September 29, 1959
Pursuant to recession of the meeting on September 19,
the Village Council reconvened at the Village Hall at 9:30
a.m., September 26th. Assistant Mayor Broeman called the
meeting to order and when it was determined that there was
not a quorum present, the meeting was again recessed until
Tuesday morning, September 29, 1959.
Pursuant to recession of the meeting of September 26th,
the Village Council of Bal Harbour Village reconvened at
the Village Hall at 8:30 a.m, on September 29, 1959.
There were present Messrs. Broeman, Faulkner, and White.
Absents Messrs. Beatty and Hart.
Also present were Thomas Anderson, Village Attorney;
Mary T. Wetterer, Village Clerk; and W. H. Webb, Village
Manager.
The Library Committee report, which was deferred from
the session of September 19th, was made by Mr. Faulkner at
which time he recommended to the Council that Mrs. Beulah
Butler be appointed co—chairman of the Library Committee.
This recommendation was unanimously approved by the Council.
The matter of changing the Taxi license year to January
1st to comply with Metro Ordinance date was presented.
During the discussion, Mr. Anderson, The Village Attorney,
stated that he did not feel that it was necessary to change
the License date but that it could remain November 1st of
each year to comply with other licenses being issued in Bal
Harbour. However, it would be necessary to amend the taxi
ordinance to change the date from January 1st to November 1st.
Mr. White then moved that

"AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA
AMENDING ORDINANCE NO. 68 BY CHANGING THE
LICENSING DATE FROM JANUARY 1st TO NOVEMBER 1st
OF EACH YEAR TO AGREE WITH THE LICENSE YEAR OF
THE VILLAGE"
be accepted as submitted. Said motion was seconded by Mr.
Faulkner and unanimously approved.
Assistant Mayor Broeman then asked the Village Manager
to present the resolutions which had been prepared by the
Village attorney with reference to the Beach Erosion problem.

Mr. Webb then read
RESOLUTION NO. 66
"A RESOLUTION OF THE COUNCIL OF BAL HARBOUR
VILLAGE WHICH PURSUANT TO SECTION 5 (b) OF
THE CHARTER OF BAL HARBOUR VILLAGE CREATES
SPECIAL EROSION TAXING DISTRICT NO. I."
After a brief discussion in which the Village Attorney
explained the provisions of the resolution, Mr. White moved
that Resolution No. 66 be adopted as submitted. Said motion
was seconded by Mr. Faulkner and unanimously approved by
the Council. Then, Mr. Webb read
RESOLUTION NO. 67
"A RESOLUTION OF THE COUNCIL OF BAL HARBOUR
VILLAGE WHICH SETS THE COST OF THE IMPROVEMENT
AT $80,000.00 AND THE TIME FOR SPECIAL MEETING
AS OCTOBER 24, 1959"
A discussion followed the reading of said resolution in which
Mr. Anderson advised the Village Council as to the legal steps
to be taken prior to the public hearing. Mr. Faulkner then
moved that Resolution No. 67 be adopted as read. Mr. White seconded
this motion and it was unanimously approved.
During the general discussion of the Beach Erosion problem,
the matter of the removal of an old existing sheet steel seawall
in front of Tracts C, D, and E was again questioned. Mr. Webb
explained that the old seawall had been cut off years ago at the
water line and had been abandoned and that Zurwelle and Whittaker,
the Village Engineers, have definitely recommended that this
seawall must be removed. When Mr.Anderson was asked whose
responsibility it would be to remove the seawall, he stated that
it was a private seawall in front of the three lots mentioned
and that it was the responsibility of the owners of those lots
to have the seawall removed at their expense. He also advised
Mr. Webb that he should contact the owners and advise them
accordingly.
It was explained by the City Manager that in order for the
employees of the Village to get the benefit of a preferred
group hospitalization insurance plan, at least 35 village
employees would have to participate in the plan and the
village would have to contribute a small amount toward this
group premium. It was therefore his recommendation that the
Village Council be included in the group and that a contribution
of fifty cents per month per employee be paid by the Village
for all those wishing to participate in the group; and, that
in lieu of salary the five councilmen be included in the group
with premiums to be paid by the Village. Mr. White moved that
the Council accept the recommendation of the Village Manager.

Mr. Broeman then relinquished the chair to Mr. Faulkner in order
that he might be able to second this motion. Said motion was
unanimously approved by the council.
Assistant Mayor Broeman then re—claimed the chair and
asked if there was any further business to be brought before
the council. There being no further business, the meeting
was adjourned upon motion of Mr. White and second by Mr.
Faulkner.

The Council of Bal Harbour Village met at 9:30 a.m. on
October 24, 1959 at the Village Ha11.
Those present were Messrs. Hart, Beatty, Hroeman, Faulkner,
and White.
Absent: None
Also present were W. H. Webb, Village Manager; Mary T.
"letterer, Village Clerk; Thomas H. Anderson, Village Attorney;
and Arthur Lippack, Village Engineer.
Mayor Hart called the meeting to order and after hearing
the roll call, the minutes of the meeting of September 19,
1959 and recesses thereof were accepted as submitted upon
motion of Mr. Faulkner, seconded by Mr. White and unanimously
approved.
The first item considered by the council was the Beach
Erosion Program at which time it was explained to those present,
either as owners of the ocean front properties or representatives
of the owners, the entire plan for rebuilding the beaches and
the means of financing same. Mayor Hart called on Mr. Lippack,
the Village Engineer, to explain the plan. Mr. Lippack gave
a detailed report on the causes and results of the loss of
sand over the years and explained just exactly what the Sand
Nourishment Program consists of and how it will be accomp—
lished. Copies of the engineer's drawings were available
for all ocean front owners who cared to obtain one. After
