Failace approximately 7:30 P.M. on Thursday, April 4, 2002, Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: ROLL CALL Councilmember Frank Parisi " Daniel Reiman Ronald Rios Brian Sosnowski Also noted present was Borough Attorney Robert J. Bergen, Esq. Noted absent were Councilmember Janet Santoro and Buddy Sohayda. The meeting was opened with a moment of Silent Prayer and The PRAYER, PLEDGE Pledge of Allegiance led by Mayor James A. Failace. He asked OF ALLEGIANCE everyone to remember the men and women in the Armed Services overseas. The Clerk stated that on March 28, 2002, in full compliance with the STATEMENT OF Open Public Meetings Act, a notice of tonight's meeting was sent to MEETING NOTICE The Home News Tribune, The Star-Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Rios and Reiman and unanimous APPROYAL OF affirmative vote of the four Councilmembers present, the minutes of MINUTES March 21, 2002 were approved as transcribed and engrossed by the Clerk. Mayor Failace spoke about the Central Jersey All-Star Cheerleaders COMMENTS and their coaches. He spoke about the tape he viewed of their performance and said he was very proud of the team and coaches. Councilmember Parisi spoke about the cheerleaders and their winning red jackets. He spoke about the cheerleaders, their routines and how they have come a long way. He congratulated them. Councilmember Rios spoke about the night they came home from the -- cheerleading competition. He congratulated them and thanked them for representing Carteret. Mayor Failace read the commendations for the coaches and COMMENDATIONS: cheerleaders of Central Jersey All-Stars and handed them out. CENTRAL JERSEY ALL-STARS APRIL 4, 2002 NOTED PRESENT At approximately 7:40 P.M., Councilmember Santoro was noted present. COMMENTS Councilmember Santoro apologized for being late and spoke about the -- cheerleaders and their accomplishments. Coach, Patty Ann Romero thanked everyone for recognizing the team and said they have great parental support. Upon MMS&C, by Councilmembers Rios and Santoro and unanimous RECESS affirmative vote of the five (5) Councilmembers present, the meeting was in recess at approximately 7:50 P.M. At approximately 7:55 P.M. the meeting was reconvened. Upon MEETING individual roll call, the following were noted present, Councilmember RECONYENED Parisi, Reiman, Rios, Santoro and Sosnowski. Noted absent was Councilmember Sohayda. Councilmember Reiman said Tony Fabr/zio, Dave Daumeno from COMMENTS Dauman Pallet were not present for the commendation and he did not see John Sudia. He explained that this was a Council Commendation and the Council was thanking Dauman Pallet for the disposal of Carteret's leaves. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C, by Councilmembers Rios and Reiman and unanimous PUBLIC HEARING affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open: Pat Tozzi asked the Council to explain. COMMENTS Councilmember Reiman said this would bring fences to a standard height of four feet. Pat Tozzi asked the Council to explain Resolution //02-125, the COMMENTS amendment to the temporary budget and what it included. Councilmember Reiman explained that the Council has not had the final adoption on the budget yet and this took five hundred thousand dollars into the medical insurance. Mayor Failace said the money is in the budget, there is no additional cost, and the Council has to do amendments to make sure the money goes where it needs to go. 5 APRIL 4, 2002 MEETING CLOSED There being no further comments or objections to the Resolutions, the Mayor declared the Public Heating to be closed, upon MMS&C, by Councilmembers Rios and Reiman and unanimous affirmative vote of the five (5) Councilmembers present. CONSENT AGENDA The Borough Clerk asked if any Councilmembers wanted any Resolutions to be taken off the Block Vote and asked for a motion. Borough Attorney Bergen said this raises as permitted by law the amount of money employers could put into a deferred compensation plan from eight thousand to twelve thousand dollars. CRYSTAL CARPENTER COMMUNICATIONS: The Clerk stated that she was in receipt of a Communication from NJ NJ TRANSIT- Transit- Public Hearing, May 1, 2002-Lavallette, NJ-Re: Proposed PUBIC HEARING Bay Head Rail Yard Improvements Project. Upon MMS&C, by Councilmembers Reiman and Rios and affirmative vote of the five (5) Councilmembers present, all Communications were ordered to be received and placed on file. PAYMENT OF BILLS Upon MMS&C, by Councilmembers Reiman and Rios all bills appearing on the prepared list properly audited and signed were ordered to be paid. REPORTS DEPARTMENT The Clerk stated that she was in receipt of the following report: 1. Clerk's Office-March 2002 10 APRIL 4, 2002 Upon MMS&C, by Councilmembers Rios and Parisi and unanimous affirmative vote of the five (5) Councilmembers present, all reports were ordered to be received and placed on file. BUILDINGS & GROUNDS: Committee Chairperson Sosnowski said STANDING COMMITTEES there was more painting done in Borough Hall and the conference room was almost done. He said patching had to be done due to vandalism at the Library and they are starting to paint the Community Center. He reported progress. FINANCE & ADMiNISTRATION: Committee Chairperson Reiman said the DEP recommends Carteret received an additional five hundred thousand dollars of Green Acres funding for the Waterfront Project Phase II. He said this could be approved as early as this month. He spoke about the Historical Committee's poster contest and said the Mayor would be one of the judges. He said the deadline is April 24th. He asked that the budget meeting was rescheduled with the Mayor and full Council and Department Heads. He said the Council has received approval from the DOT to use Discretionary Aid for local streets. He spoke about the funding of fixing the streets and where the money would be coming from and what they expected to accomplish. He reminded the Council and the public that there are some full time temporary clerical positions in the Court. He said the Council received proposals for Redevelopment in the Business District Project and spoke about the developers. He said they would be having a joint meeting with the Council in a month or so to discuss the details. He suggested that the Council give Joe Calogero a Commendation at the next meeting for his donation of The Roosevelt News Newspapers dated from May 1922 through March 1923 to the Carteret Historical Committee. FIRE: Councilmember Sosnowski in the absence of Committee Chairperson Sohayda said someone was caught in an elevator in the Cardinal China building and the Fire Department got them out. He spoke about the Ladies Fire Auxiliary fifty's dance and the Fire Department's Valor Awards that would be held on April 27th. He reported progress. PARKS & RECREATION: Committee Chairperson Rios said the Parks Committee had a meeting with Carroll Thomas from MCEOC who will be donating twenty thousand dollars towards Chrome Park. He said they would be receiving twenty-five trees, which will be planted in Shore Crest Park. He said there was a fire at Shore Crest 11 IPRIL 4, 2002 STANDING COMMITTEES Park and the new playground equipment was damaged. He spoke about the incident and his plans to replace that section of the equipment. He apologized to the residents of the area and spoke about what has been done in the park. He thanked the Sewer Department for cleaning the lake. He said Little League Opening day would be Saturday April 13th and the parade will start at noon in Carteret Park. He said this year on July 27th there would be the 1st Annual Carteret Sports Festival. He said there will be a bike race and "mn" and the proceeds will go to the young sports group and the Carteret Specials who are organizing this event, Ken Eardly is the coordinator. He spoke about the details and who would be present. He spoke about the World Trade Center Dance, which will be held on April 27th and said they are on target. He reported continued progress. POLICE: Committee Chairperson Santoro said starting April 1st the Carteret Police Department has instituted a Walking Beat on Lower Roosevelt Avenue. She spoke about the details and where the grant money came from for this project. She said there would be a Firearms Surrender Program in Carteret May 3rd, 4th and 5th and spoke about what would happen during the program. She said Det. Novak was assigned to Terrorist Task Force and spoke about various officers and the classes they have recently attended. She said next week there would be a UEZ meeting concerning the Washington Avenue Streetscape and West Carteret. She said there would be a meeting with the Turnpike Authority on April I 1th. She spoke about the temporary clerical work that is available in the Court and urged that anyone interested fill out an application at the Clerk's Office. She reported progress. PUBLIC WORKS: Committee Chairperson Parisi said Recycling schedules have gone out for several areas. He said the Harrison Avenue and Roosevelt Avenue Pump Stations should begin construction on April 8th. He said the demolition of the back building at the Sewer Treatment Plant has been completed and the main building should begin soon. BOARD OF EDUCATION: Committee Chairperson Parisi said the School Budget was introduced on Tuesday and would be voted on at the School Board Election on Tuesday April 16th from 2:00 to 9:00 P.M. He urged everyone to vote. He said Disability Awareness Day is Sunday April 7 at St. Demetrius Hall and urged everyone to attend. He spoke about the Ladies Fire Auxiliary dance at the Fire House. 12 APRIL 4s 2002 MayorFailaceread~e ~llowingproclamaion: PROCLAMATION: AUTISM AWARENESS AUTISM AWARENESS MONTH 2002 WHEREAS, autism is a pervasive developmental disorder affecting the social, learning and behavioral skills of those affected by it; and WHEREAS, autism was once thought to be a relatively rare disorder, affecting only one in 10,000 people; and WHEREAS, as more and more health professional become proficient in diagnosing autism, more children are being diagnosed on the autism spectrum, resulting in rates as low as one in 500 children; and WHEREAS, while there is no cure for autism, it is well-documented that if an individual with autism receives treatment early in their lives, it is often possible for that individual to make significant improvement; and WHEREAS, the New Jersey Center for Outreach Services for the Autism Community (COSAC) is spearheading an awareness effort in order to educate parents, professionals and the general public about autism and its effects; and NOW, THEREFORE, BE IT RESOLVED that I, MAYOR JAMES A. Failace do hereby proclaim April, 2002 as AUTISM AWARENESS MONTH in the BOROUGH OF CARTERET, and urge all employees and residents to participate in our Municipality's Autism Awareness Month activities in order to become better educated on the subject of autistic spectrum disorders. Mayor Failace read the following proclamation: PROCLAMATION: CARTERET DISABILITIES AWARENESS DAY- CARTERET DISABILITIES AWARENESS DAY APRIL 7, 2002 "CARING AND SHARING" WHEREAS, the Carteret Office of the Disabled will hold its Eighteenth Annual "Carteret Disabilities Awareness Day" on Sunday, April 7, 2002 at the St. Demetrius Hall, Roosevelt Avenue, Carteret, N.J. from 12:00 Noon to 4:00 P.M.; and WHEREAS, Carteret Disabilities Awareness Day is held as an informational and social gathering to be enjoyed by all who chose to attend; and 13 APRIL 4, 2002 PROCLAMATION WHEREAS, this event is only made possible through the combined (CON 'T) efforts of many volunteers from non-profit organizations and Borough Departments and businesses within our Community; and WHEREAS, the Office for the Disabled continues to expand opportunities for Disabled Persons to achieve their goals, developing and using their capabilities. PROCLAMATION: MayorFailacereadthe ~llowingproclamation: -- WORKER'S MEMORIAL DAY RECOGNIZiNG APRIL 28, 2002 AS WORKERS' MEMORIAL DAY iN MEMORY OF WORKERS WHO HAVE DiED OR HAVE BEEN iNJURED ON THEIR JOBS WHEREAS, thirty (30) years ago, the United States Congress passed the Occupational Safety and Health Act, promising every American worker the right to a safe job; and WHEREAS, labor unions and their allies have fought hard to make that promise a reality, by winning workplace protections that have saved hundreds of thousands of lives and prevented millions of workplace injuries; and WHEREAS, despite decades of struggle by workers and their unions having resulted in significant improvements in working conditions, the toll of workplace injuries, illnesses and death remains enormous; and WHEREAS, each year more than sixty thousand (60,000) workers die from job injuries and illnesses and another six million (6,000,000) are injured; and WHEREAS, the unions of the AFL-CIO have honored these workers on April 28th, each year since 1989, observing said date as Workers' Memorial Day; said date being the anniversary of the passage of the Occupational Safety and Health Act and the day of a similar remembrance in Canada; and 14 APRIL 4, 2002 WHEREAS, every year hundreds of communities and work sites PROCLAMATION recognize workers who have been killed or injured on the job and trade (CON ' T) unionists around the globe now mark April 28 as an International Day of Mourning; and WHEREAS, on April 28, 2002 the unions of the AFL-CIO will observe Workers' Memorial Day to remember those who have suffered and died on the job and to renew the fight for safe workplaces. Ceremony to be held 12:00 noon at Borough Hall. WHEREAS, this year has special significance as we mourn those killed in the September 11th terrorist attacks, which claimed the lives of more than 3000 people-most of whom were workers at their jobs when the attacks occurred or rescue workers who worked to save lives. NOW, THEREFORE, I, JAMES A. FAILACE, Mayor of the Borough of Carteret along with the Borough Council, do hereby proclaim April 28, 2002, Workers' Memorial Day in the Borough, and hereby encourage all Americans to remember the thousands of workers who are injured and die each year from workplace hazards, to support efforts to implement and maintain strong laws and protections to prevent job injuries and illnesses, and to defend the promise of safe jobs for all workers. FAILACE, MAYOR OF THE BOROUGH OF CARTERET do hereby proclaim WEDNESDAY, MAY 1, 2002 CARTERET HISTORY DAY FURTHERMORE, I urge the entire Community to participate in said program making it a great success. 15 APRIL 4~ 2002 COMMENTS Mayor Failace said he received a phone call from a French teacher in South Jersey who had a visiting dignitary from Carteret France. He said he tried to have him come to the meeting tonight but he would be in the Mayor's office tomorrow at 3:30 P.M. beating gifts. He said he looked forward to the visit and would give him some of the Carteret Commemorative Plates. He said Linda Morgan from OENJ Cherokee came to the Agenda Meeting to discuss the Auto Port in Port Reading. He said he and the Council made them aware Carteret will not accept twelve hundred trucks per day. He said he hoped Carteret and Woodbridge could work together. He said there is a DEP hearing at the Port Reading School No. 9. He spoke about the Board of Education Meeting last week where the budget was presented. He spoke about the tax increase, which would be $400.00, not $248.00. He spoke about the Board of Education asking for an acceleration of payment from the Borough. He explained that the Borough has to pay the Board of Education twice a year. He said the Board of Education was expecting a one point four million dollar payment from the State and they blamed this on the former Business Administrator not getting the paperwork to the State on time. He explained what had happened and said he would check into the situation himself and do what is best for the children. He said Carroll Thomas from MCEOC would be giving the town money to refurbish the building and for park equipment. He spoke about plans for the money. He spoke about the letter from the Little League and their decision not to schedule any games in Chrome Park. He said everyone should stand together to get the games played there and felt the town needed more police officers present to make it happen. Councilmember Rios said Carteret welcomes the five thousand dollars for Chrome Park but the Little League had their schedules made already and did not include Chrome Park. He said they would try to schedule festivities there to encourage people to get games played at Chrome Park once again. He spoke about some of the good times he attended at Chrome Park and encouraged everyone to play at the field. Mayor Failace said they could make the leagues to play down there as before or other fields would not be used. Upon MMS&C, by Councilmembers Reiman and Sosnowski PUBLIC DISCUSSION and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was opened to the public for discussion. COMMENTS Pat Tozzi spoke about the school budget and the tax increase. He recommended the Board of Education Committee not participate in the budget and felt that since all were either 16 APRIL 4~ 2002 employees or past officers of the Board of Education it was a PUBLIC DISCUSSIOI~I conflict of interest. Mayor Failace said he felt that it was not a conflict and did not feel they should remove themselves from voting. He spoke about the increase in spending and State Aid. James Mancuso, Jackson Avenue said he felt it was discriminating not to play ball at Chrome Park. He said he disagreed that anyone should say there would not be any games played there. He spoke about being at Chrome Park when his grandson played. He asked Councilmember Rios to look at the Skate Park since he felt it was a disgrace. He said there are holes in the fence and parties are being held there at night. He wanted to have this taken care of before someone got hurt. Stanley Gutowski asked what the bidding threshold of 2002 was. Borough Attorney Bergen said 17.5 thousand dollars and if the Purchasing Agent is certified it will be 25 thousand dollars. Stanley Gutowski asked why the Council is giving a commendation to a garbage company that was paid three hundred and sixty thousand dollars in the passed ten months for a contract that has not been legally bid. Borough Attorney Bergen said the company filled in when the previous contract expired. He said the contract was out to bid now and the company is free to bid on it. Stanley Gutowski asked if the Borough could pay someone in excess of the billing threshold. Borough Attorney Bergen said the town has an obligation to collect the garbage and this would be an emergency situation. He explained why the bid was late and how he prepared the bid. Stanley Gutowski spoke about the garbage companies and the expiration of their contract. He said he felt the Council was giving a commendation to a garbage company that he felt was paid more than the Borough should have paid them. Councilmember Reiman said Dauman agreed to pick up leaves before and spoke about the details. Stanley Gutowski said Manella picked up leaves and wood for nothing before and when they lost the bid they decided to charge the Borough again. Borough Attorney Bergen explained about the bid specs and the cost of the Borough's garbage removal. Councilmember Reiman asked if the Borough could go back and sue Manella. 17 APRIL 4~ 2002 PUBLIC DISCUSSION Borough Attorney Bergen said yes and explained the details. Stanley Gutowski continued to ask Borough Attorney Bergen for details concerning the bid and Borough Attorney Bergen explained. Borough Attorney Bergen explained the curbside pick up and dumpster pick up at the apartment complexes and the costs and details concerning them. Stanley Gutowski spoke about the Housing Authority collection. Borough Attorney Bergen said this would be broken down in the bid and explained. Susan Naples, Louis Street said she never saw a problem with Chrome Park when her daughter played there. She said she felt since the schedules were already made they should play make- up games there. Mayor Failace agreed. Rose Mihalek Costanza and her husband said they own property by Shore Crest Park. She said the bleachers are ten foot from their property and felt the fence was too low and children climb over the fence and spoke about an incident that occurred. She explained what she found on their property. She said the trees have been cut. She said the trees used to break the impact of the ball coming toward the houses. Her husband said no one spoke to them, they just came in and cut the tree on their property. Councilmember Rios said he spoke to them and went to see the tree. He apologized and advised Mr. Kately never to cut a tree again with out asking the homeowner. Mrs. Costanza spoke about fighting amongst the coaches, plastic netting the Parks Department put up and having to pay for the tree to be removed she did not want removed. Councilmember Rios said the fence will be increased from six feet to eight feet on the Sumutka side and the netting will be extended twenty-five feet further and eight feet out instead of four feet out. He said he hoped that would decrease the balls from going onto the properties. Mayor Failace asked Councilmember Rios if the Parks Department could move the bleachers. Councilmember Rios said the cement was poured but the bleachers were not up yet they are still being put together. He said they would discuss this with Mr. Kately and talk to the Council at the Agenda Meeting. Mr. and Mrs. Costanza said they would be patient but wanted this to be corrected before something happened. 18 ~PRIL ~ 2002 Jim Stone asked if the microphones were ever going to be PUBLIC DISCUSSION fixed. Borough Clerk Kathleen Barney said the microphones were working. Ernie Evon, First Aid Assistant Captain, gave a letter to the Mayor and Council requesting to schedule a meeting with the First Aid Squad and the Mayor and Council. There being no further business or discussion, upon MMS&C, ADJOURNED by Councilmembers Reiman and Rios and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was adjourned at approximately 8:55 P.M.
