J.M. O'Reilly-continued variance request for 0 Lower Road This was postponed and will be on the May 1, 2012 meeting agenda. 4. Felco Engineering-continued variance request for 93 The Channel Way This was postponed and will be on the May 1, 2012 meeting agenda. 7. Brewster Recreation-food establishment permit application Ellen Ojala, Recreation Director was present. She stated that they are rebuilding the concession stand at Freeman's Way fields. They will be selling pre-packaged foods, hot dogs and may be selling pizza that will be kept in a warmer. NI told the Board that they are CFM exempt. A copy of the Inspector's recommendations was given to E0. Motion: LS-grant food establishment permit pending Inspector's recommendations. KJ seconded. 4 yes. 8. David Henchy-mobile food service permit application David Henchy explained to the Board that he will be delivering fresh fish to local homes. He showed the Board the packaging that the fish will be in and explained how he would be picking up the fish from Nantucket Fish Co. Motion: JF-grant mobile food service permit pending Inspector's recommendations. KJ seconded. 4 yes. 5. Ryder &Wilcox-variance request for 235 Underpass Road Judy Bersin presented this to the Board. The owner would like to ad fish manufacturing to his current food service operation. He will be putting an addition on for this and also make the upstairs apartment a bit bigger. JB told the Board that DEP approval for the industrial wastewater tank will be sought after the tank is installed. The following variance is being requested: 1. To allow the existing SAS to be nine (9) feet from the proposed cellar Motion: 10-as the variance does not effect the septic because the SAS is below the foundation, the variance shall be granted. LS seconded. 4 yes. 9. 98 Ebenezer-reverse decision on"unfit for human habitation"order Motion: LS-lift the"unfit for human habitation"order due to installation of a new septic system. At this time, the Board went into Executive Session with Sarah Turano Flores, Town Counsel. Motion: KJ-go into Executive Session and then return to the regular meeting. LS seconded. 3F-yes MC-yes 10-yes LS-yes JH-yes 8:00PM- Motion to exit ES and go back into regular BOH meeting was made by LS. KJ seconded. JF-yes MC-yes KJ-yes LS-yes JH-yes 3. Ryder&Wilcox-continued variance request&I/A approval for Lot 43 Landing Drive Stephanie Sequin went over the proposed I/A system for this lot, Owner would like to now do a three (3) bedroom deed restriction for the house. They have 6 rooms total. They will not be finishing the basement. Motion: LS-approve variance request and I/A system, provided that there is financial assurance mechanism in Place for the abutter who was concerned with damage to his property/trees and a 3 bedroom deed Restriction will be recorded at the Registry of Deeds. MC seconded. 5 yes. 6. Marie Gould-27 Beach Rose Lane-request to speak to the Board Ms. Gould did not show for the meeting. 11. Discuss public education on dog waste The Board agreed to hold off on this until the April 17, 2012 meeting. 12. Discuss Planning Board application for 311 Stony Brook Road / Noted. / 13. Members Sports club Fitness Center-OE/Food Service Permit Application / U f This was ost ned until the Ma 1 2012 meetin . ► if postponed May 1, 9 7 Bills to be paid were signed by the Chairman. The"Dogs Banned at Drummer Boy Park"regulation had a"service dogs"sentence added to it. The BOH ed the amended Regulation. Meeting adjourned at 8:30PM
