VILLAGE SPECIAL COUNCIL MEETING
KEY BISCAYNE, FLORIDA
WEDNESDAY, AUGUST 6, 2014
COUNCIL CHAMBER
560 CRANDON BOULEVARD
1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order
by the Mayor at 6:00 p.m. Present were Councilmembers Theodore Holloway, Michael E. Kelly,
Edward London (arrived at 6:21 p.m.), James S. Taintor, Vice Mayor Michael W. Davey and
Mayor Franklin H. Caplan. Councilmember Mayra P. Lindsay was absent. Also present were
Acting Village Manager Eric Lang, Deputy Village Clerk Jennifer Duque and Village Attorney
Stephen J. Helfman.
2. PLEDGE OF ALLEGIANCE: Mayor Caplan led the Pledge of Allegiance.
3. RESOLUTIONS: The Village Attorney read the following resolution by title:
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY
BISCAYNE, FLORIDA, ACCEPTING BEACH ACCESS DEDICATION EASEMENTS
AS WELL AS EASEMENTS DEPICTED ON THE APPROVED SITE PLAN FROM
CONSULTATIO KEY BISCAYNE, LLC ON PROPERTY LOCATED AT 350 OCEAN
DRIVE; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN
EFFECTIVE DATE.
Councilmember Davey made a motion to approve the resolution. The motion was seconded by
Councilmember Kelly.
August 6, 2014
The Village Attorney addressed the Council recommending approval of the beach access
easement agreement with Consultatio Key Biscayne, LLC on the property located at 350 Ocean
Drive.
There was extensive discussion from Council regarding the beach access easement agreement.
Mr. Marcos Corti-Maderna, 325 Atlantic Road and Mr. John K. Shubin from Shubin & Bass,
addressed the Council regarding the beach access easement agreement.
The resolution was approved by a 6-0 voice vote. The vote was as follows: Councilmembers
Davey, Holloway, Kelly, London, Taintor and Mayor Caplan voting Yes.
4. OTHER BUSINESS/PENDING LITIGATION: A list of pending business/pending
litigation was presented to the Council.
5. SCHEDULE OF FUTURE MEETINGS/EVENTS: A schedule of future meetings and
events was presented to the Council.
6. ADJOURNMENT: The meeting was adjourned at 6:30 p.m.

PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND
EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED.
