Jane Moore seconded the motion. Motion passed unanimously. Rules of Procedure a. Eric Barron presented the Rules of Procedure. b. Mary Schantz asked Eric for clarification regarding a couple of the Rules. Eric explained the reasoning of the specific Rules in question. Jayme Abbott stated that if procedural questions arise during future HPC meetings, the City attorney present at that particular meeting can be consulted at that time. Eric stated that if necessary, the Rules of Procedure may be amended by the Commission in the future if the Commission Members agree that changes to the Rules are needed. c. According to MidMOGIS the property was constructed in 1910, therefore the age of structure is over 100 years old. In accordance with Section 8-47(A)(1)(a) the property was posted with a public hearing sign on February 28, 2018. Exterior and interior photos, MIDMOGIS Map, and other documentation are attached. STAFF ANALYSIS Section 8-43(F)(1) Notable Structure With YES Respect NO To Historic Value Its association with an event or events that significantly contributed to the broad patterns of the history or architectural heritage of the city, county, state or nation; X The property is not individually listed on the National Register, local landmark or local historic district. Its association with the life or lives of a person or persons Significant in the history of the city, county, state or nation; X While each family that occupied this property has in some small way added to the fabric of Jefferson City history, they had no significant association with the history of the city, county, state, or nation. Its embodiment of distinctive characteristics of a type, design, period or method of construction X Reconnaissance or intensive level of survey has not been completed for this property. It represents the work of a master designer or architect or possesses high architectural value; X The architect for this property is unknown. American Folk Victorians were mainly built from plan books provided by architectural companies. It exemplifies the cultural, political, economic, social or historic heritage of the city X It contains elements of design, detail, material or craftsmanship which represent a significant construction innovation; X This house is a typical version of the American Folk Victorian popular from 1870 to 1910. The railroad system delivered the supplies necessary, and that were affordable to the common person, to dress up ordinary folk houses. It is part of or related to a square, park or other distinctive area that was or should be developed or preserved according to a plan based on a historic or architectural motif; X It is an established and familiar visual feature of a neighborhood or of the entire community; X This property, while it has stood for over 100 years, could not be called a familiar visual feature singularly. Elm, National Register Listing & locally designated landmark, and other various properties on the National Register of Historic Places. The historic preservation commission may request the applicant to submit documentation or other information necessary to determine whether the property can be rehabilitated or restored with a reasonable economic return to the owner. X Per the property owner, The cost of rehabbing/restoring the structure would not be economically feasible do to its current level of deterioration. Whether the property is located within an area identified for redevelopment within the adopted comprehensive plan, and the nature of the intended redevelopment. X This property is located within the Historic Southside, Old Munichburg District & Neighborhood Plan that was adopted in 2017. The property is located within an area identified as expanding housing choices by increasing the diversity of types and affordability while retaining and improving existing homes and developing new ones. The nature of the surrounding area and the compatibility of the structure to existing adjacent structures and land uses. X This property is within the boundaries of the area defined as "Munichburg in the Southside". The number of similar structures that exist within the City of Jefferson. X This property is one of many properties of the same architectural style located in Jefferson City. Plans for the preservation or salvage of notable historic or architectural features and historic fixtures that contributed to the finding of a notable structure. X The rock wall in front will remain intact and the property owner states that everything that can be salvaged will be including the foundation rocks. CONDITION THAT HISTORIC PRESERVATION COMMISSION OR CITY COUNCIL MAY IMPOSE In accordance to Section 8-43(I), The Commission or Council may impose conditions on the approval of a Historic Preservation Demolition Clearance in order to ensure that the demolition complies with any applicable requirements of this section that include, but are not limited to, the following: 1. To ensure that notable historic or architectural features or historic fixtures that contributed to the finding of a notable structure are being salvaged or preserved. 2. To ensure that a structure found to be a notable structure and approved for demolition clearance is properly documented for posterity. 3. To ensure that partial demolition of a structure found to be a notable structure does not result in establishment of an exterior finish that is out of character with the structure. 4. Other conditions that the Commission or City Council may deem appropriate to reduce the impact of the demolition with respect to the applicable review criteria. Conditions imposed by the Historic Preservation Commission may be appealed to the City Council in the manner provided for in Section 8-43(H) STAFF RECOMMENDATION In reviewing Section 8-43(F), Review Criteria (as outlined above), does not appear to hold significant historic value. Even though the structure is located within the "old Munichburg", the area itself has not been designated as a local historic district. The property is not individually listed on the National Register or designated as a local landmark. The recently adopted Historic Southside/Old Munichburg District & Neighborhood Plan does recognize the area for revitalization of existing properties and construction of new homes. The Jefferson City Fire Department responded and reported that there was a fire in the rear of the structure. Upon my site visit, the damage was extensive_ In accordance with Section 8-95 of City Code, 25% of the insurance proceeds ($23,869.92) were sent to the City of Jefferson to hold until the nuisance is abated since the loss exceeded more than 50% of the value of the policy. Improvements to the property are listed at $58,100 on MidMOGIS. As stated in the Dangerous Building Regulations, Section 8-81, the structure's condition is unsafe due to the fire damage and cannot be occupied. Given the repair cost exceeds 50% of the value (Section 8-82, paragraph 0), the City of Jefferson has the right to order it to be repaired or demolished. The owner has opted to voluntarily pursue demolition. Please note that if the owner did not pursue to abate the situation, the City of Jefferson would have eventually abated the nuisance by demolition. Given the above facts, the building's condition is categorized under the dangerous building City Code and is declared a nuisance. The structure's condition must be abated. Bowlin From Wikipedia, the free encyclopedia James Butler Bowlin (January 16, 1804 — July 19, 1874) was a U.S. Representative from Missouri. Born near Fredericksburg, Virginia, Bowlin took an apprenticeship to a trade, but abandoned it to teach at a school. He received a classical education and moved to Lewisburg, Virginia in 1825. Bowfin studied law and was admitted to the bar in 1822, commencing his practice in Greenbrier County. He moved to St. Louis, Missouri in 1833 and continued the practice of law. Bowlin also established the Fanners and Mechanics' Advocate. Bowfin served as Chief Clerk of the State House of Representatives in 1836. He served as member of the Missouri House of Representatives in 1836 and 1837, was appointed district attorney for St. Louis in 1837, and was an unsuccessful candidate for the State House of Representatives in 1838. Bowfin was elected judge of the criminal court in 1839 and served until his resignation in 1842. Bowfin was elected as a Democrat to the Twenty-eighth and to the three succeeding Congresses (March 4, 1843 — March 3, 1851). He served as chairman of the Committee on Private Land Claims (Twenty-ninth Congress), Committee on Public Lands (Thirty-first Congress). He was an unsuccessful candidate for reelection in 1850 to the Thirty-second Congress. James B. Bowlin. Bowfin was appointed Minister Resident to New Granada by President Pierce December 13, 1854. He was appointed commissioner to Paraguay by President Buchanan September 9, 1858, and served until February 10, 1859. Afterwards, Bowlin resumed the practice of law. The front has been changed, but the general structure can still be recognized. Mr. Brandenberger was an institution in this community. In his later years (1920s and early 1930s) when Mr. Brandenberger had younger men employed at the pharmacy, he presided over the store from his desk behind the counter. He was a portly man who could speak German. Note the sign "Deutsche Apotheke" between the upper story windows. He stocked home remedies and patented medicines, as well as medicines prescribed by physicians. Before construction of the Central Trust Bank, the upper floors of the Brandenberger Drug Store were filled with doctors' and dentists' offices. Two occupants were Dr. Phil Miller, a dentist, and Dr. J. S. Summers, a pioneer specialist of Eye, Ear, Nose and Throat. In the 1890s, an office visit to the physician might have cost as much as i0 cents, and "tonics" such as Lydia E. Pinkham's Tonic for Pale Ladies, Ind Peruna, were among the multitude of tonics that were advertised vith exaggerated claims (there was no Food and Drug Administration or ;overnment control over those advertisements). One case recalls a lady, a member of the Women's Temperance Union, vho died of alcoholic cirrhosis of the liver because she took Peruna. 'eruna had some active ingredients of questionable value in a wine base. teaspoonful was to be taken three times a day. This lady was taking 68 Jefferson City, 1890 - 1900 three to four bottles a day, not understanding that she was drinking alcohol in the poor quality wine base of the medicine. Just as the Central Trust Bank building was nearing completion, lightning in the form of a fire ball struck the Brandenberger Drug Store. The fire was brought under control quickly, but the offices could not be used. Two doctors moved to the 5th floor of the Central Trust Bank before it was completed. The site was not valued separately by prior arrangement and agreement with the client. The contributory value of the site was considered in the analysis of the sales and appropriate adjustments were made. The Cost Approach was not developed, despite this being an appropriate valuation technique with knowledge of the client. The Income Approach was not considered appropriate due to predominance of owner occupied properties in this price range and area. CONDITIONS OF THE REPORT This Limited Appraisal Departure Disclosure is part of the Limited Appraisal made according to the requirements and guildelines of USPAP as prepared by the Appraisaal Standards Board of the Appraisal Foundation. John Caskie Collet John Caskie Collet (May 25, 1898 — December 5, 1955) was a United States federal judge in Missouri. Collet was born in Keytesville, Missouri. He was in the United States Army Air Corps from 1917 to 1918, and read law in 1920. He was a City attorney of Salisbury, Missouri from 1922 to 1924, and then a county prosecutor for Chariton County, Missouri from 1925 to 1929. He then served as assistant counsel to the Missouri State Highway Department from 1930 to 1933. He became chairman of the Missouri Public Service Commission in 1933, and then became a member of the Missouri Supreme Court in 1935. On March 9, 1937, President Franklin D. Roosevelt nominated Collet to be a federal judge on the U.S. District Courts for both the Western District and Eastern District of Missouri, filling two new seats created by 49 Stat. 1804. He was confirmed by the United States Senate on March 15, 1937, and received his commission on March 20, resigning his position on the Missouri Supreme Court. Ten years later, on April 30, 1947, President Harry S Truman nominated Collet to the United States Court of Appeals for the Eighth Circuit, to a seat vacated by Kimbrough Stone. He was confirmed by the United States Senate on July 8, and received his commission the next day. Collet served on that court until he died in Kansas City, Missouri.
