CALL OF MEMBERS The meeting was called to order by the Mayor at "` 00 p m Present were Counculmembers Enrique Garcia, Steve Liedman, Jorge F Mendia, Thomas Thornton, Patricia Weinman, Vice Mayor Robert L Vernon and Mayor Robert Oldakowski Also present were Village Manager Jacqueline R Menendez, Village Clerk Conchita H Alvarez and Village Attorney Stephen P Helfman 2 PLEDGE OF ALLEGIANCE Mr Nelson Zambrano led the Pledge of Allegiance 3 SPECIAL PRESENTATION Senator Gwen Margolis presented to the Council a $50,000 grant check to be used for '' illage Green improvements 4 APPROVAL OF MINUTES Councilmember Garcia made a motion to approve the minutes of the September 5, 2006 Regular Council Meeting The motion was seconded by Councilmember Thornton and approved by a 7-0 voice vote The vote was as follows Councilmembers Garcia, Liedman, Mendia, Thornton, Weinman, Vice Mayor Vernon and Mayor Oldakowski voting Yes The Clerk requested the addition of a resolution approving professional services agreement between the Village of Key Biscayne and Wallace Roberts and Todd, LLC to be heard after the Budget Hearing There was no objection to the request 1of6 September 12 2006 5 BUDGET RESOLUTION The Clerk read the following resolution by title A RESOLUTION OF 1 HE VILLAGE OF KEY BISCAYNE, FLORIDA, ADOPTING THE PROPOSED MILLAGE RATE OF THE VILLAGE OF KEY BISCAYNE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2006 THROLGH SEPTEMBER 30, 2007 PURSUANT TO FLORIDA STATUTE 200 065 (1 RIM BILL), SETTING A DATE FOR A FINAL PUBLIC HEARING TO ADOPT THE \'TILLAGE RATE, PROVIDING FOR AN EFFECTIVE DATE Councilmember Liedman made a motion to approve the resolution The motion was seconded by Councilmember Weinman 'dice Mayor Vernon made a motion to table the resolution adopting the proposed mmllage rate The motion was seconded by Councilmember Weinman and approved by a 7-0 voice vote The vote was as follows Councilmerbers Garcia, Liedman, Mendia, Thornton, Weinman, Vice Mayoi Vernon and Mayor Oldakowski voting Yes 6 ORDINANCES The Clerk read the following ordinance on first reading, by title AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, ADOPTING THE BUDGETS FOR THE FISCAL YEAR COMMENCING OCTOBER I, 2006 THROUGH SEPTEMBER 30, 2007 PURSUANT TO FLORIDA STATUTE 200 065 (TRIM BILL), PROVIDING FOR AN EFFECTIVE DATE Councilmember Garcia made a motion to adopt the ordinance on first reading Me motion was seconded by C,ouncilmember Thornton Chief of Fire Rescue John C Gilbert addressed the Council regarding the budget for the Fire Rescue Department Chef of Police Charles Press addressed the Council regarding the budget for the Police Department Jud Kurlaneheek, Director of Building, Zoning and Planning addressed the Council regarding the budget for the BZP Department Puhhc Works Director, Armando Nunez addressed the Council regarding the budget for the Public Works Department The Council requested, for the next budget hearing, a break down of the Contractual Services under the Public Works Budget 2 o 6 September 12 2006 Todd Hofferberth, Parks and Recreation Director addressed the Council regarding the budgets for the Parks and Recreation Department and the Community Center The Manager addressed the Council regarding the budgets for the Village Council and the Administration and Finance Department 1 he Council requested that the State and Federal Relations Representatives provide updates, on a monthly basis, to them The Clerk addressed the Council regarding the budget for the Office of the Clerk requesting an additional $10,000 for the election budget and an additional $5,000 for the election advertising budget in anticipation of a possible charter amendment election as a result of the recommendations that will be made by the Charter Revision Commission in 2007 There was no objection to the request f he Attorney addressed the Council regarding the budget for the Village Attorney The Attorney proposed to reduce the Lawsuits line item by $40,000 and increase the Professional Fees line item by $40 000 Director of Finance and Administrative Services, Randolph White addressed the Council and the public regarding the proposed budgets The Mayor opened the public hearing Mortimer Fried, 291 Harbor Court, Alan Fern, 525 Allendale Road, Hugh O'Reilly, 475 Allendale Road, Guido Conill, 600 Grapetree Dnve, Michael Davey, 425 Glenndge Road, Father Bob Libby, 200 Ocean Lane Drive, Camille Guethrng, 260 Seaview Dnve, Larry Radzville, 77 Crandon Boulevard, Ed Sanchez, 260 Cypress Road, Edward Keith, 240 Galen Drive, Rafael Perez, 524 Fernwood Road, Nelson Zambrano, 260 Fernwood Road, Theresa Hodges, 255 Glenndge Road, Carol Marcantonro, 17S Hampton Lane, Ed Stone, 145 Hampton Lane, Ramon Blanco -Herrera, 310 Femwood Road, Cecile Sanchez, 260 Cypress Dnve and Mike Kelly, 395 Gulf Road addressed the Council The Mayor closed the public, hearing The Chair of the Art in Public Places Board, Veronica Scharf Garcia, and Rosa de la Cruz, Member of the Art in Places Board addressed the Council requesting funds in the amount of 560,000 for the installation of a pemnanent art project that will be designed by Jose Bedra and $26,500 for Educational and Cultural Programs Ramon Castella with 3CTS addressed the Council regarding Fernwood Road improvements, including a new sidewalk with curbing on McIntyre Street (Fernwood to Glenndge) The estimated cost is 5530,000 The sidewalk on McIntyre Street from Fernwood to Glenndge is estimated to cost $20,000 3of6 September 12, 2006 Where was extensive discussion from Council regarding the parking spaces on Femwood Road It was the consensus of Council to defer the Harbor Drive Improvements item to the September 26, 2006 Second Budget Hearing The Manager and Director White also addressed the Council regarding the Capital Outlay and Reserves Analysis for FY 2007 Vice Mayor Vernon addressed the Council and the public regarding the budgets proposing to reduce the millage rate at the Second Budget Hearing on September 26, 2006 It was the consensus of Council to direct staff to prepare a five year projects©n of the operating budget using a 5% assessed value increase, in ,hiding the proposed Sonesta Project It was also the consensus of Council to direct staff to bring back, to the Second Budget Hearing, allocations for burying power lines and landscape Councilmember I iedman made a motion to remove from the table the proposed millage rate resolution The motion was seconded by Councilmember Thornton and approved by a 7-0 voice vote The vote was as follows Councilmembers Garcia, Liedman, Mendia, Thornton, Weinman, Vice Mayor Vernon and Mayor Oldakowski voting Yes The Clerk announced that the rolled -back rate is 2 752 mills and the proposed millage rate is 3 606 mills which is 31 03% over the rolled -back rate The motion to approve the resolution adopting the proposed millage rate f©r the fiscal year commenc1ng October 1, 2006 through September 30, 2007 was approved by a 7-0 voice'ote The vote was as follows Councilmembers Garcia.
