Update on 40 Sean Circle NI gave an update to the Board. An inspection of the property was done today. NI along with the Assistant Health Director, Animal Control Officer, a member of the MSPCA and the homeowner's parent partner were present at that inspection. It was noted that the second well sample came back normal. It was also noted that there were still 2 cats and a dog present in the home. The owner stated that she is planning on taking the cats to the Animal Rescue League in hopes that they can be adopted. They will not return to the property. The dog will be gone when the son moves out of the home. The homeowner stated that she is signing a contract with a company to replace the hot water heater. The bedrooms were not cleaned out although in one of the rooms the carpet was partially torn out. The yard still has issues, no cleaning was done in the basement and the odor in the home is still overwhelming. The homeowner stated that she could have the basement cleaned up within 3 weeks. NI stated that a hoarding therapist is going to be working with the homeowner to help get the house cleaned up. The homeowner asked if the Town would be willing to waive the dump fees for the scrap metal that she needs to get rid off. She was told that the request would have to be made to the Selectmen for that. Co-owner of the home told the Board that he would be doing dump runs and could have the whole yard cleaned up within a week. MC spoke about her concerns with the odor in the home and stated that she would like to be present at the next inspection. JH would also like to be present at the inspection. The Board requested that the homeowner come back to the December 4th meeting to see how the clean up is going. 2. Discuss proposed Variance Request Regulations There were 2 items that were added to the regulation: 1) definition of buildable upland and 2) Section 3.5 with regards to new construction and the 300 foot setback. Motion: LS-approve the regulation as modified. KJ seconded. 4 yes. 3. Discuss proposed Animal Regulations NI stated that the Animal Control Officer's job descriptions were obtained. There was discussion on the Kennel part of the regulation. W W W.TO WN.BREWSTER.MA.US 11/7/12 Minutes Page 2 The Board agreed that the Regulation will go to Town Counsel for review and then the Board will hold a public hearing. 4. Minutes from 10/2/12 meeting A few minor changes were made. Motion: LS-approve minutes with changes. KJ seconded. 4 yes. 5. Minutes from 10/16/12 meeting Motion: LS-approve minutes. KJ seconded. 4 yes. 6. Release performance bond money Motion: KJ-release performance bond money. LS seconded. 4 yes. Add on's NI handed out the subpoena for the Brewster Pizza court case and gave the Board some information. NI told the Board that she had been asked to look at private wells surrounding the area where the multi use park was being proposed. She did look through all the files and noted that water flow was not towards most of the wells with the exception of one lot which may be affected depending on where the actual "dog" portion of this park was. Bills to be paid were signed by the Chairman. Information items were noted. An update was given on informational item #2 (preliminary injunction at 77 Stony Brook Road). NI went there last week to do an inspection and noted that nothing had changed. The owner is still living in the home, despite the order that the home is unfit for human habitiation. The police are checking daily and are reporting back to Town Counsel when they find her in the house. Meeting adjourned at 8:00PM. 1/31f fpi _ 1
