SPECIAL COUNCIL MEETING
KEY BISCAYNE, FLORIDA
TUESDAY, OCTOBER 13, 2015
COUNCIL CHAMBER
560 CRANDON BOULEVARD
1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Mayor at 5:40 p.m. Present were Councilmembers Luis de la Cruz, Michael E. Kelly, Ed
London, James S. Taintor, Vice Mayor Franklin H. Caplan and Mayor Mayra Lindsay.
Councilmember Theodore Holloway was absent. Also present were Village Manager John C.
Gilbert, Village Clerk Conchita H. Alvarez and Village Special Counsel John Shubin and Ian
DeMello with Shubin and Bass.
2. PLEDGE OF ALLEGIANCE: Councilmember de la Cruz led the Pledge of Allegiance.
3. VILLAGE SPECIAL COUNSEL: Village Special Counsel John Shubin requested to hold
an Executive Session, immediately after this meeting, regarding the following pending litigations:
Village of Key Biscayne vs. NMMA, et al, Case Number 15 -0909160 -CA 11 and Village of Key
Biscayne vs. City of Miami, Case Number 15 -2997 -CA 21, in the 11 th Judicial Circuit, In and For
Miami -Dade County, Florida.
Vice Mayor Caplan made a motion to hold an Executive Session regarding the above pending
litigations immediately after the Special Council Meeting. The motion was seconded by
Councilmember London and approved by a 6-0 voice vote. The vote was as follows:
Councilmembers de la Cruz, Kelly, London, Taintor, Vice Mayor Caplan and Mayor Lindsay voting
Yes.

4. ADJOURNMENT: The meeting was adjourned at 5:41 p.m.

THE APPEAL IS TO BE BASED.
