Board of Health Meeting
Tuesday,October 16, 2012 at 7:00PM
Town Hall, Room A
Present: Joanne Hughes, Chairman, Lemuel Skidmore, Vice Chairman, Mary Chaffee, Keith Johnson, Nancy Ellis Ice,
Health Director and Tammi Mason, Senior Department Assistant.
1. Update with Police Chief re: Pets Banned from Beaches Regulation
This will be discussed at a later date.
2. Stephanie Kelly-Samaritans on CC&Islands-discussion on preventing suicide in the elderly
Ms. Kelly spoke to the Board about what the Samaritans do and the programs they have to provide assistance to those
elderly that may need it.
3. Public Hearing on changes to the Regulation Regarding Variance Requests
Richard Judd, local engineer, spoke to the Board about his concerns with these changes to the regulation. He spoke
about the below level rooms that are being counted in the room count with regards to egress issues, groundwater issues,
and spoke about the 300'setback requirement.
John O'Reilly, local Engineer, spoke about letter F under definitions (land in critical environmental habitats) and about 3.2
(D).
The Board asked NI to have Town Counsel check to see if Section 3.2 (D) could be moved and made 3.5.
4. Update on 40 Sean Circle
NI gave the Board an update on the status and about the inspection that was done today by herself and Sherrie
McCullough, Assistant Health Director. Pictures were taken and the basement and upstairs were inspected. NI stated
that they could not stay upstairs long enough to get pictures due to the heavy odor. The odor is not as bad on the main
level as it was before. Although the owner stated the carpets had been ripped up, the odor is still present, which may
mean that it has seeped into the flooring. Well testing results have not been received by the office at this time. The
owner stated that she is still working on getting the hot water heater fixed.
NI stated that all but 2 cats and the dog are gone and that the yard outside is in worse condition than when they
previously went.
NI spoke to Marina Brock from the County about an ammonia meter and she stated that if you could smell it when you
were in the house than it was already at a dangerous level.
MC stated that she was very concerned about how unhealthy this living situation is. She encouraged the owner to find
another place to live while the cleaning continues.
The Board agreed to a one month extension of time provided that the following be done by the time the owner returns to
the next Board meeting on November 13, 2012:
1. Cats and dog must be gone
2. Hot water heater must be installed

3. Bedrooms must be cleaned out
4. Trash in yard must be taken away.
NI will go and do another inspection prior to the next meeting. Owner will attend the next meeting.
5. Discuss proposed Landfill Regulations
MC told the Board that the Recycling Committee met and they asked the BOS not to take any action at this time and to
remove the article from the warrant.
The Board will discuss this at a later date.
6. Discuss proposed Animal Regulations
The Board discussed the proposed regulations and had changes. The proposed regulation will be redone and brought
back to the Board.
7. Discuss Body Art Regulations
The Board was fine with what is existing.
8. Discuss Policy and Guidelines for Title 5-State Sanitary Code
NI stated that this is in conflict with the Bedroom Definition and should be rescinded.
Motion: MC-rescind policy. K7 seconded. 4 yes.
9. Discuss Article 9 on Town Warrant(preserve 82 Acres at Freeman's Way and Slough Road)
JH gave a brief synopsis about this.
Motion: LS-BOH supports Article 9. MC seconded. 4 yes.
Informational items were noted.
