CITY OF TEMPLE CITY
TEMPLE CITY CALIFORNIA
DECEMBER 5, 1967
INITIATION:
1. Mayor Pro Tem Briggs called the regular meeting of the City
2. Council to order at 7:30 P. M. Invocation was given. by Rev.
James Thomann, First Methodist Church, Woodruff and Golden
3. West, Temple City. Mayor Pro Tem Briggs then led the Pledge
of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen- Harker, Merritt, Tyrell, Briggs
ABSENT: Councilman- Beckley
ALSO PRESENT: City Manager. Koski, City Attorney Martin,
Planning Director Dragicevich, Public Works Director

Councilman Tyrell moved to excuse the absence of Mayor Beckley
who was representing the City elsewhere, Councilman Harker
seconded and the motion was unanimously carried.
APPROVAL OF MINUTES: Regular meeting of Nov. 21, 1967.
Councilman Merritt corrected thei:mi nutesi on ;page,14, follow-
ing roll call vote in paragraph 8 to add for the public record
the oral resignation of Commissioner Nunamaker from the Parking
Commission. Councilman Merritt moved to approve the minutes as
corrected, Councilman Harker seconded, and the motion was un-
animously carried.
PUBLIC HEARING: 7:30 P. M. Re Proposed extension of Ordinance No.
67 -251 for an additional 90 days from December 19, 1967,
relating to zone classification for car wash establishments.
Mayor Pro Tem Briggs declared the public hearing opened.
Planning Director Dragicevich advised the extension was necessary
for the Council to conduct a public hearing and hear the re-
commendations from the Planning Commission.
Mayor Pro Tem Briggs asked if anyone wished to speak in favor
of or against the proposed extension and no one came forward to
speak.
Councilman Tyrell moved to close the public hearing, Councilman
Merritt seconded, and the motion carried unanimously.
City Attorney Martin presented Ordinance 67 -256 AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY EXTENDING INTER-
IM ORDINANCE NO. 67-251. Following discussion Councilman Tyrell
moved to waive further reading and adopt Ordinance No. 67 -256,
Councilman Merritt seconded, and the motion carried unanimously.
PUBLIC HEARING: 7:30 P. M. SIDEWALKS:
A. Emperor, south side, between Loma and Oak Ave.
B. Emperor, south side, between Livia and Loma Ave.
Mayor Pro Tem Briggs declared the public hearing opened.
Public Works Director Pi.zzorno presented item A and advised the
petition received represented 64.98% of the front lineal footage.
The Mayor Pro Tem asked if anyone wished to speak for or against
this installation and no one came forward to speak.
Councilman Merritt moved to close the public hearing, Councilman
Harker seconded, and the motion carried unanimously.

Councilman Harker moved to find the project under item "A" to
be in public interest and to instruct the Supt. of Streets to
cause the work to be done, Councilman Merritt seconded!, and the
motion carried unanimously.
Mayor Pro Tem Briggs declared the public hearing opened on
item "B ".
Public Works Director Pizzorno presented item B and advised
the petition received represented 76.3% of the lineal front
footage involved.
The Mayor Pro Tem asked if anyone wished to speak for or against
this installation and no one came forward to speak.
Councilman Merritt moved to close the public hearing on item B,
Councilman Harker seconded, and the motion carried unanimously.
Councilman Harker moved to find the project under item B to
be in public interest and to instruct the Supt. of Streets to
cause the work to be done, Councilman Merritt seconded, and the
motion carried unanimously.
ORDINANCE NO 67-252: 2nd read.
City Attorney Martin presented Ordinance No. 67 -252 for second
reading titled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING
NEW SECTION 4508 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO
CHARITABLE SOLICITATION PERMITS. Councilman Tyrell moved to
waive further reading and adopt Ordinance No. 67 -252, Council-
man Harker seconded, and the motion carried unanimously.
ORDINANCE NO. 67 -253: 2nd read.
City Attorney Martin presented Ordinance No. 67 -253 for second
reading titled AN ORDINANCE OF THE CITY OF TEMPLE CITY IMPOSING
A DOCUMENTARY STAMP TAX ON THE SALE OF REAL PROPERTY. Council-
man Tyrell moved to waive further reading and adopt Ordinance
No. 67 -253, Councilman Harker seconded, and the motion carried
unanimously.
Councilman Tyrell stated for the record that this tax is not
imposed by the City but that unless the City takes this action
the County will collect all the proceeds from the state tax
and by adopting this Ordinance the City will receive half of
what the County would collect.
ORDINANCE NO. 67 -255: 1st read.
City Attorney Martin presented Ordinance No. 67 -255 which was
requested at the Council meeting of Nov. 21, 1967, and titled
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 7320 OF
THE TEMPLE CITY MUNICIPAL CODE RELATING TO CHANGE OF REGULAR
MEETING DATES OF THE PARKING COMMISSION. Councilman Tyrell
moved to waive further reading of Ordinance No. 67 -255, Council-
man Merritt seconded, and the motion carried unanimously.
No further action was taken as this was the first reading of
the ordinance.
9. PLANNING COMMISSION RECOMMENDATIONS: Meeting of Nov. 14, 1967.
A. Recommend Ordinance No. 65 -151 relating to standards for
construction, operation and maintenance of mobile home parks
be repealed as it is preempted by the State. Recommend Ordi-
nance No. 65 -153 be repealed relating to design requirements
of off- street parking facilities as this is now covered in
the new zoning ordinance.

The Planning Director presented the above recommendation.
Councilman Tyrell moved to instruct the City Attorney to pre-
pare an ordinance in accordance with the recommendation of the
Planning Commission, Councilman Harker seconded, and the motion
was unanimously carried.
B. Recommend adoption by the City Council of a Resolution re-
quiring applicants for State sign permits to obtain certifi-
cates of zoning compliance in incorporated cities re location
of advertising displays adjacent to interstate or federal -aid
primary highways in accordance with a recommendation from the
State Division of Highways.
The Planning Director presented the above recommendation.
Following discussion :,the :.City - Attorney presented Resolution No.
67 -789 A RESOLUTION OF THE-CITY COUNCIL OF THE CITY OF TEMPLE
CITY REQUIRING APPLICANTS FOR STATE OUTDOOR ADVERTISING PERMITS
TO APPLY FOR A CERTIFICATE OF ZONING COMPLIANCE. Councilman
Tyrell moved to adopt Resolution No. 67 -789, Councilman Merritt
seconded, and the motion carried unanimously.
C. Recommend the Council consider an amendment to the City
Zoning Code re time extension for zone variances and condi-
tional use permits once for a period of time not to exceed
one year.
The above recommendation was presented by the Planning Director.
Councilman Tyrell moved to set the requested amendment for public
hearing on Jan. 2, 1968, at 7:30 P. M., Councilman Harker second-
ed and the motion was unanimously carried.
10. PLANNING COMMISSION RECOMMENDATIONS: Meeting of Nov. 28, 1967.
A. Recommend an amendment to the City Zoning Code be consider-
ed by the Council which would provide that structures with
substandard yard areas in R -1 and R -2 zones would continue
to be conforming if they were conforming and existing at the
effective date of the new zoning ordinance which was Aug. 18,
1967.
The Planning Director presented the above recommendation.
Councilman Tyrell moved to set the recommendation for public
hearing on Jan. 2, 1968, at 7:30 P. M., Councilman Harker se-
conded, and the motion was carried unanimously.
B. Recommend clarification of ambiguity, determining and declar-
ing power saws and milling equipment used as accessory uses
to a lumber yard operation are customarily conducted in the
open.
Planning Director Dragicevich presented the above recommenda-
tion and advised the Planning Commission adopted Resolution
No. 67 -275PC determining these are proper accessory uses in
lumber yards and are customarily conducted in the open. The
recommendation is for Council approval of their determination.
Councilman Tyrell moved to approve the recommendation, Coun-
cilman Merritt secondl, and the motion carried unanimously.
C. Recommend the Council consider an amendment to the existing
zoning code relative to the zoning of car wash establishments,
automatic, coin operated, mechanical or by hand, and they
should not be permitted in any "R" zoned property or "C -2"

Councilman Tyrell moved to set this recommendation for public
hearing on Jan. 2, 1968, at 7:30 P. M., Councilman Harker se-
conded and the motion carried unanimously.
11. RESOLUTION NO. 67 -787: appointing personnel - Receptionist Clerk
City Manager Koski presented Resolution No. 67 -787 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PER-
SONNEL. Councilman Tyrell moved to adopt Resolution No. 67 -787,
Councilman Merritt seconded, and the motion carried unanimously.
12. RESOLUTION NO. 67 -788: Warrants & Demands
City Manager Koski presented. Resolution No. 67 -788 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS
AND DEMANDS IN THE SUM OF $42,070.96, DEMAND NOS. 10323 THROUGH
10379. Councilman Harker moved to adopt Resolution No. 67-
788, Councilman Tyrell seconded, and the motion carried unanimous-

13. COMMUNICATIONS:
A. Santa Anita Girl Scout Council, request for charitable soli-
citation permit for annual cookie sale, Febr. & March, 1968.
The City Manager presented the above request. Councilman Tyrell
moved to grant, Councilman Harker seconded, and the motion was
carried unanimously.
B. Proclamation request, that Deco be proclaimed "The Danny
Thomas Teenagers March Month ". Councilman Harker moved to
so proclaim, Councilman Merritt seconded, and the motion was
carried unanimously.
C. The City Manager presented a request from Marvin Braude,
Councilman from the City of Los Angeles, requesting support
by exerting purchasing power to induce automobile manufactur-
ers to make greater progress in the control of harmful auto-
motive exhaust emissions.
Following discussion Councilman Tyrell moved to have the City
Attorney prepare a Resolution to be sent to the legislators
expressing the City's concern regarding the manufacturing and
control of petroleum products to reduce those ingredients pri-
marily responsible for smog and its related problems, Councilman
Merritt seconded, and the motion carried unanimously.
D. The City Manager presented a request for removal of a large
carob tree at 6317 Sultana Ave.
Public Works Director. Pi.zzorno advised he had inspected the
tree and that it had been trimmed recently, that the roots
had raised the asphalt 21" to 3" at the flow line which he
advised should be pruned, and he felt the tree was not hazardous
and should not be removed at this time. Following a lengthy
discussion Councilman Tyrell moved to have the tree removed,
Councilman Merritt seconded, and the motion carried unanimously.
14. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Mr. Gillespie, Vice -Pres. of the Chamber of Commerce, advised
the Council that the Chamber conducted a survey concerning the
mall parking. Of the 27 individual merchants contacted everyone
was willing to keep their employees from parking in prime loca-
tions of the lots, 15 felt the lots for customers only, and 18
felt there should be restrictions on the lots. The merchants
with large businesses were willing to police their own lots for
their employees.

Mr. Gillespie advised the Chamber also had sent a letter to
each merchant asking their cooperation particularly during
the Christmas season. Another survey will be made after the
first of the year.
Mayor Pro Tem Briggs asked if he felt the Chamber could solve
the problem and Mr. Gillespie advised with the cooperation of
the merchants and the Chamber they felt they could police the
lots and control the problem.

MATTERS FROM CITY OFFICIALS:
Councilman Merritt reported several areas in the flood control
project that were depressed and needed attention.
Councilman Tyrell felt the record should be cleared re the
resignation of Commissioner Nunamaker which was unofficial
as it was not in writing, and stated he had discussed this
with Mr. Nunamaker and that he would reconsider if the Council
desired him to remain on the Commission. Councilman Tyrell
moved that the verbal resignation of Mr. Nunamaker not be
accepted by the Council so he will remain on the Commission,
Councilman Merritt seconded, and the motion carried unanimously.
Councilman Harker advised there was a "Road Closed" sign at
the east entrance onto Temple City Blvd. from Broadway that
was lying on the parkway and serving no purpose;; ::and recommend-
ed it be removed if not heeded.
The Council questioned the Public Works Director re the comple-
tion of the work on Broadway and Las Tunas Dr. He advised
any time this week the last course would be put in down the
center of Las Tunas Dr. On Broadway they start the temporary
paving on Wednesday and also the repair at Encinita. Broadway
will be opened in about a week and they are starting the per-
manent paving on Lower Azusa. Councilman Tyrell felt we should
expedite this work to be completed before the racing season.
The Public Works Director advised the tennis courts are in the
process of being etched and should be complete by the end of
the week. Councilman Tyrell will meet him to inspect the courts
8 A.M. Wednesday.
Mayor Pro Tem Briggs thanked Mr. Gillespie and Mr. Goodman
for bringing back the report on the mall parking and for the
manner in which they solved the problem.
City Attorney Martin presented Ordinance No. 67 -254A for second
reading which was adopted as an urgency ordinance on Nov. 21,
1967, and read title - AN`ORDINANCE OF THE CITY OF TEMPLE CITY
RE-ENACTING, RE- ADOPTING AND CODIFYING ORDINANCE NO 66 -178.
Councilman Tyrell moved to waive further reading of Ordinance
No. 67 -254A and to adopt, Councilman Harker seconded, and the
motion carried unanimously.
The Public Works Director advised on the concrete contract on
the mall 3 sections of concrete had been removed and replaced
by the contractor and it now meets specifications and he re-
commended the Council accept the work on Schedule 2. Councilman
Tyrell so moved, Councilman Merritt seconded, and the motion was
unanimously carried.
Public Works Director presented a recommendation that the
Council accept the asphalt work of the mall at this time.
Councilman Harker so moved, Councilman Merritt seconded, and
the motion carried unanimously.

16. ADJOURNMENT:
Councilman Tyrell moved to adjourn to the next regular
meeting on Jan. 2, 1968, at 7 :30 P. M. in the Council Chambers
of the City Hall, 5938 Kauffman Ave., Temple City, Councilman
Harker seconded, and the motion carried unanimously. Council
adjourned at 8:25 P. M.
