SPECIAL COUNCIL MEETING
KEY BISCAYNE, FLORIDA
THURSDAY, JULY 30, 2015
COUNCIL CHAMBER

1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Mayor at 6:32 p.m. Present were Councilmembers Luis de la Cruz. Theodore Holloway, Michael
E. Kelly, James S. Taintor, Vice Mayor Franklin H. Caplan and Mayor Mayra Lindsay.
Councilmember Ed London was absent. Also present were Village Manager John C. Gilbert, Village
Clerk Conchita H. Alvarez and Village Special Counsel John Shubin and Ian DeMello with Shubin
and Bass.
2. PLEDGE OF ALLEGIANCE: Mayor Lindsay led the Pledge of Allegiance.
3. VILLAGE ATTORNEY: Village Special Counsel John Shubin requested to hold an
Executive Session regarding the following pending litigations: Village of Key Biscayne vs. NMMA,
et al, Case Number 15 -0909160 -CA 11 and Village of Key Biscayne vs. City of Miami, Case
Number 15 -2997 -CA 21, in the 11th Judicial Circuit, In and For Miami -Dade County, Florida.
Vice Mayor Caplan made a motion to hold an Executive Session regarding the above pending
litigations immediately after the Special Council Meeting. The motion was seconded by
Councilmember Kelly and approved by a 6-0 voice vote. The vote was as follows: Councilmembers
de la Cruz, Holloway, Kelly, Taintor, Vice Mayor Caplan and Mayor Lindsay voting Yes.
4. ADJOURNMENT: The meeting was adjourned at 6:35 p.m.

THE APPEAL IS TO BE BASED.
