ORDER/ROLL CALL OF MEMBERS The meeting was called to order by the Mayor at 7 09 p m Present were Councilmembers Luis Lauredo Edward London Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey Also present were Village Manager Andrea Agha Village Clerk Jennifer Medina and Village Attorney Chad Friedman 2 PLEDGE OF ALLEGIANCE Mayor Davey led the Pledge of Allegiance 3 BRIEF COMMENTS BY COUNCIL There were no comments provided by Council 4 PUBLIC COMMENTS The following residents addressed the Council Jan Dillow 350 W Heather Drive commented on the proposed FY2020 budget and in support of the Chief Resilience Officer Lynn Paisley 345 Redwood Lane commented in support of MAST Academy Green Champions and Solar Hub, Ellie Reyna, 111 SW 21St Road commented in support of MAST Academy solar panels, Felipe Patoletti, 7407 SW 52"d CT commented m support of the MAST Academy Green Champions budget request, Holly Thorpe 651 S Mashta Dnve commented in support of the installation of the MAST Academy solar hub, Cecile Sanchez, 260 Cypress Drive, commented on the funding for landscaping, and Antonio Camejo 151 Crandon Boulevard commented on the proposed Improvements to the Key Biscayne library At this time Councilmember Petros and the Attorney addressed the Council and the public regarding the proposed improvements to the Key Biscayne library September 24 2019 There was extensive discussion by Council regarding the proposed improvements to the Key Biscayne library At this time, the Mayor called for a recess and the meeting reconvened at 7 43 p m 5 MILLAGE RESOLUTION The Clerk read the following resolution by title A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE FLORIDA ADOPTING THE FINAL MILLAGE RATE OF THE VILLAGE OF KEY BISCAYNE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2019 THROUGH SEPTEMBER 30, 2020 PURSUANT TO FLORIDA STATUTE 200 065 (TRIM BILL), PROVIDING FOR AN EFFECTIVE DATE Mayor Davey made a motion to approve the resolution The motion was seconded by Councilmember Moss The Attorney addressed the Council regarding the process for the adoption of the millage resolution Mayor Davey made a motion to table the resolution to be heard after Item 6A The motion was seconded by Councilmember Moss and approved by a 7 0 voice vote The vote was as follows Councilmembers Luis Lauredo Edward London Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes 6 ORDINANCES The Clerk read the following ordinance on second reading, by title AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, ADOPTING THE BUDGETS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2019 THROUGH SEPTEMBER 30, 2020 PURSUANT TO FLORIDA STATUTE 200 065 (TRIM BILL), PROVIDING FOR AN EFFECTIVE DATE Councilmember Moss made a motion to adopt the ordinance on first reading The motion was seconded by Mayor Davey The Manager addressed the Council regarding the process for the adoption of the budget on second reading The Manager addressed the Council presenting the FY2020 proposed budget, resiliency, effective and efficient government, strategic planning, quality of life, public safety beach restoration, increasing stormwater mitigation land acquisition undergrounding utilities and enhance communication efforts capital investments towards parks and open spaces and maintenance standards At this time Councilmember Moss addressed the Council regarding the proposed FY2020 general fund excess revenues over expenditures 2of10 September 24 2019 The Manager addressed the Council regarding the proposed FY2020 General Fund Summary a proposed total amount of $508 000 from Working Capital to fund the Capital Improvement Plan and also possible options to fund the proposed FY2020 budget and Capital Improvement Projects loan proceeds increase millage and funds from Working Capital Councilmember Lauredo addressed the Council regarding the Deputy Finance Director The Manager addressed the Council regarding the Deputy Finance Director position Council, Boards & Community Groups The Mayor addressed the Council regarding the funding decrease in the Subscriptions & Memberships budgetary line item The Clerk addressed the Council regarding the Subscriptions & Memberships budgetary line item There was extensive discussion by Council regarding the State & Local Lobbyist budgetary line item It was the consensus of Council to issue a Request for Proposals for both a Local and State Lobbyist Councilmember Lauredo addressed the Council regarding a funding request by the Village of Kindness totaling $4 750 Councilmember Moss addressed the Council regarding the reinstatement of the Youth Engagement budgetary line item totaling $4 500 Councilmember Moss also addressed the Council regardmg removing "Outward Bound from the Youth Leadership/Outward Bound budgetary line item It was the consensus of Council to remove Outward Bound from the Youth Leadership/Outward Bound budgetary line item Lastly Councilmember Moss also addressed the Council regardmg reinstating the Youth Council budgetary line item totaling $15 000 It was the consensus of Council to rename the budgetary line item from Youth Engagement to "Village of Kindness and allocate a total of $5 000 in the FY2020 budget It was also the consensus of Council to allocate a total of $10 000 in the FY2020 budget towards the Youth Council budgetary line item At this time, Councilmember Moss addressed the Council regarding movmg the $100,000 for the 2040 Vision Board and the $14,000 from the Parks & Open Space Board into the Professional Services budgetary line item 3 of 10 September 24 2019 It was the consensus of Council to create a Professional Services Line item under the Council, Boards and Community Group budget and move the fund allocation of $100 000 from the 2040 Vision Board budgetary line item and $14 000 from the Parks & Open Space Board budgetary line item into the newly created budgetary line entitled Professional Services' and lastly, remove both the 2040 Vision Board and Parks & Open Space Board line items from the Council Boards and Commumty Group budget Councilmember Lauredo made a motion to approve the Educational Initiatives budgetary line item in the Managers budget The motion was seconded by Vice Mayor McCormick and approved by a 7 0 voice vote The vote was as follows Councilmembers Luis Lauredo Edward London, Brett G Moss, Kathleen Petros, Ignacio Segurola, Vice Mayor Alhson McCormick and Mayor Michael W Davey voting Yes The Manager addressed the Council regarding the revised total for the Council, Boards and Council totaling $379,071 Clerk Councilmember Petros addressed the Council regarding the Video Streaming budgetary line item Councilmember London addressed the Council regarding the Social Medina budgetary line item The Clerk addressed the Council regarding the Video Streaming and Social Media budgetary line items Manager At this time the Mayor addressed the Council regarding the proposed funding request for Commumcation efforts Councilmember Lauredo addressed the Council regarding the Council strategic planning session that took place in May of 2019 and the Communications program The Manager addressed the Council regarding the proposed Communications program The Mayor addressed the Council regarding approving the FY2020 budgetary funding allocation towards the Commumcatrons program with the understandmg the Manager will not hire a Communications Officer prior to Council discussion and final approval There were no objections by Council At this time Councilmember Segurola addressed the Council regarding the removal of the FY2020 funding allocations for solar benches EV chargmg stations resiliency education and the Resilience Master Plan There was extensive discussion by Council regarding resiliency initiatives 4of10 September 24 2019 At this time the Manager addressed the Council regarding in house efforts towards resiliency initiatives At this time the Mayor addressed the Council regarding the need to add a one (1) full-time Chief Resiliency Officer position to the FY2020 budget There was extensive discussion by Council regarding moving the funding allocation towards the Resilience Master Plan totaling $50,000 into the Resiliency Program Councilmember Lauredo addressed the Council regarding the Village staff's efforts towards resiliency Councilmember Segurola made a motion to remove the FY2020 funding allocations for solar benches ($25,000), resiliency education ($1,000), Resiliency Master Plan ($50,000) and EV charging stations ($2,500) The motion was seconded by Councilmember Lauredo The Manager addressed the Council regarding project management services for capital projects Councilmember Segurola amended the motion to rename the Professional Services Sustainability Program budgetary line item to state Resiliency Program" and allocate a total of $150,000 towards the Resiliency Program remove the FY2020 funding allocations for solar benches ($25 000), resiliency education ($1 000), Resiliency Master Plan ($50 000) and EV charging stations ($2,500) The motion was seconded by Councilmember Lauredo and approved by a 6 1 voice vote The vote was as follows Councilmembers Luis Lauredo Edward London Kathleen Petros, Ignacio Segurola, Vice Mayor Allison McCormick and Mayor Michael W Davey votmg Yes Councilmember Brett G Moss voting No At this time, Councilmember London addressed the Council regarding the removal of the fundmg allocation towards the Village's Financial Advisor totaling $50 000 There was extensive discussion by Council regarding the services provided by the Village's Financial Advisor Councilmember London made a motion to remove the funding allocation towards the Village's Financial Advisor totaling $50 000 The motion was seconded by Councilmember Lauredo At this time, the Intenm Chief Financial Officer addressed the Council regarding the services provided by the Village s Financial Advisor Ms Lourdes Abadm, Village s Financial Advisor from Estrada Hinojosa, addressed the Council regarding the services currently being provided to the Village At this time, the Mayor addressed the Council regarding mamtammg the funding allocation for the Village's Financial Advisor and at a later time issue a bid There was extensive discussion by Council regarding issuing a Request for Qualifications to provide Financial Advising services 5of10 September 24 2019 Councilmember London withdrew his motion to remove the funding allocation towards the Village's Financial Advisor totaling $50 000 Councilmember Lauredo addressed the Council regarding the Professional Services- Videographer budgetary line item The Manager addressed the Council regarding the Professional Services Videographer budgetary line item Attorney Councilmember Petros addressed the Council regarding the Labor Relations budgetary line item The Attorney addressed the Council regarding the Labor Relations budgetary lme item Councilmember London addressed the Council regarding the Bond Counsel budgetary line item The Attorney addressed the Council regarding the Bond Counsel budgetary line item Councilmember Lauredo made a motion to approve the Attorney budget The motion was seconded by Councilmember Moss and approved by a 7 0 voice vote The vote was as follows Luis Lauredo Edward London Brett G Moss, Kathleen Petros, Ignacio Segurola, Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes Budding, Planning and Zoning The Manager addressed the Council regarding the proposed FY2020 Building Plannmg and Zoning budget Councilmember Moss addressed the Council regarding the funding allocation towards Code Enforcement At this time, the Building, Planning, Zoning and Public Works Director Jake Ozyman addressed the Council regarding Code Enforcement There was extensive discussion by Council regarding Code Enforcement At this time Councilmember London exited the Chambers (10 15 p m ) Public Works The Building, Planning, Zoning and Public Works Director addressed the Council regarding the proposed Public Works Department budget There was extensive discussion by Council regarding the beach, landscape and street maintenance 6of10 September 24 2019 The Manager addressed the Council regarding beach maintenance options Councilmember Petros and Vice Mayor McCormick addressed the Council regarding allocating additional funding to address the increased number of iguanas within the Village Vice Mayor McCormick addressed the Council regarding the whitefly infestation It was the consensus of Council to allocate funding to address the increased number of iguanas within the Village totaling $50,000 The Parks and Recreation Director Todd Hofferberth addressed the Council regardmg the increased number of iguanas within the Village Councilmember Petros addressed the Council regarding the tree replacement on Westwood Dnve Councilmember Petros made a motion to remove the funding allocation towards the tree replacement on Westwood Dnve The motion was seconded by Councilmember Moss and approved by a 6 0 voice vote The vote was as follows Luis Lauredo Brett G Moss, Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes Parks & Recreation There were no comments by Council Police Councilmember Lauredo addressed the Council regarding Police bicycle patrollmg The Manager addressed the Council regarding the Police bicycle patrolling Fire There were no comments by Council Capital Improvement Plan The Manager addressed the Council regarding funding options for the proposed FY2020 Capital Improvement Plan Vice Mayor McCormick addressed the Council regarding the removal of $274,000 towards Traffic Circles from the total transfer from the Transportation Fund totalmg $674,000, thereby, the transfer from the Transportation Fund will decrease to reflect a new total in the amount of $400,000 Councilmember Segurola addressed the Council regarding the funding allocation towards the proposed Community Center expansion 7 of 10 September 24 2019 Mayor Davey made motion to extend the meetmg to 11 05 p m The motion was seconded by Vice Mayor McCormick and approved by a 6 0 voice vote The vote was as follows Luis Lauredo Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes At this time, the Parks and Recreation Director addressed the Council regarding the funding allocation towards the Community Center expansion At this time, Councilmember Lauredo addressed the Council regarding continuing the green bicycle traffic lanes thru the Village Councilmember Petros 6-0 voice vote The vote was as follows Luis Lauredo Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes Councilmembers Lauredo and Petros addressed the Council regarding the funding allocation towards the Solar Energy project Councilmember Petros made a motion to reduce the funding allocation towards the Solar Energy capital project to reflect a new total of $40 000 The motion was seconded by Councilmember Lauredo and approved by a 6-0 voice vote The vote was as follows Luis Lauredo, Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes The Manager addressed the Council regarding a transfer of approximately $371,000 from working capital to fund the Capital Improvement Plan Mayor Davey made a motion to table the amended budget ordinance The motion was seconded by Councilmember Moss and approved by a 6 0 voice vote The vote was as follows Luis Lauredo Brett G Moss Kathleen Petros, Ignacio Segurola, Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes 8of10 September 24 2019 At this time Councilmember Moss made a motion to remove the millage resolution from the table The motion was seconded by Mayor Davey and approved by a 6 0 voice vote The vote was as follows Luis Lauredo Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes The Attorney read into the record that the proposed millage rate for the Village of Key Biscayne for the fiscal year commencing October 1, 2019 through September 30 2020 be and is hereby fixed at the rate of 3 1950 mills which is $3 20 dollars per $1,000 00 of assessed property value within the Village of Key Biscayne That the rolled -back rate is 3 1580 mills and the proposed millage rate is 3 1950 nulls which is 1 17% over the rolled -back rate Councilmember Moss made a motion to approve the millage resolution with a 3 1950 millage rate The motion was seconded by Mayor Davey and approved, as amended, by a 6 0 voice vote The vote was as follows Luis Lauredo Brett G Moss, Kathleen Petros Ignacio Segurola, Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes At this time, Mayor Davey made a motion to remove the amended budget ordinance from the table The motion was seconded by Councilmember Moss and approved by a 6 0 voice vote The vote was as follows Luis Lauredo Brett G Moss Kathleen Petros, Ignacio Segurola, Vice Mayor Allison McCornuck and Mayor Michael W Davey voting Yes Councilmember Moss made a motion to adopt the budget ordinance as amended, on second reading The motion was seconded by Mayor Davey Mayor Davey made a motion to extend to meeting to 11 19 p m The motion was seconded by Vice Mayor McCormick and approved by a 5 1 voice vote The vote was as follows Luis Lauredo, Kathleen Petros, Ignacio Segurola, Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes Councilmember Brett G Moss voting No At this time, Councilmember Lauredo made a motion to cut the proposed FY2020 General Fund budget by 3% across the board The motion was not seconded The budget ordinance as amended was adopted on second readmg by a 5 1 roll call vote The vote was as follows Brett G Moss Kathleen Petros Ignacio Segurola Vice Mayor Allison McCormick and Mayor Michael W Davey voting Yes Councilmember
