Update on 77 Stony Brook Road NI spoke about the assessment done by Debra Scavotto, Smooth Moving for Seniors. Per Elder Services, she will not be helping with this situation until all the structural issues are taken care of at the house. NI also stated that Tufts University had hired a home inspector to do an inspection last Thursday. She has not heard back from Tufts with regards to the results of that inspection. NI spoke about people going to the house to help out. Homeowner stated that a plumber has completed the work necessary. The owner still has no heat. MC spoke about the owner still living in the home after it was condemned. She told her that she needs to take any medical equipment and medications that she needs and relocate to a safer living environment. She is not supposed to be in the house. JH spoke about having the locks changed. MC stated that Tufts is the owner, so they would need to be in charge of the locks. The owner stated that she is not living in the house. She is staying with friends at night, but is in the house all day to clean. Motion: MC-move to proceed in the direction given by Town Counsel and act to secure the house at 77 Stony Brook Road because the owner has refused to comply with the Board of Health order that condemned the house. Elder Services will be contacted to give an offer to stay somewhere. The Health Director will engage the services of a locksmith to secure the dwelling. KJ seconded. 4 yes. 2. Update on 40 Sean Circle NI spoke about the inspection that was done today. The homeowner had stated that she is still getting estimates for the hot water heater to be replaced. The odor was still present although not as bad this time. The owner stated that the ARL can take the cats at the end of the week and there will be no more. The well water came back but needs to be retested',due to the presence of coliform. The owner stated that she is still working with her parent partner and her son is still trying to get set up to work with Webster Light. JH asked NI to find out about an ammonia meter from Barnstable County. MC asked the owner about the hot water heater situation. The owner stated that although she has gotten estimates, it's the financial aspect that is holding her back. She is waiting to hear from someone with regards to financing. NI stated that the yard looked a little better but there is still a lot of stuff that needs to be taken to the dump. The Town must document the state of the house, and therefore needs to do an inspection of all 3 levels of the house with photographs taken. The animals have to be removed, significant cleaning must be done, well test has to be done, and if it comes back with high levels of coliform again, some sort of remediation will need to be done. The hot water heater needs to be replaced or there must be a scheduled appointment for it to be replaced. On going cleaning of house and yard must be done also. KJ seconded. 4 yes. 3. Discussion on possible Rental Regulation NI stated that she did not have much done for this. The Board agreed that at this time there is no justification to have this regulation. 4. Discuss and possibly vote on Smoking in Workplaces Regulation NI stated that she is still waiting to hear from the Town Administrator as to whether or not this has to be reviewed by Town Counsel. The effective date was discussed and it was agreed that it would be upon publication. Motion: LS-adopt the regulations with a minor change and Town Counsel approval if necessary. KJ seconded 4 yes. 5. Discuss Animal Regulations The Board agreed that they would like to adopt the same regulations as Dennis and asked that NI go through them to see if anything does not pertain to Brewster and then bring it back to another meeting. 6. Discuss and possibly vote on Dog Waste Removal Regulation Board signed regulation with title change. 7. Discuss and possible vote on Zone II Deed Restrictions Regulation Motion: LS-approve the change to Regulation. KJ seconded. 4 yes. 8. Discuss and possibly vote on Variance Request Regulation There was discussion on what"upland"meant. NI suggested another public hearing. Motion: MC-change 3.2 (D) of the regulation to defined as 10,000 of upland lot size and add the definition of upland to the regulation. LS seconded. 4 yes. 9. Discuss Health Director's FY '13 Objectives There was discussion about the objectives. The Board approved them.
