Mayor Beckley called the regular meeting of the City Council 2. to order at 7:30 P. M. Invocation was given by Pastor A. R. Hagen of the Seventh Day Adventist Church, 9664,Broadway, 3. Temple City. Mayor Beckley then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen- Briggs, Harker, Merritt, Tyrell, Beckley ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Public Works Director P.i zzorno 5. APPROVAL OF MINUTES: Regular meeting of Nov. 7, 1967. Councilman Merritt moved to approve the minutes of the regular meeting of the Council held on Nov. 7, 1967, Councilman Harker seconded and the motion was unanimously carried. At this time Mayor Beckley called the attention of the audience to the portraits on display and advised they were of the Mayors of this City since incorporation. He then introduced Mr. Rayford Turner who presented the portraits to the City. Mr. Turner stated this presentation was his way of expressing . his appreciation for the privilege of living in Temple City, and for the many hours of work these men devoted to the people of Temple City in their service as Councilmen and Mayors of the City. Mayor Beckley expressed the appreciation of the City for the portraits and advised they would be hung in the Council Chambers. He requested the former mayors who were in attendance to step forward. The following comprised the Mayors and their term as Mayor: Merrill Fitzjohn 1960 -61 Howard Dickason 1961 -62 Jack R. Tyrell 1962 -63 A. L. Nunamaker 1963 -64 Louis W. Merritt .1964 -65 William A. Harker 1965 -66 Jack R. Tyrell 1966 -67 Paul W. Beckley 1967 -68 Following their introduction Mayor Beckley, with the assistance of Mayor Pro Tem Briggs, honored all former Mayors and presented each with a walnut plaque for them to take home and thanked them for their attendance at this time. Mayor Beckley also welcomed the young people from Oak Ave. school who are students in the class, The Student and the Law" conducted by Sgt. Geo. Stevens of the Sheriffs Dept. This is the second group for the class, the first having been very successful, and IIthere has been a large application for the class which is elective. PUBLIC HEARING: 7:30 P. M. A. CURB & GUTTER, EAST SIDE, GOLDEN WEST, LA ROSA TO KEY WEST. B. CURB, GUTTER & SIDEWALK, NORTH SIDE, GARIBALDI, KAUFFMAN TO GOLDEN WEST. ° The Public Works Director presented item A and stated 71% of the frontage had signed the petition and advised proper posting had been done. Council Minutes, November 21, 1967, page 2 The Mayor declared the public hearing opened, and asked if any- one wished to speak for or against this installation and no one came forward to speak. Councilman Harker moved to close the public hearing, Councilman Briggs seconded, and the motion carried unanimously. The Public Works Director presented item B, advised the area was properly posted, and that the petition was signed by 100% of the people in the block, with one pt- eferring. the sidewalk deleted which would leave 85% signed up for all three installations. The Mayor declared the public hearing opened, and asked if any- one wished to speak for or against the project and no one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Briggs seconded, and the motion carried unanimously. Councilman Merritt moved to find projects A and B in the public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Tyrell seconded, and the motion was un- animously carried. 6. RESOLUTION NO. 67- 784: Re Entertainment License request for Dancing,. The Crest, 5921 Temple City Blvd. City Attorney Martin presented the above resolution he had pre- pared in accordance with Council instruction which contains the conditions imposed for granting of the license, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING A DANCE PERMIT (5921 TEMPLE CITY BOULEVARD). Councilman Tyrell moved to adopt Resolution No. 67 -784, Councilman Harker seconded, and the motion was carried unanimously. 7. ORDINANCE NO. 67 -252: 1st read. Re Charitable Solicitation Permits. City Attorney Martin presented for first reading Ordinance No. 67 -252 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SEC- TION 4508 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO CHARI- TABLE SOLICITATION PERMITS. Councilman Tyrell moved to waive further reading of the ordinance, Councilman Briggs seconded, and the motion was unanimously carried. No further action was taken as this was the first reading of the ordinance. NEW BUSINESS: 8. SET PUBLIC HEARING: Re proposed extension of Ordinance No. 67- 251 for an additional ninety days from Dec. 19, 1967, relating to zone classification for car -wash establishments. The City Attorney presented the above recommendation. Council- man Tyrell moved to set the public hearing for Dec. 5, 1967, at 7:30 P. M., Councilman Merritt seconded, and the motion carried unanimously. 9. ORDINANCE NO. 67 -253: 1st read. Re documentary stamp tax on sale of real estate. City Attorney Martin advised the federal government abandoned the documentary stamp and the state has picked it up, and the county has enacted an ordinance whereby a tax will be imposed of 55 per $500. valuation. If the City adopts this ordinance they will receive 2 of each 55 collected and the county the other half, but if the City does not adopt the ordinance the county will re- tain the full amount. He presented Ordinance No. 67 -253 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY IMPOSING A DOCUMENTARY STAMP Council Minutes, November 21, 1967, page 3 TAX ON THE SALE OF REAL PROPERTY. Councilman Tyrell moved to waive further reading of Ordinance No. 67 -253, Councilman Merritt seconded, and the motion carried unanimously. Councilman Tyrell stated the City is not initiating this tax and unless they enact this ordinance the City will not receive a share of this revenue and the county would .receive the City share. III10. PARKING COMMISSION RECOMMENDATIONS: Meeting of Nov. 8, 1967. A. Review of Parking District Lot traffic flow for Lots 1, 5 & 6. Recommend traffic flow be reversed,on north side of Lots 1A, 2 and 5, and the private port,ion.of Lot 6, and on the south side of Lots 1B, 6 and the private portion of Lot 5. The Public Works Director presented the above recommendation. Parking Commissioner Nunamaker explained in detail the reasons for the recommendation. Following discussion Councilman Tyrell moved to approve the recommendation and to include a detached line down the center of the lots, Councilman Briggs seconded, and the motion was unanimously carried. B. Parking District Lot Entrance and Exit signs: Recommend the following signs be placed: 1. ':'Exit" sign to Lot 2 at Primrose. 2. "Enter" sign to Lot 2 at the intersecting alleys. 3. "Enter" and "Exit" sign to Lot 3 at Temple City Blvd. 4. "Enter" sign to Lot 4 at Camellia. 5. "Do Not Enter" sign at the intersection of the north - south alley between Primrose and Temple City Blvd. with the east -west alley southerly of Las Tunas Dr. 6. "Do Not Enter" sign at the intersection of the north - south alley between Temple City Blvd. and Camellia with the east -west alley immediately south of Las Tunas Dr. Public Works Director Pizzorno presented the above recommenda- tion. Following discussion Councilman Tyrell moved to adopt recommendations No. 5 and 6 under B, Councilman Harker seconded the motion, and it was carried unanimously. Item 1 under B. Following presentation by the Public. Works Director and discussion by the Council it was moved to deny this recommendation, Councilman Harker, made the motion, seconded by Councilman Tyrell, and carried unanimously. Item 2 under B. Following discussion Councilman Harker moved to deny the recommendation as stated above, Councilman Tyrell seconded, and the motion was unanimously carried. Item 3 of B. Councilman Harker moved to approve recommendation for both "Enter" and "Exit" signs on Lot 3 at Temple City Blvd., Councilman Briggs seconded, the roll call vote as follows to carry the motion: AYES: Councilmen - Briggs, Harker, Beckley NOES: :Councilmen- Tyrell, Merritt Item 4 of B. Following discussion Councilman Briggs moved to deny this recommendation, Councilman Tyrell seconded, and the motion carried unanimously. C. Review of Limited Time Parking Restrictions: Recommend parking be restricted to two hours, the proper signs posted, and effective enforcement provided, for the following portions of the Parking District Parking Lots: 1 Council Minutes, November 21, 1967, page 4 1. Lot 1, row of parking adjacent to the mall. 2. Lot 2, the northerly three rows of parking. 3. Lot 3, the northerly two rows of parking. 4. Lot 4, the row of parking adjacent to the alley. 5. All of Lot 5. 6. Lot 6, the row of parking adjacent to the mall. The Public Works Director presented the above recommendation and advised a survey had been made and that 50% of the parking on the lots was all day parking, and on one lot 87 %. Parking Commissioner Nunamaker advised the Council the Commis- sion had a meeting and asked the merchants to attend to consider the limited parking for customer use closest to the shopping area. He stated these recommendations came from the Parking Commission as a result of a great deal of study and research and requested the Council to consider them favorable. Alex Goodman, Manager of the Chamber of Commerce, stated the Chamber of Commerce was in full accord with the recommendations, that merchants whose employees were parking all day were con- tacted and for a day or so they would not be there, but would be back again in the same spot. Checks have been made many times to confirm this, and the Chamber feels the only way to control this is by putting a time limit on parking on the mall. Al Lindberg, 9932 Nadine, spoke in opposition to the recommenda- tion of limited parking and stated surveys he had made since last September indicated that lot is no more than 50% used by all day parkers and that he was violently opposed to limited parking of any kind at this time. Bill Graham of Graham Music Co., also opposed the limited parking recommendations. He advised his employees were instruct- ed to use the rear part of the lots and if needed at Christmas for customers he would request them to park elsewhere. He spoke in detail in opposition to limited parking. A lengthy discussion followed. Councilman Harker felt the cus- tomer was being penalized by limited parking, and he felt the, Chamber should contact the merchants and have them control their own problem. Councilman Briggs also felt the merchants would be hurt by controlled parking. Councilman Merritt also felt the customer would be more hurt than the merchants. Mayor Beckley favored a "Customer Parking Only" and for the merchants to set up some sort of group to enforce this with the other alternative of the City adopting an ordinance and enforcing it. Councilman Tyrell felt it in the merchants' interest for them to do some- thing about the parking. City Attorney Mar-,tin advised the Council that the Parking Commission had made recommendations and it requires an answer from the Council either yes or no. Councilman Briggs moved to deny the recommendation, Council- man Merritt seconded, and the motion was carried by the follow- ing roll call vote: AYES: Councilmen - Briggs, Harker, Merritt NOES: Councilmen - Tyrell, Beckley D. Change of Ordinance re meeting dates: Recommend Ordinance No. 65-159, Sec. 7320, be amended to change the meeting dates of the Parking Commission from the second Wednesday of April, August and December of each calendar year, to the second Wednesday of February, June and October of each calendar year. The Director of Public Works presented the above recommendation. Councilman Merritt moved to approve, Councilman Tyrell seconded, and the motion carried unanimously. The City Attorney will pre- pare the amendment to the Ordinance. Council Minutes, November 21, 1967, page 5 11. SET PUBLIC HEARINGS: A. Sidewalks, south side, Emperor between Loma and Oak Ave. B. Sidewalks, south side, Emperor,between Livia and Loma Ave. Councilman Tyrell moved to set public hearings for items A and B for Dec. 5, 1967, at 7:30 P. M., Councilman Merritt seconded, and the motion carried unanimously. 12. RESOLUTION NO. 67 -785: Warrants & Demands, No. 10279 through No. 10322, and Nos, 10275, 10276, 10277, in the sum of $25,561.71. City Manager Koski presented Resolution No. 67 -785. Councilman Harker moved to adopt Resolution No. 67 -785, Councilman Briggs seconded, and the motion carried unanimously. 13. COMMUNICATIONS: A. Request from Seventh Day Adventist Church, 9664 Broadway, to sing Christmas carols and solicit funds. City Manager Koski presented the above request. Councilman Briggs,moved to approve, Councilman Merritt seconded, and the motion carried unanimously. B. Request from Arthritis Foundation for charitable solicita- tion permit for Febr. 8 -10, 1968. The City Manager presented this request. Councilman Briggs moved to approve, Councilman Harker seconded, and the motion was unanimously carried. C. Request for proclamation from League of Calif. Cities for Nov. 17 -23 as. National Farm -City Week. City Manager Koski presented the proclamation request. Coun- cilman Harker moved to so proclaim, Councilman Merritt seconded, and the motion carried unanimously. D. The City Manager presented a request from the Chamber of Commerce for permission to use Santa Claus Moving Toyland again this year starting on Dec. 2 at Live Oak Park and finish on Dec. 23. Councilman Merritt moved to approve, Councilman Harker seconded, and the motion carried unanimously. E. The City Manager presented a letter from C. C. Scanlon, the Supt. of the Alhambra schools re e bond election in the Alhambra High School Dist. requesting that it be consolidated with the City election on April 9, 1968. This also involves San Gabriel and Monterey Park and would require approval of all three cities. Following discussion Councilman Merritt moved to approve on condition the other cities approve also, Councilman Harker seconded, and the motion carried unanimously. F. City Manager Koski presented a request from T. E. Robertson, 627 Griswold Ave., San Fernando, requesting a license to paint house numbers on curbs. Councilman Merritt moved to approve subject to specifications and that it is not an exclusive permit, Councilman Tyrell seconded, and the motion carried un- animously. G. The City Manager presented a request from the Kiwanis out- lining their program for the March of Dimes which is the same as in the past and requesting no other solicitations during their solicitation. Councilman Merritt moved to approve the requests as outlined with the exception of the request that no other solicitations be permited at that time, Councilman Harker seconded, and the motion carried unanimously. 14. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. R. C. Rumin, 10553 Bogue St., ,brought to the attention of the Council a problem existing at the southwest corner of Council Minutes, November 21, 1967, page 6 Live Oak and Pal Mal where the overgrowth of trees on this property is a traffic hazard as well as a great concern of parents in the area as a haven for molesters of children on their way to and from Longley Way School. Considerable dis- cussion followed and Councilman Tyrell moved to have the right of way cleared forthwith, Councilman Briggs seconded, and the motion carried unanimously. The City Attorney advised that the clearance of private property takes a longer time but can be accomplished under our nuisance ordinance. Also the pro- cedures for installation of sidewalks was explained to Mr. Rumin. Mr. Brown of the Longley school has information on the problem as well as the Arcadia police dept. who have a file on the problem. The City Manager will contact Capt. Pascoe in order that he may have all the material available to help correct the problem. Also the people in the area were requested to contact Capt. Pascoe at any time with anything they may be able to report. The City Manager will follow up on this complaint. 15. MATTERS FROM CITY OFFICIALS: City Manager Koski presented Resolution No. 67 -786 commemorat- ing the 200th anniversary of the State of California and requesting the United States Postmaster General to issue a commemorating stamp in 1969, which has been requested by the Mayor of San Diego. Councilman Tyrell moved to adopt Resolu- tion No. 67 -786, Councilman Merritt seconded, and the motion , carried unanimously. Regarding the signals on Broadway and Rosemead the City Manager reported they had found a malfunction and further repairs will be made. Also the additional red curb has been put in at Encinita and Hermosa. Referring to the complaint of Mr. Goold, 9019 Rancho Real, about the trimming of the redwood tree in front of his house, the tree is in the right of way and is about 50 ft. tall and was trimmed up about 13 ft. to clear the street sweeper and disposal trucks. Mr. Goold also complained about a driveway depression which can be corrected if Mr. Goold would put in the driveway approach which he agreed to do. The expense to the City would be around $80. Councilman Harker moved to expend the necessary funds to adjust the curb subject to Mr. Goold depositing with the City an amount to cover the construction of the driveway approach, Councilman Merritt seconded, and the motion carried unanimously. The City Manager requested acceptance of a Moto jig saw, Model 57, the Temple City Junior Womens Club proposed to give to the Recreation Dept. for their use. Councilman Tyrell so moved, Councilman Briggs,seconded, and the motion carried unanimously. City Manager Koski presented an application for a Christmas Tree lot by the T. C. Y.M.C.A. requesting Council approval for the waiver of the license fee. Councilman Merritt so moved, Councilman Harker seconded, and the motion unanimously carried. Councilman Briggs asked about the tennis courts and the City Manager advised etching commences Dec. 4, following that the staining, and they should be complete about Dec. 10 or 12. Councilman Harker presented correspondence received from Bill Geller, County Librarian, requesting the City to support the 1968 -69 library budget request from the State. He recommended the City go on record as supporting their request. Following discussion it was agreed to discuss this at the next study session, and to also consider the Rapid Transit District at that time. Council Minutes, November 21, 1967, page 7 Councilman Merritt requested the clearing of the pile of debris in the area of the old Shopping Mart, and the City Manager will contact the contractor and Ralphs. City Attorney Martin stated inadvertantly the nuisance ordi- nance was not included in the new zoning ordinance and pre- sented Ordinance No. 67 -254 whereby it would be readopted and codified into the new zoning ordinance, and recommended this be done as an urgency measure. Councilman Tyrell moved to adopt Ordinance No. 67 -254 as an urgency ordinance, Council- man Briggs seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Briggs, Harker, Merritt, Tyrell, Beckley NOES: Councilmen -None ABSENT: Councilmen -None 16. ADJOURNMENT: Councilman Harker moved to adjourn, Councilman Briggs second- ed, and the motion was carried unanimously. Council adjourned at 10:15 P. M.
