Mayor Beckley called the regular meeting of the City Council to 2. order at 7:30 P. M. Invocation was given by Rev. R. E. Schulz of the First Lutheran Church, 9123 Broadway, Temple city, following 3. which Mayor Beckley led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Briggs, Harker, Merritt, Tyrell, Beckley ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Public Works Director Pizzorno 5. APPROVAL OF MINUTES: Regular meeting of January 2, 1968. Councilman Merritt amended the minutes on page 6 the first para- graph to add that the report made by the Traffic Engineer per- tained to another intersection, and he will check on the signals at the intersection of Baldwin and Olive and report back. Coun- cilman Harker moved to approve the minutes as amended, Councilman Merritt seconded, and the motion carried unanimously. UNFINISHED BUSINESS: 6. ORDINANCE NO. 68 -257: 2nd read. Repealing Ordinances No. 65 -151 and 65 -153 which are superseded by the new zoning ordinance. City Attorney Martin presented Ordinance No. 68 -257 for second reading AN ORDINANCE OF THE CITY OF TEMPLE CITY REPEALING ORDI- NANCES 65 -151 AND 65 -153. Councilman Merritt moved to waive further reading and adopt Ordi- nance No. 68 -257, Councilman Briggs seconded, and the motion was unanimously carried. 7. ORDINANCE NO. 68 -258: 1st read. Re Time extension for zone variances and conditional use permits once for a period of time not to exceed one year. City Attorney Martin presented the above ordinance for first reading as amended by the Planning Commission AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9231 OF THE TEMPLE CITY MUNICIPAL CODE. Councilman Briggs moved to waive further reading of Ordinance No. 68 -258, Councilman Harker seconded. Considerable discussion followed. The City Attorney explained if a variance is granted it is given for one year and this ordinance would allow only one extension and for only a period not to exceed one year. Councilman Tyrell felt that if the variance was not exer- cised within the one year period they should not be granted an extension and should be required to come in for a new permit, and that two years as allowed by this ordinance was too long a time, and he felt any right of extension should be granted by the Council. Mayor Beckley was in favor of the ordinance and to give the authority to the Planning Commission for only one extension which would rarely be granted for one year. Councilman Harker felt the Council should not restrict the activities of the Planning Commission on applications for extension as the Council is aware of their activities through their agendas and minutes and can - inform them of anything the Council is aware of that might be useful to them. Councilman Merritt agreed with Councilman Harker. As this was the first reading of Ordinance No. 68 -258 no further action was taken. 8. ORDINANCE NO. 68 -260: 2nd read. Re Existing uses on Properties in R -1 and R -2 zones which shall be deemed to be conforming if they were conforming and existing at the effective date of the new zoning ordinance (August 18, 1967). City Attorney Martin presented Ordinance No. 68 -260 for second reading AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING CERTAIN OF THE ZONING REGULATIONS RELATING TO ZONES R -1 AND R -2. Councilman Merritt moved to waive further reading and to adopt Ordinance No, 68 -260, Councilman Harker seconded, and the motion carried unanimously. Robert Bock, 5328 -5330 Encinita, advised his property which is R -1 had a dwelling and one car garage constructed in 1941 with required building permits on the second half of the lot. In 1953 an additional residential dwelling in the front and a two -car detached garage was constructed with required building permits. The property contained 14,000 sq.-Ft. and at that time one addi- tional dwelling was permitted on an R -1 lot for each 5,000 sq. ft. of area. He felt he should be covered under Ordinance No. 68- 260 and not be required to apply for a variance to build an addi- tional utility building on his property. It was explained to Mr. Bock that under our present zoning ordi- nance his property is classified "legal nonconforming" as it con- tains two residential dwellings on an R -1 lot, therefore any enlargement or addition to existing structures would require a zone variance approval. Also it was recommended that Mr. Bock prepare something for presentation to the Planning Commission and to check it out with the Planning Director in detail. 9. ORDINANCE NO. 68 -261: 2nd read. Re Prohibiting back -in parking on Municipal Parking Lots. City Attorney Martin presented Ordinance No. 68 -261 for second reading AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SEC- TION 3335 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO PRO- HIBITING OF BACK -IN PARKING ON MUNICIPAL PARKING LOTS. Councilman Merritt felt this restriction would make a problem for trucks loading and unloading. Mayor Beckley suggested that some places on the streets be designated for loading and unload- ing. The City Manager stated extensive deliveries were made from the Mall and it would be a hindrance to have these made from the streets. He suggested that trucks could be excluded from the prohibition and certain areas could be designated in the Malls for this purpose. Manager Koski advised there has been some damage from trucks backing in. He suggested this be referred to the Parking Commission Councilman Harker stated the matter of loading and unloading was a matter of concern when hearings were held on the Malls. Mayor Beckley felt the ordinance not too restrictive. Council- man Harker felt the main purpose for the Malls was convenience to our people in Temple City and customers, and improvement of the business district and benefit to the merchants, and for these reasons he would hesitate to put on any restrictions, however he would go for the no.back -in parking with trucks excepted. Councilman Briggs wanted to know more about the total problem and whether it was trucks or automobiles. Coun -. Council Minutes, January 16, 1968, page 3 cilman Tyrell felt trucks making deliveries should be excepted. Paul Kettle, Chairman of the Parking Commission, stated any car backing in creates a problem. Trucks have to unload and he did not think trucks can be stopped from backing in. Signing was also considered by the Parking Commission. City Attorney Martin presented Ordinance No. 68 -261 with section 3335 amended to add as follows: "There shall be exempted from the restrictions of this section, all trucks in excess of three ton gross weight, loading or unloading." Councilman Merritt moved to waive further reading of the amended ordinance and to refer it back to the Parking Commission for recommendations on signing of the parking lots, Councilman Harker seconded, and the motion was unanimously carried. This was the first reading on the amended ordinance so no further action was taken. The matter will be referred to the Parking Commission for their action before the second reading of the Ordinance before the Council. 10. RESOLUTION NO. 68 -796: calling for a General Municipal Election on April 9, 1968. City Manager Koski presented Resolution No. 68 -796 A RESOLUTION OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 9th DAY OF APRIL, 1968, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES. Councilman Merritt moved to adopt Resolution No. 68 -796, Council- man Briggs seconded, and the motion carried unanimously. 11. RESOLUTION NO. 68 -795: Requesting the Board of Supervisors to permit the Registrar of Voters to render services to the City for the General Municipal Election on April 9, 1968. City Manager Koski presented Resolution No. 68 -795 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO PERMIT THE REGISTRAR OF VOTERS OF SAID COUNTY TO RENDER SPECIFIED SERVICES TO THE CITY OF TEMPLE CITY, RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 9, 1968. Councilman Merritt moved to adopt Resolution No. 68- 7951;; Coun- cilman Briggs seconded, and the motion carried unanimously. 12. TRAFFIC COMMISSION RECOMMENDATIONS: MEETING OF JAN. 3, 1968. A. Item 5. LOWER AZUSA RD. & TEMPLE CITY BLVD. Recommend parking stalls be placed on south side of Lower Azusa Rd. from Temple City Blvd. to alley easterly thereof. Traffic Engineer Envall presented the above recommendation. Councilman Merritt moved to approve recommendation A -Item 5, Councilman Tyrell seconded, and the motion was unanimously carried. B. Item 6. LAS TUNAS DR. Recommend that a two week test be run of traffic signals on Las Tunas Dr. between hours of 6 P. M. and 8:30 A. M. with signals at Sultana, Encinita, Alessandro, Cloverly, Primrose, Camellia and Kauffman flash- ing yellow on Las Tunas Dr. and flashing red on cross streets. Remaining signals on Las Tunas Dr. will remain at their normal signal cycle. Traffic Engineer Envall presented the above recommendation. Following considerable discussion Councilman Tyrell moved to approve recommendation B -Item 6, Councilman Briggs seconded, and the motion was unanimously carried. Council Minutes, January 16, 1968, page 4 13. PLANNING COMMISSION RECOMMENDATION: Meeting of Jan. 11, 1968. A. Zone Change: Recommend approval of proposed change of zone from R -1 to C -2 for 5409 through 5429 Baldwin Ave., west side, and 9933 through 9945 Olive St., north side. Planning Director Dragicevich presented the above recommenda- tion. Councilman Merritt moved to set this proposed zone change for public hearing on Febr. 6, 1968, at 7 :30 P. M., Councilman Tyrell seconded, and the motion carried unanimously. 14. CONTRACT RENEWAL: City of Temple City and Chamber of Commerce. City Manager Koski presented a letter from the Chamber of Commerce requesting renewal of the contract with the City as of Febr. 1, 1968. He recommended the contract be renewed until—the end of the City fiscal year, June 30, 1968, and that renewal from that date conform' with the City's fiscal budget. Councilman Tyrell moved to extend the contract to June 30, 1968 under the same terms, and to appropriate necessary funds for the next five months period of the contract, Councilman Briggs seconded, and the motion carried unanimously. 15. RESOLUTION NO. 68 -797: Warrants & Demands City Manager Koski presented Resolution No. 68 -797 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $29,559.41 DEMAND NOS. 10481 THROUGH 10522. Councilman Tyrell moved to adopt Resolution No. 68 -797, Councilman Harker seconded, and the motion was unanimously carried. 16, COMMUNICATIONS: A. Request from the Chamber of Commerce for sidewalk sale on Thursday, Febr. 22, 1968, from 9 A. M. to 5 P. M. City Manager Koski presented the above request and advised they ask restrictions on both sides of Las Tunas between Primrose and Camellia with barricades furnished by the City to aid in restricted parking. Al Goodman, Manager of the Chamber of Commerce, also request- ed permission from the Council to hang banners on the light poles to be put up the week of the sale and taken down on Friday. The Camellia Festival will be using the lines for the Camellia Festival for street banners. Councilman Merritt moved to approve subject to insurance re- quirements, Councilman Briggs seconded, and the motion carried unanimously. B. The City Manager presented a request from the Temple City Friends of the Library to conduct a book fair at the library . patio and equipment on Saturday, April 20, 1968 between the hours of 9 A. M. to 4 P. M. Councilman Merritt moved to approve, Councilman Tyrell second- ed, and the motion was unanimously carried. C. City Manager Koski presented a request from the Standard Oil Co. to conduct a seismic survey along the Southern Pacific Railroad right -of -way within the city limits from Febr.,1, 1968, to April 15, 1968. Following considerable discussion Councilman Tyrell moved to grant the request subject to the recommendations of the City Manager, Councilman Harker seconded Council Minutes, January 16, 1968, page 5 Roll call vote to carry the motion as follows: AYES: Councilmen- Harker, Tyrell, Beckley NOES:._._leunci lmen- Briggs, Merritt ABSENT: Councilmen -None D. The City Manager presented a letter from Jack Valiquette, 9138 Emperor Ave., requesting a second curb cut for driveway entrance on his property which formerly led to a garage which has been converted into a room on the house. Following re- view of the circumstances and facts Councilman Merritt moved to allow the curb cut, Councilman Tyrell seconded. Discussion followed and it was brought out that this driveway would serve as an illegal parking space on the westerly side of the property and would be within the front yard setback. It was also felt that the discontinuing of the use of the garage structure as a garage was in effect abandonment. Roll call vote held on the request as follows: NOES: Councilmen - Briggs, Harker, Tyrell, Beckley AYES: Councilman- Merritt ABSENT: Councilmen -None 17. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Wm. Alvarado, 9531 Olive St., stated that a condition imposed on a lot split required $300.00 for sidewalk installation which he made some ten months ago and nothing had been done. He requested either installation now or his money back. Following discussion the Council agreed to have this sidewalk put in on our annual contract for curb work and to use the funds deposited to cover the cost which was agreeable to Mr. Alvarado. 18. MATTERS FROM CITY OFFICIALS: City Manager Koski presented Resolution No. 68 -798 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINT- ING TEMPORARY PERSONNEL. He advised this was for temporary employees in the Recreation Dept. with budgeted funds. Councilman Tyrell moved to adopt Resolution No. 68 -798, Councilman Briggs seconded, and the motion carried unanimous - 1 y. The City Manager presented Resolution No. 68 -799 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINT- ING PERSONNEL which appoints David Recupero to the position of Assistant City Manager. Councilman Briggs moved to adopt Resolution No. 68 -799, Coun- cilman Tyrell seconded, and the motion was carried unani- mously. The City Manager recommended items concerning the cigarette tax and also the possible increase in the tax rate for room accommodations be held for the next study session. City Manager Koski recommended the reappointment of Leonard Adams, and Max Maudlin, as Commissioners on the Parks & Re- creation Commission for two years as of Jan. 5, 1968. Councilman Merritt so moved, Councilman Harker seconded, and the motion carried unanimously. The City Manager presented a request from the Public Works Director to attend the California Public Works Conference at Stockton, Jan. 31 to Febr. 3. Councilman Harker moved to approve, Councilman Briggs seconded, and the motion carried unanimously. Council Minutes, January 16, 1968, page 6 The City Manager presented a letter from the County Divi- sion of the League of California Cities proposing an in- crease in dues from $25. to $30. Councilman Tyrell moved approval of the increased rate, Councilman Harker seconded, and the motion carried unanimously. Re the transfer of city bonds to the county for collection the City Manager recommended this be referred to a study session. The Traffic Engineer reported on the inquiry made by Coun- cilman Merritt re the traffic signals at Baldwin Ave. & Olive St. He advised if the pedestrian pushes the button crossing Baldwin at Olive it gives 34 seconds to cross. Also there is a proposal to upgrade this particular inter- section. The City Manager advised this is in this year's budget and that plans and specifications will be brought to the Council for approval at a subsequent meeting. The City Manager presented a proposed Resolution submitted by Southern California Rapid Transit District affirming the route for the San Gabriel Valley Corridor Rapid Transit Line being located in the railroad right of way of the Baldwin Park Line of the Southern Pacific Company from Mission Road in Los Angeles easterly, including the median strip of the San Bernardino Freeway to the City of El Monte. Following discussion Councilman Tyrell moved to file the request, Councilman Briggs seconded, the motion carried by the following roll call vote: AYES: Councilmen - Briggs, Harker, Tyrell NOES: Councilmen- Merritt, Beckley ABSENT: Councilmen -None The City Manager advised a report had been made re the recommendation concerning the responsibility of the Traffic Commission and may be scheduled for a study session on Febr. 5, 1968. Mr. Gilbertson, Chairman of the Traffic Commission was present and agreed to have the Commission meet with the Council at this time to consider the report. All Traffic Commissioners will be so notified. City Manager Koski advised that the large tree at one time authorized to remain protruding into Emperor Ave. in the new curb and gutter project has been determined to be a traffic hazard and drainage problem and recommended authority be granted for its removal. Councilman Merritt moved to approve removal, Councilman Briggs seconded, and the motion carried unanimously. Carl Clark, Past - President of the Chamber of Commerce, thanked the Council for their wonderful assistance and cooperation for the past year, and felt the accomplishments of the Chamber proved their support well deserved. At this time Councilman Harker announced that he would be one of the incumbents in the coming Municipal election, and that he would be filing for re- election. Councilman Tyrell advised the Council that Congressman Wiggins had been appointed to the Municipal Affairs Committee of Congress. In talking to him Councilman Tyrell suggested having him attend a study session of the Council and give a quick run -down of what is going on at the federal level. It was agreed to do this with the time to be set when the Congressman would be available. ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman Merritt se- conded, and the motion carried unanimously. Council ad- journed at 9:55 P. M.
