WHEREAS, Ordinance No. 13304, adopted September 8, 2011, authorized the
Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into a contract with Kohn, Shands, Elbert Gianoulakis & Giljum, LLP, whereby
Kohn, Shands, Elbert Gianoulakis & Giljum, LLP would provide Legal Consulting Services
pertaining to storm water rate issues.
WHEREAS, said contract provided for an initial term of one (1) year with a
renewal term at the option of the District until the final resolution of William Douglas Zweig, et
al on behalf of themselves and all others similarly situated vs. The Metropolitan St. Louis Sewer
District, and
WHEREAS, the District desires to exercise its option to renew said contract
through final resolution of aforementioned lawsuit.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRAUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT THAT, the Executive Director and
Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer
District to exercise the District’s option to renew the contract with Kohn, Shands, Elbert
Gianoulakis & Giljum, LLP, until the final resolution of William Douglas Zweig, et al on behalf
of themselves and all others similarly situated vs. The Metropolitan St. Louis Sewer District,
whereby Kohn, Shands, Elbert Gianoulakis & Giljum, LLP will provide Legal Consulting
Services pertaining to storm water rate issues, and said contract renewal shall be comprised of
such terms and conditions as are approved by the Office of the General counsel of the District.
The foregoing Resolution was adopted September 27, 2012 by the following vote –
Ayes – E. Ross, R. Berry, A. Mandel, and J. Buford.
Nays – None.
