FIRST BUDGET HEARING
KEY BISCAYNE, FLORIDA
TUESDAY, SEPTEMBER 8, 2009

1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by
the Mayor at 7:00 p.m. Present were Councilmembers Enrique Garcia, Robert Gusman, Jorge E.
Mendia, Thomas Thornton, Vice Mayor Michael W. Davey and Mayor Robert L. Vernon.
Councilmember Michael E. Kelly was absent. Also present were Village Manager Genaro "Chip"
Iglesias and Village Attorney Stephen J. Helfman.
2. BUDGET RESOLUTION: The Attorney read the following resolution by title:
A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; ADOPTING THE
PROPOSED MILLAGE RATE OF THE VILLAGE OF KEY BISCAYNE FOR THE FISCAL
YEAR COMMENCING OCTOBER 1, 2009 THROUGH SEPTEMBER 30, 2010 PURSUANT
TO FLORIDA STATUTE 200.065 (TRIM BILL); SETTING A DATE FOR A FINAL
PUBLIC HEARING TO ADOPT THE MILLAGE RATE; PROVIDING FOR AN
EFFECTIVE DATE.
Vice Mayor Davey made a motion to approve the resolution. The motion was seconded by
Councilmember Garcia.
The Manager addressed the Council recommending the adoption of a 3.2 millage rate.

Vice Mayor Davey made a motion to table the resolution adopting the proposed millage rate. The
motion was seconded by Councilmember Mendia and approved by a 6-0 voice vote. The vote was
as follows: Councilmembers Garcia, Gusman, Mendia, Thornton, Vice Mayor Davey and Mayor
Vernon voting Yes.
3. ORDINANCES: The Attorney read the following ordinance on first reading, by title:
AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; ADOPTING THE
BUDGETS FOR THE FISCAL: YEAR COMMENCING OCTOBER 1, 2009 THROUGH
SEPTEMBER 30, 2010 PURSUANT TO FLORIDA STATUTE 200.065 (TRIM BILL);
PROVIDING FOR AN EFFECTIVE DATE.
Vice Mayor Davey made a motion to adopt the ordinance on first reading. The motion was seconded
by Councilmember Garcia.
The Manager addressed the Council regarding the accomplishments for Fiscal Year 2008-2009. The
proposed budget includes a 3% salary increase for all employees except for the Village Manager,
Village Clerk and Department Heads.
The Council requested the following information from staff: updated 5% elimination savings by
department (with benefits), savings of no COLA by department _(with benefits), Attorney's costs
broken down by category, obtain information of BZP outsourcing, full cost of Fire Department with
a 5% merit (plus benefits).

Acting Director of Finance and Administrative Services, Beatrice Galeano addressed the Council
and the public regarding the Revenue Budgets.
The Manager also addressed the. Council regarding .the budgets for the Village Council, the
Administration and Finance Departments and the Office of the Clerk.
Alfredo Mesa, Vice President with Dutko Worldwide, Federal Relations Representative for
the Village addressed the Council.
The Attorney addressed the Council regarding the budget for the Village Attorney.
Jud Kurlancheek, Director of Building, Zoning and Planning addressed the Council regarding the
budget for the BZP Department.
Chief of Police Charles Press addressed the Council regarding the budget for the Police Department.

Chief of Fire Rescue John C. Gilbert addressed the Council regarding the budget for the Fire Rescue
Department.
Public Works Director, Armando Nunez addressed the Council regarding the budget for the Public
Works Department.
Todd Hofferberth, Parks and Recreation Director addressed the Council regarding the budgets for
the Parks and Recreation Department, the Community Center and the Youth Athletics Program.
Acting Finance Director Galeano also addressed the Council regarding the Transportation Special
Revenue Fund.
The Manager also addressed the Council regarding the Capital Projects Fund, the Capital Outlay
Allocations, the Stormwater Enterprise Fund and the Solid Waste Enterprise Fund.
The Mayor opened the public hearing. Ed Meyer, 798 Crandon Boulevard addressed the
Council. The Mayor closed the public hearing.
Vice Mayor Davey made a motion to remove from the table the proposed millage rate resolution.
The motion was seconded by Councilmember Thornton and approved by a 6-0 voice vote. The vote
was as follows: Councilmembers Garcia, Gusman, Mendia, Thornton, Vice Mayor Davey and
Mayor Vernon voting Yes.
The Attorney announced that the rolled -back rate is 3.4138 mills and the proposed millage rate is
3.2 mills which is 6.263% under the rolled -back rate.
The motion to approve the resolution adopting the proposed millage rate for the fiscal year
commencing October 1, 2009 through September 30, 2010 was approved by a 6-0 roll call vote. The
vote was as follows: Councilmembers Garcia, Gusman, Mendia, Thornton, Vice Mayor Davey and
Mayor Vernon voting Yes.
The motion to adopt the budget ordinance on first reading was approved by a 6-0 roll call vote. The
vote was as follows: Councilmembers Garcia, Gusman, Mendia, Thornton, Vice Mayor Davey and
Mayor Vernon voting Yes.
The second reading of this ordinance will be on Tuesday, September 22, 2009.
The Attorney read the following ordinance on second reading, by title:
AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AUTHORIZING
THE ISSUANCE OF NOT EXCEEDING $1,200,000 OF WATER AND SEWER REVENUE

BONDS OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; PROVIDING FOR A
SUPPLEMENTAL RESOLUTION SETTING FORTH THE DETAILS OF SAID BONDS;
AND PROVIDING AN EFFECTIVE DATE.
Vice Mayor Davey made a motion to adopt the ordinance on second reading. The motion was
seconded by Councilmember Garcia.
The Manager addressed the Council recommending the approval of this ordinance authorizing the
execution of a bank loan to pay for any portion of the Sanitary Sewer Project in lieu of the previously
approved State Revolving Fund.
Lourdes Abadin with Estrada Hinojosa also addressed the Council regarding this loan.
The Mayor opened the public hearing. There were no speakers present. The Mayor closed
the public hearing.
The ordinance was adopted on second reading by a 6-0 roll call vote. The vote was as follows:
Councilmembers Garcia, Gusman, Mendia, Thornton, Vice Mayor Davey and Mayor Vernon voting
Yes.
4. BUDGET INFORMATION: The following was presented to the Council for their
information: 1.) Resolution 2009-14 adopted July 7, 2009 setting the first and second budget
hearings; 2.) Public notice regarding the adoption of the budgets for Fiscal Year commencing
October 1, 2009 through September 30, 2010 advertised in the Daily Business Review and The
Islander News on September 3, 2009 and on September 10, 2009 and 3.) Miami -Dade County
Certification of Taxable value
5. RESOLUTIONS: The Attorney read the following resolution by title:
A CAPITAL PROJECT RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AWARDING CONSTRUCTION CONTRACT FOR
HARBOR DRIVE RESURFACING AND LIGHTING IMPROVEMENTS TO MAGGOLC,
INC. (THE "CONTRACTOR"); AUTHORIZING THE PROJECT AND EXPENDITURE OF
FUNDS; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR EFFECTIVE DATE.
Vice Mayor Davey made a motion to approve the resolution. The motion was seconded by
Councilmember Garcia.
The Manager addressed the Council recommending to award the construction contract to Maggolc,
Inc., Engineering Contractor. On July 2, 2009, the Village and the Florida Department of
Transportation entered into a Local Agency Program Agreement to provide lighting and resurfacing
improvements along Harbor Drive, which is classified as a federal -aid collector roadway. The
Agreement commits $261,587 of federal funds authorized under the American Recovery &

Reinvestment Act of 2009 toward these improvements.
Ramon Castella with 3CTS addressed the Council regarding this project.
The resolution was approved by a 6-0 voice vote. The vote was as follows: Councilmembers
Garcia, Gusman, Mendia, Thornton, Vice Mayor Davey and Mayor Vernon voting Yes.
6. SCHEDULE OF FUTURE MEETINGS AND EVENTS: A schedule of future meetings
and events was presented to the Council.
7. ADJOURNMENT: The meeting was adjourned at 9:52 p.m.
