SPECIAL COUNCIL MEETING
KEY BISCAYNE, FLORIDA
THURSDAY, NOVEMBER 17, 2011

1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Mayor at 7:00 p.m. Present were Councilmembers Michael W. Davey, Enrique Garcia, Robert
Gusman, Mayra P. Lindsay, James S. Taintor, Vice Mayor Michael E. Kelly and Mayor Franklin H.
Caplan. Also present were Village Clerk Conchita H. Alvarez and Village Attorney Stephen J.
Helfinan.
2. PLEDGE OF ALLEGIANCE: Mayor Caplan led the Pledge of Allegiance.
3. VILLAGE MANAGER SEARCH/SELECTION FOLLOW UP: Colin Baenziger with
Colin Baenziger & Associates addressed the Council.
On the advice of search consultant Colin Baenziger, the meeting started with a straw poll of the
Council in which each Councilmember was asked to list their top five candidates.
The 14 finalists for the Village Manager position are: Rene Crichton, Michael Dutton, Kenneth
Fields, John Gilbert, Roberto Hernandez, Peter Lombardi, Jim Payne, Joe Rasco, Fred Russell, Dale
Sugerman, John Szerlag, Mark Taxis, Bob Vitas and Randy Witt.

Mr. Gilbert and Mr. Taxis received five votes, while Fields, Hernandez and Vitas received three
votes each. Everyone else received two or fewer votes, giving the Council the top five candidates.
The Attorney announced the votes. The votes were as follows: Mayor Caplan voted for John Gilbert,
Roberto Hernandez, Joe Rasco, Dale Sugerman and Mark Taxis. Vice Mayor Kelly voted for Rene
Crichton, Jim Payne, John Szerlag, Mark Taxis and Bob Vitas. Councilmember Davey voted for
Kenneth Fields, John Gilbert, Joe Rasco, John Szerlag and Mark Taxis. Councilmember Garcia
voted for John Gilbert. Councilmember Gusman voted for Rene Crichton, John Gilbert, Roberto
Hernandez, Peter Lombardi and Randy Witt. Councilmember Lindsay voted for Kenneth Fields,
Roberto Hernandez, Jim Payne, Mark Taxis and Bob Vitas. Councilmember Taintor voted for
Kenneth Fields, John Gilbert, Peter Lombardi, Mark Taxis and Bob Vitas.
The Council thanked all the candidates for taking part in the process.
Mr. Baenziger addressed the Council regarding the schedule for the Village Manager Interview
proposing that interviews start on Saturday, December 2, 2011 with breakfast at 7:45 a.m., individual
interview with Councilmembers immediately after, lunch at 1:00 p.m. with the candidates and a
Special Council Meeting at 2:00 p.m.
Councilmember Garcia excused himself from the meeting at 6:30 p.m.
Mayor Caplan made a motion to ratify Mr. Gilbert, Mr. Taxis Mr. Fields, Mr. Hernandez and Mr.
Vitas as the five finalists for the position of Village Manager. The motion was seconded by Vice
Mayor Kelly and approved by a 6-0 voice vote. The vote was as follows: Councilmembers Davey,
Gusman, Lindsay, Taintor, Vice Mayor Kelly and Mayor Caplan voting Yes.
Councilmember Davey addressed the Council regarding the Deep Dredging Project and the direct
impact on Key Biscayne.
The Attorney addressed the Council regarding this process.
Councilmember Davey made a motion to direct the Attorney to make sure that Key Biscayne rights
to challenge are preserved. The motion died for lack of a second.
The Attorney requested an Executive Session regarding the Sands/Sonesta matter on Tuesday,
November 22, 2011 at 6:00 p.m. There was no objection to the request.
4. ADJOURNMENT: The meeting was adjourned at 6:55 p.m.

MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS
MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH
THE APPEAL IS TO BE BASED.
