Board of Health Meeting
Tuesday, January 3, 2012 at 7:00PM
Town Hall, Room B
Present: Joanne Hughes, Chairman, Lem Skidmore, Vice Chairman, Keith Johnson, Mary Chaffee, Jose Fernandez, Nancy
Ellis Ice, Health Director and Tammi Mason, Senior Department Assistant.
1. J.M. O'Reilly&Associates-continued variance request for 0 Lower Road
This was continued until the February 7, 2012 meeting.
2. Bennett Environmental-variance request for 21 Captain Dunbar Road
David Bennett presented this to the Board. This is a continuation of an early hearing. The variance being requested now
is as follows:
1. Separation between SAS gallery and SAS bed is not 22'. 8' held, 14'variance requested.
This is a State Variance. DB had re-submitted new plans and forms. The Board asked if the abutters were notified of the
new variance request. DB stated that they had not.
Motion: MC-notify abutters and then come back to the January 17, 2012 meeting for approval. KJ seconded. 5
yes.
3. Bennett Environmental- variance request for 23 Captain Dunbar Road
David Bennett presented this to the Board. This is an upgrade to an existing house. There was a question about the
number of bedrooms in the house. DB asked for the hearing to be continued so the Health Director could do a walk
through to determine the number of bedrooms. DB asked if abutters needed to be notified again. JH stated that as long
as the variances were not changing there was no need to re notify them. JH read a letter from an abutter. The Board
agreed to continue this hearing until February 7, 2012.
4. Ryder &Wilcox-variance request for 43 Landing Drive
Judy Bersin presented this to the Board. This is a new 4-bedroom home and septic system. The entire lot is within 300'
of the pond. The system has been located as far away as possible from the pond. Conservation Commission has not
approved this yet. Abutter's from 9 Janelle's Way questioned the notification process and also the size of the house.
Judy Bersin asked that this be continued until the next meeting so that Conservation Commission could hear it. The
Board agreed.
5. Ryder&Wilcox-variance request for 299 Landing Drive
Judy Bersin presented this to the Board. This is an existing dwelling and the SAS is only 235'away from the pond. It is
70'from groundwater. It is a new system.
Motion: MC-finding that the existing dwelling and SAS is 235' from pond, it is 70'from groundwater and is a new
system, approve the variance request. KJ seconded. 5 yes.

6. Paul Lively-Chef Paul's Truffle's-food service permit application
Paul Lively explained to the Board that he is looking to expand into more of the building. Adding a restaurant style
tasting table for 12 (building is limited to 18 seats). JH spoke about the Assistant Health Director's review of the
application. She had concerns with PL using the 3 bay sink for a counter space. PL told the Board that he does use it as
a sink now and also has a dishwasher now. There was a discussion on the seating and on what he calls"having
functions"at his restaurant. JH told him he needed to get his Allergen Awareness certificate into the office. NI told him
that he would need to get the septic inspected.
Motion: LS-approve food service permit application pending PL meeting all of the recommendations of the
Assistant Health Director. KJ seconded. 5 yes.
7. John Sundermier-request for six month extension for septic inspection approval
Mr. Sundermier explained that he may not be able to sell his house before the current inspection runs out. He would like
to get a six month extension so that it would be good for another six months.
Motion: JF-approve a six month extension. IQ seconded. 5 yes.
8. Toni & Dudley Young-66 Fortune's Furrow Way-failure to upgrade septic system
The Young's did not show up.
Motion: KJ-send letter that they have to upgrade or have a septic inspection to determine if the system is ok by
February 7, 2012 or the Board will start fining them. LS seconded. 5 yes.
9. 440 Main Street-failure to upgrade septic system
Noone showed up for this hearing.
The Board asked NI to find out if the house has been occupied and check to see who actually owns it now.
10. Steven Harrigan-7 Thousand Oaks Drive-failure to renew 0 & M contract
Mr. Harrigan could not make the meeting but did let NI know that he has a tentative contract with Winston Steadman.
The Board asked that NI contact Winston Steadman and find out about the contract. If nothing is in place, the Board will--
start fining as of the next meeting. -
11. Planning Board application for Peter Copelas
Noted.
