SPECIAL COUNCIL MEETING
KEY BISCAYNE, FLORIDA
TUESDAY, JANUARY 6, 2011
COUNCIL CHAMBER

1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Mayor at 9:05 a.m. Present were Councilmembers Michael W. Davey, Robert Gusman, James
S. Taintor and Mayor Franklin H. Caplan. Councilmembers Enrique Garcia, Mayra P. Lindsay and
Vice Mayor Michael E. Kelly were absent. Also present were Village Manager Genaro "Chip"
Iglesias, Village Clerk Conchita H. Alvarez and Village Attorney Stephen J. Helfman.
2. PLEDGE OF ALLEGIANCE: Mayor Caplan led the Pledge of Allegiance.
3. VILLAGE ATTORNEY: The Village Attorney addressed the Council reporting that
pursuant to the Florida Statutes the Attorney needs to request approval, at a duly noticed Council
Meeting, to hold an Executive Session regarding Padilla vs VKB to be held at 6:00 p.m. on Tuesday,
January 11, 2011 prior to the Council Meeting scheduled for that evening.
It was consensus of Council to hold the above mentioned Executive Session on Tuesday, January
11, 2011 at 6:00 p.m.
4. ADJOURNMENT: The meeting was adjourned at 9:07 a.m.

THE APPEAL IS TO BE BASED.
