects to be funded by this bond issue shall be done by qualified professional engineers as selected by a fair and independent process of reviewing firms’ qualifications and knowledge of the work to be performed, and WHEREAS, the construction of all projects to be built from the proceeds of such bond issue shall be subject to the competitive bid process and WHEREAS, any and all parties receiving compensation for work completed on behalf of MSD from funds generated by the sale of said revenue bonds authorized by the voters in the August 5, 2008 election shall be required to sign a conflict of interest statement prior to being selected by MSD to perform any work, and WHEREAS, none of the funds generated by the sale of said revenue bonds authorized by the voters in the August 5, 2008 election shall be used for any non-bond related expenditures, such as salaries, benefits nor any other operating expenses, and WHEREAS, the funds generated from the sale of such bonds approved by voters at the August 5, 2008 election, will be placed into a special fund created by The Metropolitan St. Louis Sewer District Board of Trustees specifically for the engineering, construction, and other related project costs associated by the projects identified in Exhibit A of this resolution, and WHEREAS, the Board of Trustees and Staff will make quarterly reports on the progress of the projects listed in Exhibit A of this resolution and shall have an independent audit conducted by an outside accounting firm to audit the projects as they progress. The results of the audits will be made available to the public, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPLITAN ST. LOUIS SEWER DISTRICT THAT, it wishes to pledge to the public it serves its commitment to help protect their health and safety, and preserve the water resources of our community by building the projects identified in Exhibit A of this resolution. BE IT FURTHER RESOLVED, the Board thanks the public for its help and support in this task by its vote on August 5, 2008. The foregoing Resolution was adopted December 8, 2011 by the following vote - Ayes – E. Ross, D. Visintainer, J. Goffstein, R. Berry, and J. Buford. Nays – None.
