A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCCALL, IDAHO
RELATING TO SURPLUS PERSONAL PROPERTY; DECLARING PERSONAL
PROPERTY SURPLUS; AUTHORIZING AND DIRECTING THE DISPOSAL OF
SURPLUS PROPERTY; PROVIDING FOR RELATED MATTERS; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of McCall, Idaho ("City") entered into a Contract
Agreement with Heartland Gymnastics, a nonprofit organization, on August 1, 2001; and
WHEREAS, the City agreed to loan certain personal property of the City to
Heartland Gymnastics under the terms of the Contract Agreement; and
WHEREAS, Heartland Gymnastics has now requested that the City donate the
specialized equipment loaned to them under the Contract Agreement; and
WHEREAS, the Parks and Recreation Director of the City of McCall has advised
the City Council that the personal property loaned to Heartland Gymnastics under the
Contract Agreement is surplus personal property no longer needed by the City of McCall
Parks and Recreation Department for creating and maintaining a recreation program that
meets the needs of the resident and tourist population of the community; and
WHEREAS, the City Council of the City has deemed it unnecessary to maintain
ownership of surplus personal property of the City specifically listed and described in
Exhibit A attached hereto and by this reference incorporated herein ("surplus property");
NOW, THEREFORE, it is hereby RESOLVED by the City Council of the City of
McCall, Idaho as follows:
Section 1: The City Council finds and declares that the City no longer has a use for the
surplus property listed and described in Exhibit A.
Section 2: The City Council finds and declares that it is in the best interest of the City to
donate the surplus property described in Exhibit A to the Heartland Gymnastics
Recreation and Learning Center in McCall, Idaho.
Section 3: The Parks and Recreation Director of the City of McCall is authorized to
donate the property listed in Exhibit A to Heartland Gymnastics Recreation and Learning
Center.
Section 4: The surplus property donated hereunder shall be "as is" and without warranty
and the City shall be free from all liability and claims of any nature related to current and
future condition and use of said surplus property.
Section 5: This Resolution shall take effect and be in force immediately upon its passage
and approval.
