Mayor Beckley called the regular meeting of the City Council 2. to the order at 7:30 P. M. Invocation was given by Father Blaire of St. Luke's Catholic Church, 9451 Broadway, Temple 3. City, following which the Mayor led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Briggs, Harker, Merritt, Tyrell, Beckley ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Public Works Direct- or P i zzorno APPROVAL OF MINUTES: Regular meeting of December 5, 1967. Councilman Harker moved to approve the minutes of the regular meeting of December 5, 1967, as mailed, Councilman Briggs se- conded, and the motion was carried unanimously. PUBLIC HEARING: 7:30 P. M. RE TIME EXTENSION FOR ZONE VARIANCES AND CONDITIONAL USE PERMITS ONCE FOR A PERIOD OF TIME NOT TO EXCEED ONE YEAR. Planning Director Dragicevich advised the present zoning ordinance does not state how many times a zone variance or con- ditional use permit can be extended and the Planning Commission recommends an extension be granted only once and for a period not to exceed one year. Mayor Beckley declared the public hearing opened and asked if anyone in the audience wished to speak for or against the re- commendation. No one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Harker seconded, and the motion carried unanimously. City Attorney Martin presented Ordinance No. 68 -258 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9231 OF THE TEMPLE CITY MUNICIPAL CODE, to accorrplish the recommendation of the Planning Commission. Considerable discussion followed regarding the wording of the proposed amendment as to the use or permit being exercised and to what extent in accordance with the conditions of the resolution of the Planning Commissi- on granting the variance or conditional use permit. Council- man Tyrell moved to waive further reading of Ordinance No. 68 258 and to refer it back to the Planning Commission for their determination, Councilman Briggs seconded, and the motion was unanimously carried. No further action was taken as this was the first reading of the ordinance. PUBLIC HEARING: 7:30 P. M. RE EXISTING USES ON PROPERTIES IN R -1 AND R -2 ZONES WHICH SHALL BE DEEMED TO BE CONFORMING IF THEY WERE CONFORMING AND EXISTING AT THE EFFECTIVE DATE OF THE NEW ZONING ORDINANCE (Aug. 18, 1967) The Planning Director advised the Planning Commission recommends an amendment to the Zoning Code whereby R -1 and R -2 properties which were existing and conforming prior to adoption of the new Zoning Code should be deemed to be conforming and they should not be required to apply for a variance if they wish . to add on to their property or remodel. He explained in detail Council Minutes, January 2, 1968, page 2 the recommendation of the Commission. Mayor Beckley declared the public hearing opened and asked if anyone wished to speak for or against the recommendation. Mr. Robert Bock, 5328 Encinita, spoke in favor of the amend- ment to the Zoning Code and also spoke on the problems he is faced with having two houses on an R -1 lot each having 7200 sq. ft. and built prior to 1964 when the City's original zoning ordinance was adopted. Following discussion the Planning Director was instructed to get the dates of construction and all pertinent information regarding Mr. Bock's property as it appeared there should have been a lot split at the time the construction was done, and also to forward a copy of the report to Mr. Bock. No one else came forward to speak and Councilman Tyrell moved to close the public hearing, Councilman Harker seconded, and the motion carried unanimously. City Attorney Martin presented Ordinance No. 68 -260 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING CERTAIN OF THE ZONING REGULATIONS RELATING TO ZONES R -1 AND R -2, pre- pared in accordance with the Planning Commission recommendation. Councilman Tyrell moved to waive further reading of Ordinance No. 68 -260, Councilman Harker seconded, and the motion was un- animously carried. No further action was taken as this was the first reading of the ordinance. PUBLIC HEARING: 7:30 P. M. RE AMENDMENT TO ZONING CODE RELATIVE TO THE ZONING OF CAR WASH ESTABLISHMENTS Planning Director Dragicevich presented the recommendation of the Planning Commission that the Zoning Code be amended so that car washes, (automatic, coin operated, mechanical or by hand) shall not be permitted �n any property zoned "R" or "C -2" but shall not prohibit washing of motor vehicles by hand as an accessory use to a permitted principal use in any zone. Mayor Beckley declared the public hearing opened and asked if anyone wished to speak for or against the recommendation. No one came forward to speak at this time. Councilman Tyrell moved to close the public hearing, Councilman Briggs seconded, and the motion carried unanimously. Considerable discussion followed regarding the interpretation of "accessory use ". City Attorney Martin presented Ordinance No. 68 -259 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING CERTAIN OF THE ZONING REGULATIONS OF THE CITY WITH REFERENCE TO AUTOMOBILE CAR WASHES, which would not permit any type of car wash on any property zoned "R" and would require a conditional use permit in all other zones. Councilman Tyrell moved to waive further reading of Ordinance No. 68 -259, Council- man Briggs seconded, and the motion was unanimously carried. No further action was taken as this was the first reading of the ordinance. 6. ORDINANCE NO. 67 -255: 2nd read. Amending the Municipal Code Section 7320 changing meeting dates of Parking Commission. City Attorney Martin presented Ordinance No. 67 -255 for second reading AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 7320 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO CHANGE OF REGULAR MEETING DATES OF THE PARKING COMMISSION. Councilman Tyrell moved to waive further reading and to adopt Ordinance No. 67 -255, Councilman Harker seconded, and the motion was carried unanimously. Council Minutes, January 2, 1968, page 3 7. ORDINANCE NO. 68 -257: 1st read. Repealing Ordinance No. 65- 151 and No. 65 -153 which are superseded by new zoning ordinance. City Attorney Martin presented Ordinance No. 68 -257 AN ORDINANCE OF THE CITY OF TEMPLE CITY REPEALING ORDINANCES 65 -151 and 65 -153. Councilman Harker moved to waive further reading of Ordinance No. 68 -257, Councilman Tyrell seconded, and the motion was unanimous- ly carried. No further action was taken as this was the first reading of the ordinance. RESOLUTION NO. 68 -792: Urging the State Legislature to take appropriate action to establish stringent standards controlling the manufacture of gasoline and petroleum products for the pur- pose of reducing sulphur content therein. City Attorney Martin presented the above resolution requested by the Council at the regular meeting of December 5, 1967. Councilman Tyrell moved to adopt Resolution No. 68 -792 and to distribute copies to all cities in Los Angeles County and to our legislators, Councilman Merritt seconded, and the motion was unanimously carried. NEW BUSINESS: 9. SET PUBLIC HEARING re proposed assessments for curb, gutter and street widening on south side of Live Oak from Rosemead Blvd. to Eaton Wash. The City Manager recommended no action be taken to set a public hearing at this time. 10. RESOLUTION NO. 68 -790: appointing personnel (temporary tree trimmer. City Manager Koski presented Resolution No. 68 -790 appointing temporary personnel for tree trimming. Councilman Merritt moved to adopt Resolution No. 68 -790, Councilman Harker seconded, and the motion was unanimously carried. 11. RESOLUTION NO. 68 -793: appointing permanent tree trimmer City Manager Koski presented Resolution No. 68 -793 appointing a tree trimmer on a permanent basis. Councilman Harker moved to adopt Resolution No. 68 -793, Councilman Briggs seconded, and the motion was carried unanimously. 12. RESOLUTION NO. 68 -794: Street opening (Val St. west of Golden West) Public Works Director Pizzorno stated the City had acquired a portion of Val St. and requested it be dedicated for roadway purposes as there is a proposed development on this corner. The corner lot split cannot be approved without this dedication. Requirements for approval of the lot split would require installa- tion of curb, gutter and pavement for which a bond or deposit could be received and held until further dedications from other properties on the street were made and the work all done at the same time. The City Attorney advised the Council could grant the lot split subject to requirements imposed and could also impose bond requirements for the street improvement, and the Resolution could be made effective on acceptance of conditions. City Attorney Martin presented Resolution No, 68 -794 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN CITY -OWNED PROPERTY TO BE ACCEPTED AS A PUBLIC STREET. Council- man Tyrell moved to adopt Resolution No. 68 -794, Councilman Harker seconded, and the motion was unanimously carried. Council Minutes, January 2, 1968, page 4 13. TRAFFIC COMMISSION RECOMMENDATIONS: A. Item 5 - TRAFFIC ORDINANCE. Recommend Code changes to en- able Traffic Commission to take direct action on traffic matters not dealing with regulatory signs or markings with exception of placement of red curb markings adjacent to intersections, driveways or fire hydrants. Public Works Director Pizzorno presented the above recommenda- tion. Following discussion Councilman Harker moved to approve the intent of this recommendation, Councilman Merritt seconded and the motion was carried unanimously. The staff will present specific recommendations on a proposed amendment to the City Council at their next regular meeting. B. Item 9 - WOODRUFF AVENUE & KAUFFMAN AVE. Recommend: 1. That 21 feet of red curb markings be placed on the east side of Kauffman Ave., south of Woodruff Ave., which will result in losing only one parking space. 2. That 25 feet of red curb marking be placed at the other three approaches to the intersection, providing better sight clearance at this intersection during functions at the Women's Club. The Public Works Director presented the above recommendation. Councilman Merritt moved to approve recommendation "B ", Coun- cilman Briggs seconded, and the motion carried unanimously. C. Item 10 - LONGDEN AVE. & OAK AVE. Recommend that "Stop Ahead" pavement markings be placed on Longden Ave. at both approaches to Oak Ave. The Public Works Director presented the above recommendation. Councilman Briggs moved to approve recommendation "C ", Coun- cilman Harker seconded, and the motion was unanimously carried. D. Item 11 - ADDITIONAL POST PATROL FOR RACING SEASON. Re- commend reaffirmation of previously established policy of additional post patrol for racing season. Public Works Director Pizzorno presented the above recommenda- tion. Councilman Harker moved to approve recommendation "D ", Councilman Briggs seconded, and the motion carried unanimously. 14. RESOLUTION NO. 68 -791: Warrants & Demands City Manager Koski presented Resolution No. 68 -791 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $41,935.85, DEMAND NOS. 10381 THROUGH 10480. Councilman Harker moved to adopt Resolution No. 68 -791, Coun- cilman Tyrell seconded, and the motion was unanimously carried. 15. COMMUNICATIONS: City Manager Koski presented a request from the Junior Chamber of Commerce of Temple City proclaiming the week of Jan. 21 -27, 1968 as "JAYCEE WEEK ". Councilman Merritt moved to so proclaim, Councilman Tyrell seconded, and the motion carried unanimously. 16. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: "Pop" Gunst, 4929 Heleo, presented a request for the Council to work with the Temple City Community Youth Center group in securing a lot which they would buy to start a community center area with the City later procuring lots adjoining for further Council Minutes January 2, 1968, page 5 development of the center in the future. He explained the proposal to the Council and asked their cooperation. The Councilmen expressed their interest and following consider- able discussion decided to refer the proposal to the Parks & Recreation Commission to consider locations and also to make recommendations to the Council as soon as possible so as not to delay the project. The Parks & Recreation Commis - sion will also work with the Planning Commission as to zoning. Lewis Gilbertson, 9232 Sparklett, stated the City had co- sponsored the Pop Warner Football League and on behalf of the League he expressed their appreciation and reported on the successful season and Camellia Bowl and the guest team from Hawaii. He advised Temple City had received some fine publicity in Hawaii as a result of the hospitality and cooperation of this city. 17. MATTERS FROM CITY OFFICIALS: The Public Works Director presented a request for removal of two carob trees, one at 6022 Encinita, and one at 6032 Encinita, both approximately 40 yrs. old and considered a hazard. Councilman Tyrell moved that these trees be removed, Council- man Briggs seconded, and the motion carried unanimously. The Public Works Director also presented the tree planting program for January, 1968, for Council information. Councilman Briggs asked about the tennis courts and was ad- vised by the Public Works Director that they are in the final stages of completion and the Council will be advised when they are finished for their inspection and acceptance; Councilman Briggs asked about the paving on Temple City Blvd., Las Tunas Dr, and Broadway. Public Works Director Pizzorno ad- vised he had advised the Flood Control that it was not satis- factory and they are to come back and improve the streets. City Manager Koski presented Ordinance No. 68 -261 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTION 3335 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO PROHIBITING OF BACK -IN PARKING ON MUNICIPAL PARKING LOTS. He explained adoption of this ordi- nance would provide legal machinery to enforce it. Councilman Tyrell moved to waive further reading of Ordinance No. 68 -261, Councilman Harker seconded, and the motion carried unanimously. The City Manager will have a firm recommendation on the signing required for the lots at the next Council meeting. The City Manager advised that the Director of Recreation through Mr. Adams of the Recreation Commission had made available to the City three used tennis ball machines from the college (L.A.State) and it was felt one ,good machine could be assembled from the three. He recommended the Council accept the machines. Follow- ing discussion Councilman Harker moved to accept the three machines to be used by department personnel in conducting author- ized activity, Councilman Briggs seconded, and the motion was unanimously carried, Councilman Merritt asked about the street signs for Baldwin Ave. Traffic Engineer Envall advised negotiations were under way at the present time. Also that it takes about sixty days to get the signs after ordering. Councilman Merritt asked about the signals at Baldwin and Olive, as it takes fast walking to get across Baldwin before the signal changes. Traffic Engineer Envall advised this matter had come 1 1 1 Council Minutes, January 2, 1968, page 6 before the Traffic Commission and stated there was a maximum time to cross of 14 seconds and 13 seconds "Don't Walk ", making a total of 27 seconds. He will check it out again. 18. ADJOURNMENT: Councilman Merritt moved to adjourn to a personnel session, Councilman Briggs seconded, and the motion carried unanimously. Council adjourned at 9:30 P.
