WHEREAS, the adoption of Resolution No. 3460 will acknowledge that the
contract initially authorized by Ordinance No. 14542, adopted November 10, 2016, will be
amended to include the collection of excess proceeds from properties sold at the St. Louis
County tax sale auctions, pursuant to the changes in RSMo §140.230 becoming effective August
28, 2018, and will exercise option year two (2) of the said contract whereby The Law Offices of
Jonathan P. Beck, LLC will provide legal services for the collection of excess proceeds from
properties sold at the St. Louis City tax sale auctions.
WHEREAS, on August 28, 2018, changes to RSMo §140.230 became effective
and allowed lienholders of record to file a claim for excess proceeds from properties sold at the
St. Louis County tax sale auctions;
WHEREAS, said contract provided for an initial term of one (1) year with three
(3) additional one-year renewal terms at the option of the District; and
WHEREAS, The Metropolitan St. Louis Sewer District desires to exercise its
second (2nd ) of three (3) option years to renew said contract for an additional one-year term.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT THAT,
Section One: The contract initially authorized by Ordinance No. 14542, adopted
November 10, 2016, will be amended to also include the collection of excess proceeds from
properties sold at the St. Louis County tax sale auctions, pursuant to the changes in RSMo
§140.230 becoming effective August 28, 2018.
Section Two: The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to exercise the District's
option to renew for the second one-year renewal term the contract with The Law Offices of
Jonathan P. Beck, LLC, whereby The Law Offices of Jonathan P. Beck, LLC will provide legal
services for the collection of excess proceeds from properties sold at St. Louis City and St. Louis
County tax sale auctions.
Section Three: Said contract shall be comprised of such other terms and
conditions as are approved by the Office of the General Counsel of the District.
This foregoing resolution was adopted on October 11, 2018.
