HomeMy Public PortalAboutResolution 2020-86, Contract For Snow Removal 2020-2021 Season, S&R Lawn Care & Snow Rmoval ContractorsRESOLUTION 2020-86 A RESOLUTION APPROVING A CONTRACT FOR SNOW REMOVAL SERVICES FOR THE 2020- 21 WINTER SEASON (EFFECTIVE NOVEMBER 11, 2020) WHEREAS, The City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and operating under the laws of the State of Iowa, and; WHEREAS, the City of Riverdale has established a scope of work for snow removal services during the winter months of 2020-21 and published a request for bids from qualified suppliers; and, WHEREAS, following discussions with prospective contractors and the review of proposals submitted to the City, staff has negotiated a contract (Exhibit "A", attached) for review and approval by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA, Section 1. The attached Snow Removal Specifications and Contract document included with this Resolution is hereby approved; Section 2. With the approval of the City Council, the Mayor shall execute said agreement which shall become effective on Sunday, November 15, 2020. Passed and approved this 10th day of November 2020. APPROVED ATTEST Michael Bawden, Mayor Ka ie Enloe, Deputy Clerk CITY OF RIVERDALE, IOWA SNOW REMOVAL SPECIFICATIONS & CONTRACT The City of Riverdale, Iowa ("Riverdale") enters into this contract with .S R' 1 t^y✓n Cot( # 5I) e1 ("Contractor") for removal of snow and ice from the streets and public entities within the City of Riverdale pl1m V ) as described herein. 1. PURPOSE: The purpose of this contract to establish the City of Riverdale's policy and standards for level of service in respect to the management of snow or ice and maintenance of its road system during the winter months. It will also serve as practical guide for cost effective snow removal operations in the City of Riverdale. Field conditions will always warrant changes as the event progress, but the goal of providing excellent customer service through efficient snow and ice control at the best price while maintaining the safety of the traveling public will always take precedence. 2. SNOW CONTROL PROCEDURES: The City of Riverdale's standard for snow and ice control is to achieve bare pavement on public streets within twenty-four (24) hours following the cessation of snowfall from an average storm of 4"-6"; including not limited to, ice and snow. 3. PRIORITIES FOR SNOW AND ICE CONTROL OPERATIONS: In order to make the most efficient use of available resources, we have established priorities using the assumption that the severity of a storm is not beyond the capabilities of the Contractor's snow removal resources. Depending on the nature of the snowstorm, deviations could occur. The established priorities are as follows: (a) Belmont Road between the Pleasant Valley High Property to Valley Drive on the Eastern Lane only (b) Fenno Road from US-67 to Fenno Drive (c) Manor Drive (Hill) between Circle Drive and State Street (d) Scott Community College Road (e) Madison Drive Hill from State Street to Mason Dr. (f) Valley Drive from Belmont Road to Street State (g) Manor Drive Circle Drive to northwest terminus (h) Kensington Street from US-67 to southern terminus (i) Madison Drive from Smith Street to Mason Drive (j) Smith Street from Madison Drive to Ann Avenue (k) All other streets known as Circle Drive, Fieldcrest Road, Windsor Drive, Elmhurst Lane, Fenno Drive, South Bellingham Road, Sycamore Lane and Wisteria Lane, Ann Drive, Manson Drive Smith and Elizabeth Way Bus Shelters: The Contractor will clear all bus shelters of snow and ice at the end of an event. TERM: The Contractor will be an independent contractor and will furnish its own equipment, maintenance and employees. The term of this contract is three (3) year snow removal seasonal contract. The contract shall begin November 15th and end of March 3ist and/or when weather conditions could cause accumulation of frost, sleet, ice and snow on City streets, recreation trails, and public parking lots. 5. The City will notify its residents of a snow emergency if necessary. All citizen's issues concerning snow and ice removal operations will be routed to the City of Riverdale's contacts. The contract will be reviewed annually. The contractor and the City of Riverdale's contacts will meet the annually the second Thursday in April to review the performance of contractor 7. ICE CONTROL PROCEDURES: Ice Control Procedures are used to break and/or prevent the bond of ice to pavement. The Contractor will have the discretion to modify the rates and types of ice control based upon weather and street conditions. _ If possible, anti -icing is defined as the application of ice control materials prior to a winter weather event. The intent is to delay or prevent the bond of ice and/or melted snow to pavement surface. The Contractor may utilize anti -icing procedures when weather forecast, and pavement temperatures indicate that their use will help prevent the bond of ice to the pavement. The ant -icing materials and/or chemicals may be applied. When pavement temperatures are low and the pavement is initially dry, the use of salts should be delayed as long as possible to avoid the formation of ice re -freezing on the roadway surface. Salt and Sand will be contracted for and purchased directly by the City of Riverdale in quantities recommended by the Contractor. At the City of Riverdale's discretion, salt and sand will either: (1) delivered to designated area specified by the Contractor; or (2) hauled by Contractor from the vendor's location or another designated area specified by the Contractor. Riverdale shall pay Contractor hauling salt and sand in the amount per dump truck load. The salt and sand shall be stored at the Contractor's business site. The Contractor will notify the City of Riverdale in writing of the Storage location. No Salt or brine solution shall be applied to the newly created subdivision known as the Woods Subdivision. Those streets are known as Madison Drive, Smith Drive, Ann Drive, Mason Lane, and Elizabeth Way. In addition, the City of Riverdale shall pay the Contractor a monthly charge for salt and sand storage services in the amount per month. SNOW CONTROL PROCEDURES: Storage Costs: YEAR 1: i u f t r M` YEAR 2: i v r YEAR 3: 10°' P r The depth and timing of accumulations, weather forecasts and traffic volumes, will normally dictate when snow plowing operations will begin. Plowing will take place during, a storm as needed to keep the accumulation on the pavement surface less than desired guidelines. It is important to remember that plowing while a winter weather event is ongoing will not necessarily leave the street in a finished state. It is common for snow fall rates to be high enough to give the appearance that a street has not been plowed even through the plow may have made a pass very recently. Only after the winter weather event has ended can final cleanup commence, and the streets begin to be returned to normal conditions. There may be several passes of plow equipment required to fully plow a street curb to curb. Snowplow will need to maintain certain speeds while plowing in order promote efficient movement of snow movement of snow and to ensure that snow does not adhere to the plow blade. If weather forecasts indicate a significant increase in pavement temperatures during or after a storm event, the contractor will have discretion regarding plowing and/or deicer applications. If forecasts indicate that the snow and/or ice will dissipate in a time period deemed reasonable by the Contractor applied procedures will be implemented. 9. EMERGENCIES Emergencies are defined as follows, but not necessarily limited to: • Immediate need for Police, Fire and/or Emergencies Medical Assistance. If the Emergency personnel must leave the public right-of-way to respond to an emergency, snow removal crews may provide necessary assistance such as opening a driveway or parking area to give access to them • Isolated problem areas where access is urgently needed before all other areas are handled • Icy conditions due to a water main break or cleaning of streets due to debris blocking streets or access. io. DRIVEWAYS & PRIVATE PROPERTY During snow and ice control, it is common for plowed snow to be pushed and/or thrown back onto the driveways and aprons and especially around corners this unfortunate event results from the need to maintain certain speeds and plow angles to provide efficient and safe snow and ice control. While the City strives to minimize the effects of this thrown snow, it is inherent to snow and ice control activities. Removal of this additional of material on driveways and aprons is the responsibility of the abutting property owner. ii. DAMAGES TO PRIVATE PROPERTY The Contractor is wholly responsible for damage due to deicing chemicals and/or snowplow blade. This activity will include but not limited to landscaping (Hardscaping, plants, irrigation systems, or accessories such as lighting). The Contractor is responsible for replacing all mailboxes. The City of Riverdale will NOT repair or accept damages that result for snow plowing activities. 12. EQUIPMENT The Contractor's sole payment is for the work provided hereunder is based on a per -hour charge for each piece of Contractor's equipment under in performance of work. Contractor shall invoice City of Riverdale monthly for all charges incurred hereunder, including hauling and storage expenses. TRAVEL TIME TO THE CITY OF RIVERDALE The Contractor represents and warrants to the City of Riverdale that one-way travel time from the Contractor's business site to the Work locations listed above is no more than 35 minutes, weather dependent. The Contractor represents and warrants to the City of Riverdale that one-way travel time from Contractor's home -base to the Contractor's business site shall be no more than 3 S minutes, weather dependent. 14. SEVERABILITY: If a provision of this Agreement is or becomes illegal, unenforceable, or invalid in any jurisdiction, it shall not affect (i) the enforceability or validity in that jurisdiction of any other provision of this Agreement, or (2) the enforceability or validity in other jurisdictions of that or any other provision of this Agreement. 15. INSURANCE 1. The Contractor will, at Contractor's sole cost and expense, obtain and maintain during the Term (and any renewal or thereof): (a) a commercial general liability policy insuring the Contractor (and naming the City of Riverdale as an additional insured against liability arising out of the work in the amount of not less than $500,00o combined single limit, bodily injury and property damage per occurrence and $1,5oo,00o in the aggregate; and (b) workers' compensation insurance in the applicable statutory limits. Such insurance policies shall name the City of Riverdale, Iowa as additional insured under the policy. The policies will insure performance by the Contractor of the indemnity provisions below. The limits or coverage of such insurance will not, however, limit the liability of the Contractor hereunder. 2. The Contractor shall provide a copy of the Certificates of Insurance to the City of Riverdale. 16. HOLD HARMLESS AGREEMENT 1. Contractor shall indemnity, defend and hold harmless the City of Riverdale and its officials and employees and agents from and against any and all losses, liabilities, claims, damages, actions, fines, penalties, expenses or costs (including court costs and reasonable attorneys' fees) ("Losses") arising out of the negligence, recklessness or willful misconduct of Contractor or its employees, officers or directors in performing the work. 2. Notwithstanding any other provision of this Contract or anything to the contrary that may be provided for by operation of law, neither party for lost profits, lost revenue, loss of anticipated business or any other form of indirect, incidental, special, consequential exemplary, or punitive damages, even if that party has been informed of the possibility of such damages and even is such damages are foreseeable, whether as a result of breach of contract, breach of warranty, tort, negligence, or otherwise. The indemnities the Section shall be the sole and exclusive remedy available to each party hereunder. 17. TERMINIATION: Upon go (ninety) days written notice, the City of Riverdale may cancel this contract without cause. The City of Riverdale may terminate the Contract prior to the expiration of the Term for cause, such early termination being effective immediately upon written notice to the Contractor. "Cause" shall mean: (1) any act by Contractor of personal dishonesty, embezzlement, or misappropriation of the City of Riverdale assets; (2) unlawful possession or use by the Contractor of narcotics or any illegal substance at any time, legal intoxication of Contractor when performing work, or use of drugs or alcohol in any way that impairs Contractor's ability to perform the work for the City of Riverdale; or (g) neglect by the Contractor of any of its duties under this Contract; or (4) negligent or willful conduct by Contractor that is materially and demonstrably injurious to the City of Riverdale or the public or creates a danger to the public. All my trucks are equipped with gps recording devices. They track where the trucks are going, The show all the roads ect. I can send your reports of that every snow storm as well. This would help both of us in case you needed us to focus on different areas longer or what not. Communicating is key so if you need us to do something different my cell phone is on 24/7 all winter long and I will answer my phone at all hours of the day or night. 17. All of are equipment is inspected before every snow, cleaned and washed and ready to roll for the next event. We keep all are trucks and equipment in top notch shape. 18. Sense we are based out of Muscatine I want to re assure that your city would be our number 1 top priority. We would send up at least 2 trucks right before the storm would start. They would sit there and wait tell we needed to start plowing or salting. YOU WOULD NOT BE CHARGED FOR THEM WAITNG TO START. 19. If we needed to haul snow out for any reason we have dump trucks and loader tractors for situations like this. If a large snow storm (blizzard) would happen we would send heavy equipment up there to keep roads in a safe operation manor. 20. Any other question please feel free to ask.
