CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to order by the Mayor at 7:00 p.m. Present were Councilmembers Michael W. Davey, Enrique Garcia, Steve Liedman, Patricia Weinman, Vice Mayor Jorge E. Mendia and Mayor Robert L. Vernon. Councilmember Thomas Thornton was absent. Also present were Village Manager Genaro "Chip" Iglesias, Village Clerk Conchita H. Alvarez and Village Attorney Stephen J. Helfinan. 2. PLEDGE OF ALLEGIANCE: Mayor Vernon led the Pledge of Allegiance. 3. AGENDA: Councilmember Davey requested to hear Item 7A2 prior to 7A1 at and the Clerk requested the addition of an announcement regarding early voting hours as Item 7C2. There was no objection to the agenda changes. 4. APPROVAL OF MINUTES: Councilmember Davey made a motion to approve the minutes of the October 14, 2008 Regular Council Meeting. The motion was seconded by Councilmember Weinman and approved by a 6-0 voice vote. The vote was as follows: Councilmembers Davey, Garcia, Liedman, Weinman, Vice Mayor Mendia and Mayor Vernon voting Yes. 5. ORDINANCES: The Clerk read the following ordinance on first reading, by title: 1 of October 27, 2008 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AMENDING CHAPTER 2 "ADMINISTRATION" OF THE VILLAGE CODE BY CREATING A NEW ARTICLE XVI "CHARTER HIGH SCHOOL ADVISORY BOARD"; ESTABLISHING A NEW BOARD AND PROVIDING REQUIREMENTS FOR MEMBERSHIP AND JURISDICTION OF THE BOARD; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN CODE; PROVIDING FOR AN EFFECTIVE DATE. Councilmember Davey made a motion to adopt the ordinance on first reading. The motion was seconded by Councilmember Garcia. The Mayor opened the public hearing. Angel Martin, 151 Crandon Boulevard addressed the Council. The Mayor closed the public hearing. The ordinance was adopted on first reading by a 6-0 roll call vote. The vote was as follows: Councilmembers Davey, Garcia, Liedman, Weinman, Vice Mayor Mendia and Mayor Vernon voting Yes. The Clerk announced the second reading of this ordinance will be on November 18, 2008. At this time Item 7A2 was heard. Mayor Vernon and Councilmembers addressed the public regarding the upcoming Charter Amendment regarding Land Development Regulations urging voters to vote Yes. Wilfredo Borroto, 241 Harbor Drive; Carlos de la Cruz, 5 Harbor Point; Max Puyanic, 480 S. Mashta Drive; Frank Caplan, Chairman of the ZORC Committee, 370 Palmwood and former Councilmember Raul Llorente, 345 Cypress Drive addressed the Council. Councilmember Davey excused himself from the meeting at 7:45 p.m. Senator Gwen Margolis addressed the Council presenting a check in the amount of $33,902.71 from the Florida Department of Environmental Protection for Village Green improvements. Councilmember Liedman received the check on behalf of the Council and the residents of the Village of Key Biscayne. 6. RESOLUTIONS: The Clerk read the following resolution by title: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; APPROVING AGREEMENT BETWEEN THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION AND THE VILLAGE OF KEY BISCAYNE FOR A GRANT TO DEVELOP THE VILLAGE GREEN IMPROVEMENTS; PROVIDING FOR AN EFFECTIVE DATE. 2 of 4 October 27, 2008 Councilmember Garcia made a motion to approve the resolution. The motion was seconded by Councilmember Weinman. The Manager addressed the Council recommending approval of this resolution to execute a grant agreement with the Florida Department of Environmental Protection for Village Green improvements. The resolution was approved by a 5-0 voice vote. The vote was as follows: Councilmembers Garcia, Liedman, Weinman, Vice Mayor Mendia and Mayor Vernon voting Yes. 7. REPORTS AND RECOMMENDATIONS: The following items were discussed: Mayor and Councilmembers. Councilmember Weinman addressed the Council regarding the water quality and beach closings. Public Works Director Armando Nunez addressed the Council stating that the Health Department is responsible for the water quality and beach closings. Councilmember Weinman addressed the Council regarding the proposed public safety initiative. Chief of Police Charles Press addressed the Council regarding this initiative. Kathye Susnjer, Chamber of Commerce Director addressed the Council. Councilmember Weinman also addressed the Council regarding the Key Biscayne Youth Orchestra Program and the opportunity to sponsor less fortunate communities. Councilmember Weinman addressed the Council regarding the Community Center pattern of use and expansion. Councilmember Weinman also addressed the Council regarding the availability of a Key Biscayne Educational Channel. Village Attorney. The Attorney did not submit a report. Village Clerk. The Clerk presented to the Council a proposed 2009 Council Meeting schedule. It was the consensus of Council to bring back the proposed schedule to the November 18, 2008 Council Meeting. The Clerk announced that Early Voting hours have been extended from 7:00 a.m. to 7:00 p.m. 3 of October 27, 2008 Village Manager. The Manager addressed the Council proposing Tuesday, December 2, 2008 to hold the 5 -Year Capital Improvement Plan Workshop. There was no objection to the request. The Manager also proposed Tuesday, January 20, 2009 to hold a Landscape Committee Workshop. There was no objection to the request. 8. OTHER BUSINESS/GENERAL DISCUSSION: At this time the Mayor and Council thanked Councilmembers Liedman and Weinman for the years of service to the community. 9. SCHEDULE OF FUTURE MEETINGS/EVENTS: A schedule of future meetings and events was presented to the Council. 10. ADJOURNMENT: The meeting was adjourned at 8:45 p.m. Resp lly submitted Conchita H.
