1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Chairman at 7:00 p.m. Present were Councilmembers Michael W. Davey, Theodore Holloway,
Michael E. Kelly, Edward London, James S. Taintor and Chairman Franklin H. Caplan. Vice Mayor
Mayra P. Lindsay was absent. Also present were Village Manager John C. Gilbert, Deputy Village
Clerk Jennifer Duque and Village Attorney Stephen J. Helfman.
2. INVOCATION: Reverend David Moran, Presbyterian Church, gave an invocation.
3. PLEDGE OF ALLEGIANCE: Chairman Caplan led the Pledge of Allegiance.
4. APPROVAL OF MINUTES: Councilmember Davey made a motion to approve the
minutes of the January 22, 2013 Local Planning Agency Meeting. The motion was seconded by
Councilmember Kelly and approved by a 6-0 voice vote. The vote was as follows: Councilmembers
Davey, Holloway, Kelly, London, Taintor and Chairman Caplan voting Yes.
5. ORDINANCES: A public hearing and recommendation of the Village Council sitting as
the Local Planning Agency on the following proposed ordinance:

AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, REZONING
PROPERTY LOCATED AT 971 CRANDON BOULEVARD FROM 0-1 LIGHT INTENSITY
OFFICE TO C-1 LIGHT INTENSITY COMMERCIAL; AND PROVIDING FOR AN
EFFECTIVE DATE.
Councilmember Davey made a motion to recommend the adoption of the ordinance to the Council
as it is consistent with the Master Plan. The motion was seconded by Chairman Caplan.
The Attorney addressed the Council regarding the proposed ordinance.
The Chairman opened the public hearing. Raul Cerna, 251 Crandon Blvd, on behalf of
the L' Esplanade addressed the Council. The Chairman closed the public hearing.
The motion to recommend the proposed ordinance to the Village Council, as it is consistent with the
Master Plan, was approved by a 6-0 roll call vote. The vote was as follows: Councilmembers Davey,
Holloway, Kelly, London, Taintor and Chairman Caplan voting Yes.
6. ADJOURNMENT: The meeting was adjourned at 7:15 p.m.
