SPECIAL VILLAGE COUNCIL MEETING
KEY BISCAYNE, FLORIDA
TUESDAY, AUGUST 13, 2013

1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Mayor at 7:00 p.m. Present were Councilmembers Michael W. Davey, Theodore Holloway,
Michael E. Kelly, James S. Taintor, Vice Mayor Mayra Lindsay and Mayor Franklin H. Caplan.
Councilmember Edward London was absent. Also present were Acting Village Manager Chief of
Police Charles Press, Village Clerk Conchita H. Alvarez and Village Attorney Stephen J. Helfinan.
The Mayor addressed the Council and the public stating that this Special Meeting was called to
discuss the traffic pattern on Bear Cut Bridge. Councilmember Kelly also addressed the Council and
the public expressing his concerns regarding the hazard of cars and cyclists sharing the same road
during construction of the Bear Cut Bridge.
2. DISCUSSION OF TRAFFIC PATTERN ON BEAR CUT BRIDGE: Mr Antonio
Cotarelo, Miami -Dade County Engineer addressed the Council regarding the new traffic pattern at
Bear Cut Bridge. Mr Michael R. Bauman, Miami -Dade County Public Works and Waste
Management Department Chief Causeways Division also addressed the Council.
The Village Attorney also addressed the Council stating that this is a serious situation and Miami -
Dade County has the authority to create significant restriction on cyclists and pedestrians going
across the Bridge. The Attorney also stated that the County has substantial power to enforce and
require that cyclists unmount their bicycles in order to cross the bridge.

There was extensive discussion from Council regarding the life safety issues of the current traffic
pattern at Bear Cut Bridge during construction.
Councilmember Kelly made a motion to approve the following resolution and to forward the
resolution to the following authorities: Miami -Dade County Mayor Carlos Gimenez, Miami -Dade
County Commission, the Miami Herald, Department Heads of the Appropriate Public Agencies
within Miami -Dade County and the Appropriate Public Agencies within the State of Florida.
WE THE COUNCIL OF THE VILLAGE OF KEY BISCAYNE RESPECTFULLY
REQUEST MIAMI-DADE COUNTY USE THEIR AUTHORITY TO RESTRICT BICYCLE
AND PEDESTRIAN TRAFFIC TO A SEGREGATED BICYCLE/PEDESTRIAN PATH
DURING THE PERIOD OF RECONSTRUCTION OF THE BEAR CUT BRIDGE FOR THE
SAKE OF SAFETY FOR ALL USERS OF THE BEAR CUT BRIDGE.
Mr. Frank Digilio with Kiewit addressed the Council giving an update on the construction at Bear
Cut Bridge.
The motion was seconded by Councilmember Taintor and approved by a 6-0 voice vote. The vote
was as follows: Councilmembers Davey, Holloway, Kelly, Taintor, Vice Mayor Lindsay and Mayor
Caplan voting Yes.
3. ADJOURNMENT: The meeting was adjourned at 7:55 p.m.
