The Regular Meeting of the Mayor and Council of the Borough of COUNCIL MEETING
Carteret was called to order by Mayor James A. Failace approximately
7:30 P.M. on Thursday, March 21, 2002, Municipal Court/Police
Facility, 230 Roosevelt Avenue, Carteret, New Jersey.
Upon individual roll call, the following were noted present: ROLL CALL

Also noted present was Borough Attorney Robert J. Bergen, Esq.
Noted absent was Councilmember Buddy Sohayda. NOTED ABSENT
The meeting was opened with a moment of Silent Prayer and The PRAYER, PLEDGE
Pledge of Allegiance led by Mayor James A. Failace. OF ALLEGIANCE
At approximately 7:31 P.M., Councilmember Sohayda was noted NOTED ABSENT
present.
The Clerk stated that on March 15, 2002, in full compliance with the STATEMENT OF
Open Public Meeting Act, a notice of tonight's meeting was sent to MEETING NOTICE
The Home News Tribune, The Star-Ledger and posted on the bulletin
board.
Upon MMS&C, by Councilmembers Reiman and Rios and unanimous APPROVAL OF
affirmative vote of the full membership present, the minutes of MINUTES
February 7, 2002 and March 7 & 13, 2002 were approved as
transcribed and engrossed by the Clerk.
ORDINANCE #02-07 was introduced and adopted on First Reading ORDINANCE #02-07
and the Clerk authorized and directed to advertise same for Public CAPITAL

Stan Gutowski, New Jersey Avenue asked if there was a not to exceed
amount on Resolution #01-119.
Mayor Failace said $10,000.
John Sudia asked about Resolution #02-116.
Borough Attorney Bergen explained about the ongoing arbitrations the
law firm is involved in with labor issues and some of the details
concerning this. He said he felt that since they were already involved
with the matters it made sense for them to take care of it and get us
through the year. He said if the money was not expended it could be
cancelled.
Mayor Failace said it would be much more cost effective.

Mayor Failace questioned whether they paid LeBrato on a Resolution COMMENTS
in December. He questioned the need for Resolution #02-119.
Borough Attorney Bergen explained about the money and said he
would double check on it for the Mayor.
-- Mayor Failace asked if it was a case of the cart before the horse since
there were no charges filed why did they need a heating officer.
Borough Attorney Bergen explained that the Council authorized
charges to be filed and explained how the statute runs and what would
be required.
There being no further comments or objections to the Resolutions, the MEETING CLOSED
Mayor declared the Public Hearing to be closed, upon MMS&C, by
Councilmembers Reiman and Rios and unanimous affirmative vote of
the full membership present.
The Borough Clerk asked if any Councilmembers wanted any CONSENT AGENDA
Resolutions to be taken off the Block Vote and asked for a motion.
Councilmember Reiman made a motion to Table Resolution #02-119 MOTION MADE
for further discussion at the next Agenda Meeting.

Township of North Brunswick for the purpose of storing vehicles and

The Clerk stated that she was in receipt of a Communication from PSF/tG
PSE&G-Notice of Statewide General Permit #2 Application to NJ
DEP to disturb wetlands within roadway Right-of Way throughout
entire PSE&G service territory. Comments accepted.

Upon MMS&C, by Councilmembers Rios and Santoro and unanimous
affirmative vote of the full membership present, all reports were
ordered to be received and placed on file.
BUILDINGS & GROUNDS: Committee Chairperson Sosnowski
spoke about the generator test they were doing in the Library. He said
they were painting Borough Hall and cleaning it up. He said Buildings
and Grounds would meet to discuss the Library.
FINANCE & ADMINISTRATION: Committee Chairperson Reiman
said Carteret has received sixty thousand dollars for the West Carteret
Business District Improvement. He spoke about the Freeholders and
the feasible study for the Waterfront Park Project. He said he spoke to
a representative from Senator Torricelli's office and spoke about the
Senate Bill that Carteret was listed on for sewer improvements where
there would be potential grant money. He said he spoke to
Councilmember Par/si about a proposed agreement with the County
for a Recycling program where Community Service workers could
separate aluminum at no cost to the Borough in our Recycling Center.
He spoke about the cost of recycling and what money we have brought
into the budget from Recycling. He said the County would run the
program and this would not affect any of our workers or our operations

but would generate revenue from the aluminum as opposed to paying STkl~II~
to get rid of it. He spoke about the poster contest the Historical
Committee would be holding for Borough fourth graders that would be
held in May. He spoke about the Budget Meeting that would be
rescheduled and said they found roughly a hundred thousand dollars in
extra revenue. He spoke about the cuts they found and how this would
lower the tax increase.
FIRE: Committee Chairperson Sohayda spoke about Mr. Stone being
in the Rahway Hospital television commemial. He thanked Tulnoy
Lumber for donating wood for the Fire House work. He said some of
the firefighters participated in the "Read Across America Program"
where they read to the children. He spoke about the different courses
they attended and the extrication drill they conducted on Saturday. He
thanked B&L for donating the cars. He said the firefighters
participated in the Carteret High School "Career Day" and held their
annual "fit" testing. He spoke about the recent fires that had occurred
in the Borough. He reported progress.
PARKS & RECREATION: Committee Chairperson Rios said they are
working on the baseball fields to get them ready for "Opening Day"
-- and are continuing the work on Shore Crest Park. He said there would
be an Easter Egg Hunt at the Community Center sponsored by the
Recreation Commission on March 24th. He said there would be a PBA
sponsored Easter Egg Hunt at Carteret Park on March 23rd. He said
the Parks Committee, the Parks Superintendent are setting up a
meeting with Carroll Thomas from the MCEOC, he would like to
donate twenty thousand dollars for equipment for Chrome Park. He
spoke about the World Trade Center Committee Scholarship Fund and
read a letter that is being sent out concerning the dinner dance, which
would be held on April 27, 2002. He gave the details and spoke about
the essay contest, which would determine winners of the scholarship.
He said there would be between one and five scholarships given out
and hoped it would continue through out the years. He reported
continued progress.
POLICE: Committee Chairperson Santoro said two of the Police
Officers, R.J. Novak and Tommy Curran attended "Career Day" at
Carteret High School. She said Detectives Novak and Rivers attended
__ a narcotics course and gave details on other courses attended by
Borough officers. She said Captain Hojecki attended a grant proposal
class and two Police Officers attended a DWI course. She said
Detective Tardiff has applied for and she felt confident they would be
receiving a computer from the "National Center for the Missing and
Exploited Children" and gave details concerning the use of the
computer. She reported progress.

PUBLIC WORKS: Committee Chairperson Par/si said Sally Mesler,
Recycling Coordinator has put together a Recycling schedule for the
year and would be mailing it out to all eight sections of town. He said
every month the Engineer gives the Council a report on their progress
and spoke about some of the projects and their progress. He spoke
about the Road Improvement Program and the Harrison and Roosevelt
Avenue Pump Stations. He spoke about the Sewer Treatment Plant
and the progress with the demolition of the buildings.
BOARD OF EDUCATION: Committee Chairperson said he attended
the dedication of Nathan Hale School, which was dedicated to Joseph
Comba who was the principal of the school for many years. He said
the Library was dedicated to Fred Grigni. He said there would a
Budget Hearing for the Board of Education on March 26th. He said the
Council would make a motion to change the Agenda Meeting, which
would be the same night.
Councilmember Reiman asked if Councilmember Parisi would include
something in the Board of Education mailings concerning the World
Trade Center Scholarship Fund.
~YOR FA'm'I~Ci~ Mayor Failace said he received several calls from a lawyer
representing the Turnpike to set up a meeting with two
Councilmembers, the Borough Engineer and himself as well as the
Planning Board Chairman and Plarming Board Engineer and the
Construction Official sometime in April. He spoke about the
newspaper article concerning the car storage in Port Reading proposed
by OENJ Cherokee. He said there is a meeting in Port Reading at
School #9, April 10th at 6 P.M. He urged the Council and the citizens
to attend the meeting and spoke about the affect this would have on
Carteret. He spoke about the Board of Education budget and said by
his calculations it would be a $400.00 tax increase on a home valued at
$118,000.00. He said if that budget and the Municipal budget stood at
the figures they were now, the residents would be looking at a $700 to
$800 tax increase and hoped the Cotmcil would review the budget. He
said he worked with MCEOC for years and felt any partnership
Carteret would get into with them would be a benefit and a home run
for Carteret as well as for the MCEOC. He thanked John Riggio for
his work on the grant and congratulated Councilmember Reiman on
his party's nomination for Mayor and hoped he was there in November
to fight a good battle.
Councilmember Rios requested the Agenda Meeting be held on the 1st
or the 3rd. Mayor Failace polled the Council and they all agreed on
April 1st, he directed Borough Clerk Kathleen Barney to call and make
sure there was nothing going on at the Library on April 1st since there
is court held on Monday nights.

Upon MMS&C, by Councilmembers Rios and Sohayda and PtlI~IC DIS(iUSSII~
unanimous affirmative vote of the full membership present, the
meeting was opened to the public for discussion.
Olga Pettica, 1340 Roosevelt Avenue said neither the Mayor or any
one from the Council called her about the problem on Roosevelt
Avenue with the dirt and when she called the County they were at her
house within an hour and a half.
Councilmember Rios said he spoke to Mr. Neibert on her behalf and
Mr. Neibert said he would pursue it and it was corrected within a few
days.
Olga Pettica said she called the County and she was the person that
took care of the situation, not Mr. Neibert. She said the County took
care of the dirt and removed it. She said she has spoken to the Council
concerning her husband and his needs as a handicapped person. She
said she called the County Office of Handicapped about the curb cuts
and spoke about how there are only two streets her husband is able to
get around. She said there are only two painted walkways in the areas
and children can not cross, but has come to the Council and no one
helps. She said Carteret has a good Volunteer First Aid Squad and
spoke about them and felt the Council was wrong for paying someone
else to do the job.
Carroll Thomas, MCEOC thanked the Mayor and Council for the
opportunity to talk at the Agenda Meeting concerning the Playground
and the Playground equipment. He said he was authorized to put
additional money toward fixing the Little League Field so that it could
be played on. He said they had spoke of $20,000.00 but felt with the
safety issues it would be more like $25,000.00. He thanked the Mayor
and Council and spoke about some of the things that would happen.
He told the residents that this was a real good Council and they
envision a lot of good things for Carteret.
Tom Lang asked Councilmember Par/si to check the fencing and the
guardrails on the West Carteret Bridge. He asked Councilmember
Sosnowski to check the lights under the flag at the Library.
Councilmember Sosnowski said they are looking at re-doing the
lighting or putting new surface mounted lights. He explained why
they were broken and the solution.
Tom Lang spoke about the installation of the lights and what was
required by code.
Borough Attorney Bergen said they did negotiate with the contractor
and the Borough received a $1,900.00 credit.
Tom Lang asked about the electric gate at the Municipal Garage.
Borough Attorney Bergen said he was looking into that and spoke to
the Engineer. He said he understood it is working the way it is

~dm.lC DISCIISSIGgl designed but they want it to work differently and did not feel it was the
contractor's fault. He gave some of the details concerning the gate.
Tom Lang asked Councilmember Rios if the crossing guards are using
their phones.
Councilmember Rios said there was a problem with Sprint and they
haven't received the phones. He said they are still pursuing it and he
was assured they would correct it. He asked if the moderate to low
income from North Brunswick was a favorable thing for Carteret.
Mayor Failace said they have been using the money for scattered site
rehabilitation so Carteret residents could get up to $20,000 to rehab
their homes. He explained that this would not bring more people into
the town, it raises the values on the homes that are already here.
Councilmember Reiman said he believed some money should be for
owner occupied and some for new construction. He spoke about the
loan verses the grant concerning this money.
Councilmember Santoro said she felt some money should be used to
rehabilitate Lower Roosevelt Avenue and felt the area was very
important.
Tom Lang said he felt this should be considered by the Redevelopment
Agency.
Councilmember Santoro said they could use UEZ money as well.
Borough Attorney Bergen said the agreement with North Brunswick
could be used for scattered site rehab and new construction.
Pat Tozzi, Board of Health, spoke about an incident at the Health
Clinic. He said there were two handicapped people in wheelchairs and
there still is no ramp. He hoped it was completed by April 8th.
Ernie Evon, Assistant Captain Carteret First Aid Squad, asked about
the agreement of the purchase of the First Aid.
Borough Attorney Bergen said the Resolution authorizes the attorneys
to cooperate with the Board of Health appropriating the funds from the
Soldiers and Sailors Fund.
Ernie Evon said he felt the Council should tell the people. He said the
Council does not want to work with the First Aid Squad and failed to
come to an agreement with them.
Mayor Failace said he could not sit in on the meetings since there was
three Councilmembers present already.
Ernie Evon said they asked that the Mayor and the whole Council be
present and felt they were not reporting back to the Council with the
information.
Councilmember Rios said he and Councilmembers Santoro and
Reiman reported back to the Mayor and Councilmembers on every
meeting they had with the First Aid Squad.

Mayor Failace said the Councilmembers reported back to the Mayor ~IRI.T~ DI~CUSSICI~
and Council at the Agenda Meeting in Closed Session.
Emie Evon said he felt the First Aid Squad should be made part of the
Borough and asked why they can't be treated like the Volunteer Fire
Department.
Councilmember Rios said the Council wanted to make the First Aid
Squad part of the Fire Department and they tried to negotiate and have
an ambulance leased for a dollar a year and the Borough would pay for
the supplies and maintenance, insurance and gasoline. He said the
First Aid Squad said that was out of the question and locked out the
police and fireman from the First Aid Headquarters.
Emie Evon said they changed the locks and agreed they would
continue to roll the ambulance as long as there is a member of the First
Aid Squad on the fig and explained the details of that understanding
and the problems they have encountered with the agreement.
Councilmember Santoro asked if in an emergency situation the police
and fire were not available would a resident have to wait for First
Aider to gain access to an ambulance.
Emie Evon said the First Aid is in communication with Police
Headquarters. He said they would also have Mutual Aid as usual.
Councilmember Rios asked about the police and fire being in the
-- ambulance when they have other people who are from out of the town
to be in the building for several hours with no problem.
He spoke in detail about Rural Metro and how they provide a service
to the town for free. He spoke in detail about the EMT in the town and
the requirements they have to abide by.
Councilmember Santoro asked what the First Aid wanted from the
Borough to come back and provide a service to the Borough from 6:00
A.M. to 6:00 P.M. which they are paying an outside service for.
Councilmember Rios said the Council made the First Aid an offer that
they rejected.
Emie Evon said once an EMT gets paid by the Borough they can not
be a Volunteer any longer and he felt that would ruin the Volunteer
Squad.
Councilmembers Sohayda and Rios asked Mr. Evon about controlling
and owning or leasing the ambulances.
__ Emie Evon spoke in detail about how the Borough would own the
ambulances and take care of them.
Councilmember Santoro spoke about the letter that detailed what the
Borough would pay for that the First Aid Squad was now paying for.
Erni¢ Evon asked what was in it for the Volunteers and spoke about
details concerning the Volunteers and how they work things out.

15th concerning the use of the ambulance. Councilmember Rios spoke
about the Office of Emergency Management and how they were
volunteers also and came under the Police Department and how their
department works.
Mayor Failace said the First Aid turned down a proposal from the
Council on February 1 Ith and asked Mr. Evon for a counter proposal.
Ernie Evon said they put it in the original letter.
Mayor Failace said there should be discussions since this was
negotiation and they should compromise.
Ernie Evon spoke about how the Council could deal with Borough
employees.
Councilmember Rios spoke about what would happen if there were
problems with employees of the Borough as opposed to Rural Metro
or another outside services.
Ernie Evon spoke in detail about the way they were allowed to act and
the consequences.
Councilmember Rios spoke about complaints the Council has received
concerning Rural Metro and some problems concerning the First Aid
Squad contract and conditions of the contract.
Ernie Evon and Councilmember Rios went on to speak in detail
concerning some of the problems with the First Aid's proposal and
negotiations.
Borough Attorney Bergen said he would be glad to sit down and listen
to the First Aid's proposals. He asked Mr. Evon to submit a proposal
of what the First Aid needs and the Council could consider it.
Mayor Failace said Mr. Evon needs to do a counter proposal.
Ernie Evon spoke about the Borough insuring the First Aid Squad and
spoke about how they get their funds. He spoke about who responded
and how the Police could handle the emergency situation until the First
Aid got to the scene.
Councilmember Santoro spoke about the Fire Department responding
to a call and leaving the Fire House unattended. She asked if the First
Aid Squad wanted to be under the Police Department and not the Fire
Department.
Emie Evon said yes, they were dispatched by the Police Department
anyway.
Brian O'Connor, Fire Chief spoke about the Fire Department going on
calls and leaving the Fire Department unattended incase of a fire.
Mayor Failace said he would sit with two Councilmembers and meet
with the First Aid Squad.
